装卸时间的计算装卸时间的计算一、装卸事实记录或装卸时间表装卸事实记录(1aytime statement of fact),有的使用装卸时间表(1aytime sheet),是用以记载船舶从到达港口引航站时起,到装卸货物完毕时止的这段期间内船舶所进行的装卸作业的起止时间和待时的起止时间和其待时原因等事项的记录。
装卸事实记录的内容主要包括:船舶抵港时间,NOR的递交时间及接受时间、引航员登船引领时间、靠泊时间、海关检疫完成时间,每天装卸作业起止时间、星期日、节假日、不良天气、装卸设备故障、等待货物和等待接运工具等中断或除外事项的起止时间,以及装卸完毕时间和装卸货物数量等。
装卸事实记录是计算装卸时间的事实依据。
它通常由船舶代理人根据船长或港口的作业记录编制而成。
装卸作业完毕时,船长、货主或其代理人须对记录的事实逐一核对,认为没有异议后,船长、发货人、收货人或其代理人在该文件上签字。
签字后的事实记录船长保留一份,船舶代理人转交出租人、货方各一份。
有了上述三份文件,出租人便可以制作滞期费/速遣费计算单(demurrage/despatch money calculation sheet),然后将此表连同前面提到的三份文件交给承租人索要滞期费。
当然,在存在速遣费时,这些文件通常由承租人作出,向出租人索要速遣费。
在租约对索要滞期费/速遣费有时间限制时,应在规定的时间内作出并送达对方,否则,视为索赔方放弃索赔要求。
在无索赔时间规定时,索赔时效应按租约适用的法律规定执行。
一般地,租约中都规定滞期费/速遣费在装卸完毕后一个月内结算。
二、滞期时间的计算通常滞期时间是按“滞期连续计算”原则计算的(demurrage runs continuously),也称作“一旦滞期,永远滞期”(once on demurrage,always on demurrage)。
其含义是在开始进入滞期后,所有的中断、除外时间都算作滞期时间,如遇星期天、节假日、坏天气等都不再作扣除。

3、某船东将船舶出租,从我国的青岛装运袋装的玉米和大豆运往日本东京,船东与租船人签订了航次租船合同,合同中约定了相应的滞期与速遣条款。
船东在装上玉米和大豆后,发现还有空舱,为了自身利益,就又在货舱内堆装了一些其他的货物。
在当年的1月,船舶抵达日本东京,1月21日船舶出具了《准备就绪通知书》,但由于货物超载,袋装的玉米和大豆在2月6日才可以卸载,但事实上,收货人2月19日才开始卸货,最终于4月25日卸完全部货物。
对此案中卸货时滞期费如何计算,双方产生分歧。
船方认为应该从1月21日《准备就绪通知书》出具时起算卸货日,因而计算得出租船人应支付巨额滞期费,而租船人认为卸货日不应从1月21日起算,而应从2月19日起算。
一、装卸事实记录或装卸时间表装卸事实记录(1aytime statement of fact),有的使用装卸时间表(1aytime sheet),是用以记载船舶从到达港口引航站时起,到装卸货物完毕时止的这段期间内船舶所进行的装卸作业的起止时间和待时的起止时间和其待时原因等事项的记录。
装卸事实记录的内容主要包括:船舶抵港时间,NOR的递交时间及接受时间、引航员登船引领时间、靠泊时间、海关检疫完成时间,每天装卸作业起止时间、星期日、节假日、不良天气、装卸设备故障、等待货物和等待接运工具等中断或除外事项的起止时间,以及装卸完毕时间和装卸货物数量等。
装卸事实记录是计算装卸时间的事实依据。
它通常由船舶代理人根据船长或港口的作业记录编制而成。
装卸作业完毕时,船长、货主或其代理人须对记录的事实逐一核对,认为没有异议后,船长、发货人、收货人或其代理人在该文件上签字。
签字后的事实记录船长保留一份,船舶代理人转交出租人、货方各一份。
有了上述三份文件,出租人便可以制作滞期费/速遣费计算单(demurrage/despatch money calculation sheet),然后将此表连同前面提到的三份文件交给承租人索要滞期费。
当然,在存在速遣费时,这些文件通常由承租人作出,向出租人索要速遣费。
在租约对索要滞期费/速遣费有时间限制时,应在规定的时间内作出并送达对方,否则,视为索赔方放弃索赔要求。
在无索赔时间规定时,索赔时效应按租约适用的法律规定执行。
一般地,租约中都规定滞期费/速遣费在装卸完毕后一个月内结算。
二、滞期时间的计算通常滞期时间是按“滞期连续计算”原则计算的(demurrage runs continuously),也称作“一旦滞期,永远滞期”(once on demurrage,always on demurrage)。
其含义是在开始进入滞期后,所有的中断、除外时间都算作滞期时间,如遇星期天、节假日、坏天气等都不再作扣除。
1)滞期费的计算滞期费应按照滞期时间和约定的滞期费率计算,是没有什么问题的,但是,一旦发生滞期,在滞期期间的星期日、节假日,乃至因天气或其他原因停止工作的时间是否也作为滞期时间计算滞期费,常是承租人和船舶所有人之间发生争议的问题。
为了避免争议,在租船合同中,必须使用一些具有一定涵义的用语来表明滞期时间包括的范围。
这就是“滞期时间非连续计算”和“滞期时间连续计算”。
①“滞期时间非连续计算”:又称“按同样的日”(per like day)。
是指计算滞期的“日”的涵义与计算装/卸时间的“日”的涵义相同,如果计算装/卸时间使用的是晴天工作日(per weather work),即不包括星期日、节假日、天气不良等停止工作时间的“日”,(SSHEX: Saturday, Sunday holiday except)则计算滞期时间的“日”中也不包括这些时间,也就是说在滞期期间,星期日,节假日及天气不良等原因停止工作的时间,都不应计入滞期时间。
即滞期时间是断续计算的。
②“滞期时间的连续计算”(demurrage runs continuously)或称“一旦滞期,永远滞期”(once on demurrage, always on demurrage)。
是指进入滞期后,即使遇有星期天,节假日、天气不良等原因停止工作的时间,也应计为滞期时间,直至货物装/卸完毕。
当然,因严重自然灾害,或船方原因而停止工作的时间,或合同中明确规定不计入滞期的时间,均不能计为滞期时间。
合同中,关于滞期时间的计算,通常都是按照“滞期时间连续计算”约定的,即滞期时间的计算以“一旦滞期,永远滞期”为原则。
也就是说,一旦进入滞期后,滞期时间的所有星期日、节假日等不良天气等停止工作的时间,均应计为滞期时间。
2)滞留损失虽然对于滞留时间,承租人必须向船舶所有人支付一定的滞期费,但是,滞期费只能补偿因船舶滞期而产生的损失,而不能使船舶所有人获得利润,尤其是如果滞期时间过长,可能使船舶所有人遭受更大的损失。
装卸时间和滞期费/速遣费的计算示范

缮制装卸时间事实记录(SOF)装卸时间事实记录是订有滞/速计算的船舶在干装卸作业的实际情况记录。
它反映船舶从抵港之装卸完毕的全面情况,是船、租、港、货各方计算装卸时间与结算速遣/滞期费的重要依据,是外勤业务员现场工作中的一项重要内容。
工作须知(一)熟悉租约/买卖合同/协议书等规定。
缮制事实记录,要求实事求是,有理有利,兼顾管家经济利益切实熟悉掌握有关规定,特别要注意不同租约的不同规定。
例如:“作业期间的开仓盖”、“装货前的铺垫舱:、”“允许两次移泊”等经常有异的时间计算。
(二)详细记录,分清责任(1)记录的时间必须逐日时连贯,中间不得有空隙或省略,防止计算装卸时间的无法确定其是否属于应予计算的装卸货时间。
(2)船舶抵达锚地,联检后在等泊过程中遇有不良天气,应同时注明“等泊”和“不良天气”,以便按合约不同规定扣除或不扣除。
(3)装卸开始前及装卸过程中,注意等泊/等工人/等货物期间的一般公认的坏天气,或不适合货物装卸的坏天气,应按“坏天气”记录,不作“装卸货时间”计算。
等泊期间的坏天气,可参照当地气象台或其他习惯饮用的资料。
(4)在港作业过程中出现的坏天气,大浪日(SURF DAY),雨、雪天、雪后清扫船上积水,积雪所用去的时间必须做好记录。
(5)与港方订有滞/速计算的船舶,同一舱口的两对吊杆中一对损坏,应把舱口号数,损坏时间记载清楚。
(6)属船方原因造成装卸停工(如纹车故障,货灯熄灭,索具更换,船电中断等),记录中必须注明“由船方某某原因熬成停工”以明责任。
纹车动力不足,影响装卸,亦应详细记载原因和时间。
(7)因工人损坏纹车造成停工,并为港方确认,可以把损失的时间和原因记载清楚,也可以照旧记载为“装卸”,记为装卸时间。
(8)移泊时间:1.移泊前,从停止装卸至等候移泊所占去的时间,可并入移泊时间,按“移泊”登录,或记录为“准备移泊”;2.如等候移泊时间较长,超过正常所需时间,属港方原因,应按“等候移泊”记录;属船方原因,“船舶准备移泊”记录;属潮小原因,按“候潮移泊”记录,绝不能用“停工”或者“候装卸”等原因不明的记录。
一、装卸事实记录或装卸时间表装卸事实记录(1aytime statement of fact),有的使用装卸时间表(1aytime sheet),是用以记载船舶从到达港口引航站时起,到装卸货物完毕时止的这段期间内船舶所进行的装卸作业的起止时间和待时的起止时间和其待时原因等事项的记录。
装卸事实记录的内容主要包括:船舶抵港时间,NOR的递交时间及接受时间、引航员登船引领时间、靠泊时间、海关检疫完成时间,每天装卸作业起止时间、星期日、节假日、不良天气、装卸设备故障、等待货物和等待接运工具等中断或除外事项的起止时间,以及装卸完毕时间和装卸货物数量等。
装卸事实记录是计算装卸时间的事实依据。
它通常由船舶代理人根据船长或港口的作业记录编制而成。
装卸作业完毕时,船长、货主或其代理人须对记录的事实逐一核对,认为没有异议后,船长、发货人、收货人或其代理人在该文件上签字。
签字后的事实记录船长保留一份,船舶代理人转交出租人、货方各一份。
有了上述三份文件,出租人便可以制作滞期费/速遣费计算单(demurrage/despatch money calculation sheet),然后将此表连同前面提到的三份文件交给承租人索要滞期费。
当然,在存在速遣费时,这些文件通常由承租人作出,向出租人索要速遣费。
在租约对索要滞期费/速遣费有时间限制时,应在规定的时间内作出并送达对方,否则,视为索赔方放弃索赔要求。
在无索赔时间规定时,索赔时效应按租约适用的法律规定执行。
一般地,租约中都规定滞期费/速遣费在装卸完毕后一个月内结算。
二、滞期时间的计算通常滞期时间是按“滞期连续计算”原则计算的(demurrage runs continuously),也称作“一旦滞期,永远滞期”(once on demurrage,always on demurrage)。
其含义是在开始进入滞期后,所有的中断、除外时间都算作滞期时间,如遇星期天、节假日、坏天气等都不再作扣除。
