负面清单制度下我国政企关系研究—基于工商行政管理视角

摘 要

改革开放以来,我国已逐步由传统计划经济体制向社会主义市场经济体制转变,政府与企业的关系得到了一定程度的调整。伴随着我国经济的快速发展，行政管理体制暴露出更多的问题，政府与企业之间的关系也逐渐不和谐，对我国着力改革的政府职能转变有着消极的影响。尤其是在负面清单制度的实施过程中，如何建立一套行之有效的政企关系以满足负面清单管理制度的要求，并且能够与我国市场经济的发展趋势相吻合，显得尤为关键和重要。

负面清单管理制度要求政府职能进行改变，改变我国重视审批流程忽略政府监管的现有政府职能模式，重新树立政府和企业的新型关系，促进企业尤其是国有企业的发展。促进国有企业的发展首要的就是做到政企分开，只有政企分开，转变政府只能，才能够使企业应对市场经济做出相适应的改变。在中国的传统体制中,政府和国有企业是“父子”关系。负面清单制度同时要求我国现在政企关系的重新定位，重新塑造政府和企业之间的各种关系，树立以企业为市场主体的地位，政府作为公共机构的主体。本文依据政府与企业关系的一些理论,分析了在负面清单制度下,我国政府与企业关系的状况,对我国政企关系的重塑提出了一些创造性的意见。

文章分为五个部分：

第一部分是导论。介绍研究的背景和意义，综述国外和国内相关研究的状况，并且指出本文研究的方法和创新点。

第二部分概述负面清单管理制度和政府企业的关系。阐述负面清单的概念，政府、企业以及政企之间的关系，分析在负面清单制度下政企的关系。

第三部分分析负面清单制度下我国政企关系的现状。从政企不分的现象分出发，阐述政企不分造成的危害，分析政企不分的原因。

第四不分提出构建负面清单管理制度下新型政企关系的途径。从重塑政企关系、界定和调整政府机构等方面考虑建立新的的途径改善政企关系。

第五部分为结论。对全文做一个简要的概括和总结。

Abstract

Since the reform and opening, our country has gradually from the traditional

planned economic system to socialist market economic system transformation, the

relationship between government and enterprises to a certain extent. With the rapid

development of economy in our country, more problems of the administrative system

and the relationship between the government and the enterprise also gradually not

harmonious, focus on the reform of our country has a negative influence of the change

of government function. Especially in the negative list system of the implementation

process, the relationship between government and enterprises how to establish an

effective to meet the demand of the negative inventory management system, and can

be in conformity with the trend of the development of market economy in our country,

especially the key and important.

Negative listing management system requires the functions of the government to

change, change our country attaches great importance to the process of examination

and approval to ignore the government regulation of the existing mode of government

functions and to set up the new relation between government and enterprises, promote

the development of enterprises, especially state-owned enterprises. Top to promote the

development of state-owned enterprises is to separate government functions from

enterprise management, only separate government functions from enterprise

management, change the government only, can make the enterprise to make to

accommodate changes in the market economy. In traditional system of China, the

government and state-owned enterprises is the parent-child relationship .Negative list

system of the relationship between government and enterprises in our country now

also required to reposition, reshaping the relationships between governments and

enterprises, set up by the enterprise as the market main body status, the government as

the main body of public institutions. In this paper, based on the theories of some of

the relationship between government and enterprises, under the negative clearance

system is analyzed, the condition of the relationship between government and

enterprises in our country, the reshaping of the relationship between government and

enterprises of our country put forward some creative ideas.

The article is divided into five parts:

The first part is introduction. Introduces the research background and

significance, reviews the status of the foreign and domestic related research, and

pointed out in this paper, research methods and innovations.

The second part Outlines the negative listing enterprise management system and

government relations. Explains the concept of negative list, the relationship between

the government, enterprise and enterprise, analyzes the relations between government

and enterprises under negative list system.

The third part analysis the present situation of the relationship between

government and enterprises under negative list system in our country. Starting from

the phenomenon of the points, the paper expounds the damage enterprise management,

analyses the reason of enterprise management.

Fourth irrespective of the negative relationship between government and

enterprises under the new inventory management system is proposed. From the

relationship between government and enterprises to reshape, definition and

adjustment of government agencies and redefine the functions of the government

consider the relationship between government and enterprises to establish new way to

improve.

The fifth part is conclusion. For a brief summary of the whole paper, summary.
