国家税务总局山西省税务局关于修订《山西省税务行政处罚
裁量基准（试行）》的公告
为进一步优化税务执法方式，优化税收营商环境，促进严格规范公正文明执法，国家税务总局山西省税务局对《山西省税务行政处罚裁量基准（试行）》（国家税务总局山西省税务局公告2018年第8号发布）违法行为第（三十一）项“纳税人未按照规定的期限办理纳税申报和报送纳税资料的，或者扣缴义务人未按照规定的期限向税务机关报送代扣代缴、代收代缴税款报告表和有关资料的”的税务行政处罚裁量基准进行了修订，现予以发布。

本公告自发布之日起施行。

《山西省税务行政处罚裁量基准（试行）》（国家
税务总局山西省税务局公告2018年第8号发布）违法行为第（三十一）项的税务行政处罚裁量基准同时废止。

执行概要原平市热力公司将凭借具有现代管理理念的团队和精湛的技术水平为依托，以原平市集中供热为起点，可在全国范围内选择适当城市发展城市集中供热事业。

原平市热力公司集中供热现已建成两个供热网—-—电厂网（经山西省忻州市发展计划局忻计国环发(2001)287号文件批准建设)和化二网（经山西省原平市发展计划局原计基字（2002）140号文件批准建设）。

电厂网由山西省太原理工大学建筑设计研究院设计，采用“汽轮机真空运行及废蒸汽回收，循环水集中供热"方案,设计总投资2800万元，供热面积80万m2，热网供水温度70℃，回水温度55℃；化二网由化学工业部第二设计院设计，利用原平市化工有限责任公司（主要产品为草酸和元明粉）脱氢和成品车间的循环水进行集中供热，设计总投资1000万元，供热面积40万m2,热网供水温度69℃，回水温度54℃，均采取“大流量、小温差”、24小时不间断的方式连续供热。

截止目前，电厂网已实现集中供热面积75万m2，化二网实现集中供热面积30万m2，另外，我公司对山西原平水泥电杆厂小区、中国人民解放军第83预备役师西小区原有的锅炉房进行改造，实施区域供热6万m2。

现在的热价是居民7元/采暖期·建筑m2，非居民13元/采暖期·建筑m2，综合热价为10元/采暖期·建筑m2.随着城市的发展和市民生活水平的提高，新建建筑以每年10%的速度增加，热用户对我公司的供热需求越来越大,为了进一步满足市民对集中供热的迫切要求和公司的发展，我们需要理顺电厂管理体制，充分挖掘电厂热源潜力, 不断完善和加强电厂热源的供热能力，扩建改造热电厂，通过对1#锅炉的完善,2＃锅炉的改造,3#锅炉的完善（4#锅炉系2006年新建），2＃机组的大修以及3台机组打孔抽气、更换1#、2＃机组冷凝器等技术手段及措施，采用四炉三机的模式，全面提升供热能力，将电厂网由目前的“大流量、小温差”低温水直供模式改为“小流量、大温差”高温水间供模式，使热电厂供热能力最终达到到250万m2，覆盖京原南北路两侧；同时新建两个热源点—-—城西（接收原化二网用户)锅炉房（130万m2)覆盖从永康路以西地区、平安大街锅炉房（150万m2）覆盖平安大街两侧及以北地区，采用热水锅炉区域供热(综合热价为14元/采暖期·建筑m2）的办法，解决北城区和西城区用户对供热的需求,5年内使原平城区大部分建筑实现集中供热.我们正在寻求3000万元的资金支持，这笔资金用于新热源点的建设和热电厂的改造及其配套管网建设.我们计划通过公司重组的方式引进投资者，与投资者合作经营，给投资者以合理的最大回报。

二、税务师事务所依据《注册税务师管理暂行办法》规定，严格按照业务规程开展涉税鉴证和涉税服务。

服务收费应遵循公开、公正、诚实信用的原则和公平竞争、自愿有偿、委托人付费的原则，与委托人签订收费合同（协议）并开具合法票据。

三、涉税鉴证业务收费标准见附表，涉税服务业务实行市场调节价。

四、税务师事务所应当在显著位置公布服务项目和收费标准等信息，自觉接受价格主管部门的检查和社会监督。

五、涉税鉴证业务实行严格市场准入制，除依法设立并纳入省级税务机关监管的税务师事务所外，其他中介机构和团体一律不得从事涉税鉴证业务并收费。

六、本通知从2009年4月1日起执行，期限为一年。

二○○六年七月二十六日房产税城镇土地使用税车船使用税资源税减免审批办法一、为进一步规范房产税、城镇土地使用税、车船使用税、资源税减免审批，根据《中华人民共和国税收征收管理法》及其实施细则和国家税务总局有关规定，结合山西省地方税务局涉税事项首办负责制、限时办结制的要求，制定本办法。

二、本办法所指的减免是指房产税、城镇土地使用税、车船使用税的困难减免和资源税的自然灾害、意外事故损失减免。

三、纳税人发生本办法第二条所列的情况时，应分税种及时向主管地方税务机关提出书面申请，并报送以下资料：（一）减免税申请报告，列明减免税理由、依据、范围、期限、数量、金额等。

（二）申请减免期的财务会计报表，纳税申报表。

（三）有关部门出具的证明材料1、危房减免需提供房管部门出具的证明材料。

2、自然灾害和意外事故损失减免需提供保险公司、主管部门或事故处理部门出具的证明材料。

3、交通事故减免需提供公安交警等部门出具的证明材料。

4、其他减免需提供有关部门出具的证明材料。

（四）地方税务机关要求提供的相关资料。

纳税人报送的材料应真实、准确、齐全。

四、地方税的困难减免、自然灾害和意外事故减免，由纳税人提出申请，各级地方税务机关审核，省地方税务局集中审批，并在60个工作日内办结。

山西省地方税务局关于印发〈山西省土地增值税预征管理办法〉的通知（已废止）发文字号: 晋地税税一发〔2005〕6号发文日期:2005-04-04各市地方税务局、省局直属征收局:《山西省土地增值税预征管理办法》业经全省税政工作会议讨论，现印发给你们，请认真贯彻执行，执行中有什么问题请及时报告省局。

山西省土地增值税预征管理办法第一条为了加强土地增值税的征收管理，根据《中华人民共和国税收征收管理法》、《中华人民共和国土地增值税暂行条例》等有关法律法规的规定，制定本办法。

第二条凡在山西省境内从事房地产开发的单位和个人，均应按照本办法预缴土地增值税。

第三条土地增值税预征率：5%以内各市可根据当地房地产市场的实际情况，在省确定的幅度内制定具体的预征比率。

土地增值税以纳税人取得的预收款为计税依据，按下列公式计算预征税额：土地增值税预征税额=预收款×预征率预收款包括预售款、定金，实物及其他经济利益。

第四条土地增值税实行“项目登记、按月预缴、最终清算、多退少补”的征管办法。

纳税人应于取得房地产开发项目许可后三十日内，向主管地方税务机关填报《土地增值税项目登记表》，办理土地增值税项目登记手续。

纳税人每月取得的预收房地产收入，应于月份终了后十日内向主管地方税务机关如实填报《土地增值税预缴申报表》，申报预缴税款。

纳税人应于房地产开发项目竣工结算并转让完毕后十日内，向主管地方税务机关填报《土地增值税纳税申报表》（代清算申请），申请办理土地增值税清算手续。

第五条纳税人具备清算条件而不按规定向主管地方税务机关填报《土地增值税纳税申报表》，申请办理土地增值税清算手续的，主管地方税务机关应当责令其提供有关资料，并进行清算。

第六条主管地方税务机关应在受理纳税人清算申请之日起十日内完成税款清算工作，并填制《土地增值税清算表》，按规定补征或退还税款。

第七条纳税人在办理土地增值税清算手续时，应向主管地方税务机关提供以下资料：1、政府计划主管部门下达的投资计划文件；2、土地使用权受让合同；3、房地产销售（预售）合同；4、房地产开发项目的建安合同和结算资料；5、与转让房地产有关税金的完税凭证；6、主管地方税务机关要求提供的其他资料。
