39. (1) 不合法之处主要有:第一,“试用期6个月”约定违法。
《劳动合同法》规定,劳动合同期限满1年不满3年的,试用期不超过2个月。
第二,“试用期工资500元”违法。
《劳动合同法》规定,试用期工资为约定工资的80%,同时不得低于当地最低工资标准。
第三,“试用期满后开始缴纳社会保险”违法。
公司应该依法从建立劳动关系之日起,即在试用期内缴纳社会保险。
(2)合法。
因为《劳动合同法》39条规定,劳动者严重失职,给用人单位造成重大损失的,用人单位可以解除劳动合同。
(3)假设双方合同到期正常终止,甲公司可以不向王某支付经济补偿的条件是王某因重大失职给公司造成重大利益损失。
40. (1)否。
因为劳动合同法规定,劳动者与用人单位解除劳动合同应以书面形式,口头无效。
(2) 乙外资企业在本案中承担法律责任的条件是,乙外资企业明知李某未与甲私营企业解除合同,还与其签订劳动合同,违反了劳动合同法规定的竞争限制条款。
(3)假设李某只为追讨甲私营企业自2010年3月开始拖欠其3个月的工资,没有提出解除合同,根据劳动合同法的规定,便捷的救济途径是向当地政府劳动行政主管部门申诉,或直接向法院申请支付令。
按照现行法律规定,他可以得到被拖欠的三个月工资及一个半月的经济补偿金。
(4)假设甲私营企业欲与李某补签竞业限制合同,其法律依据是《劳动合同法》第23条,即用人单位与劳动者在劳动合同中约定保守用人单位的商业秘密与知识产权相关保密事项。
