法律语言的语言特征
法律语言是民族共同语在长期的法律科学和 法律实践中逐步形成的、服务于一切法律 活动而且具有法律专业特色的一种社会方 言，是在法制发展过程中，按法律活动(立 法、司法、法律科研)的要求逐步磨砺、逐 步构建的一种有别于日常语言的“技术语 言”，是全民语言的一个社会功能变体， 具有很强的功用性特点，如社会价值、逻 辑性、技术性，也具有很强的语言性特点。

• 在翻译实践中，要达到忠实、通顺的翻译标准是不容易的。 在翻译中，忠实与通顺是一个矛盾统一体的两个方面。二 者相辅相成，不可割裂。忠实是翻译的首要问题，因而是 矛盾的主要方面，在翻译中要首先解决好。通顺是矛盾的 次要方面，是第二位的，但在实践中决不可只顾忠实而忽 视了通顺，二者必须“统筹兼顾”。
商业协议类，如国际贸易合同，贷款合同，租约等；
– 仲裁诉讼文书类，如起诉状（ Complaint）判 决书（Civil Judgment）、仲裁协定（Arbitral Agreement）等；
– 经济组织内部法律文件类，如公司章程 （Articles of Association）、董事会会议记录 （Minutes of the Meeting of Directors）、股东 声明(Shareholder Representation Letter)等；
• 这是典型的对同一事物的不同语言视角。这种不同的视角和说法是有 重要的法律意义的：如果你打掉的是“婴儿”(“baby”)，则你犯有杀 人罪、谋杀罪；如果打掉的是“胚胎”(“fetus”)，则无杀人之虞，无 犯罪之嫌。这样的主观态度的表达不仅存在于词汇选择上，也存在于 语法和语用层面上。总之，对语言中表达的主观态度的批评性研究有 助于法官和陪审团做出公正的裁决。

第一章法律翻译概述（课堂讲练材料）本章教学目的：1、了解法律翻译的概念、基本特点、法律翻译常用文本类型；2、了解法律翻译者应具备的基本素质课堂教学：一、法律翻译的概念法律翻译，是指对法律法规、法律专著文献、涉及法律的商务、经贸、金融等相关专业的翻译活动。

此处提及法律翻译概念，有两个意义。

请看以下译文对比：示例1、（1）、A burned child dreads the fire.译文1、烧伤的孩子害怕火。

译文2、一朝被蛇咬，十年怕井绳。

（2）、He had one foot in the grave.译文1、他的一只脚已经踏进了坟墓。

译文2、他已经是半截入土的人了。

译文3、他已经风烛残年。

（3）、冬天，有一个双目失明的乞丐在纽约大街上乞讨，他的脖子上挂着一块牌子，写着“Blind since childhood”.有一个落魄诗人正巧路过，乞丐听到脚步声，向他乞讨。

诗人说：”我也很穷，不过我可以给你点东西。

“说完，就在乞丐牌子上写了一句话。

那天，乞丐得到了远远多于往日的施舍。

后来，乞丐又遇到那位诗人，问诗人到底在牌子上写了什么，诗人回答：“Spring is coming, but I can’t see it.”示例2、（1）、Where a defendant is fined and the same is not forthwith(means: at once, without delay) paid ,the magistrate （the official who acts as the judge in the lowest courts of law）may order the defendant to be searched.译文：如被告人被判处罚款，但没有随即缴付该罚款，裁判官可命令搜查被告人。

It is not possible to gain an insight into the nature of any institution of human life without an inquiry into the purposes or functions which the particular institution is designed to accomplish. Nobody can intelligently discuss problems of government and arrive at a considered judgment with respect to the policies which should be promoted by public officials or agencies without first forming an opinion as to the general aims and ends for which governments are established. This is equally true for the institution of law, at least in the secular, political sense with which we are concerned. We treat law as a particular kind of governmental institution. From this perspective, we assert that no official within the institution of law—no judge, attorney or other person with official duties in the administration of law—can adequately discharge his or her duties unless familiar with the general purposes which the law is supposed to perform for society.

Functions of legal document

法律文本的主要功能应当是呼吁、规范， 提供信息只能是它的各种次要功能之一、 法律文本具有规定、约束性功能以规范和 指导社会与个人之间、个人与个人之间在 政治、经济和文化等领域的活动和行为， 其规范功能受到国家强制力的保护，具有 强制性。
