CE-PED压力设备指令依据欧洲共同体1997年5月29日发布之压力设备指令(97/23/EC)规定各会员国应于1999年1月1日以前订定法律配合该指令,并于1999年11月29日起正式实施,实施缓冲期订于2002年5月29日(电磁兼容性指令实施缓冲期订于1995年底,低电压指令实施缓冲期订于1996年底),压力设备自2002年6月1日起所有输欧产品均需符合欧市相关安全规定并黏贴CE标志,才能进入欧洲共同市场。
新的市场规则(New Approach)排除贸易障碍,让货物自由流通是欧洲单一市场的基础,为此,欧洲议会通过了一系列的指令以规范各种和安全健康相关的产品。
藉由欧盟一体适用的法规以取代原来各国的相关产品法规。
压力设备指令(Pressure Equipment Directive, PED, 97/23/EC)则是其中的一项指令。
凡是设计压力超过0.5bar的设备,无论其压力、容积为何,均须符合PED的规定。
诸如灭火器、压力表、阀件、安全阀、空气柜、塔槽、管路、管件、蒸汽设备等装载或输送流体的设备都必须符合PED规定。
PED于1997年5月29日通过,自1999年11月29日起生效,到2002年5月28日之前有30个月的适应宽限期,即产品可以选择适用PED 或各国原有的规定(但适用各国原有规定者只能在该国境内流通),从2002年5月29日起则各国原有的规定一律废止,PED成为欧洲压力设备的强制法规。
因此,压力设备厂商应及早因应,以免届时被拒于欧洲市场大门之外。
PED适用于欧洲经济领域(European Economic Area, EEA)各国,即欧盟15国(奥地利、比利时、丹麦、德国、希腊、西班牙、法国、爱尔兰、意大利、卢森堡、荷兰、葡萄牙、芬兰、瑞典、英国),再加上欧洲自由贸易协议的会员国(冰岛、列支敦士登、挪威)。
根据PED规范,高于特定压力/容积门槛的压力设备和组件必须要:具备安全性符合设计、制造、和测试的基本安全要求满足适当的符合性评定程序贴附CE标志及相关规定的标示低于特定压力/容积门槛的压力设备和组件必须要:具备安全性依据完善的工程实务而设计、制造贴附相关规定的标示(可以不必贴附CE标志)产品归类与符合性评定模式的选择厂商必须针对产品加以分析归类才能因应PED对不同压力设备的不同规定。
DIRECTIVE 2014/68/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL 2014/ 68 /EU 指令2014 年5 月15 日发布on the harmonisation of the laws of the Member States relating to the making available on themarket of pressure equipment依据各成员国有关法律统一制作,适用于压力设备市场欧洲议会和欧盟理事会,根据欧盟运作条约,特别是第114 条款,考虑到来自欧洲委员会的建议,将立法法案草案传给国家议会后,根据欧洲经济和社会委员会的意见,按照普通立法程序,Whereas: 鉴于:(1)欧洲议会和理事会的97/23/EC 指令已大幅修订。
既然进一步的修订需要作出,该指令需要重新制定,以清晰说明。
(2)欧洲议会和理事会条例(EC) No 765/2008 制定了有关合格评定机构认可的规则,为产品的市场监管及来自第三国家的产品控制提供了一个框架,并规定了CE 标识的总则。
(3)根据欧洲议会和理事会第768/2008/EC 决议,规定了了共同的原则和旨在适用于部门立法的参考条款,为立法提供统一的修订或重新制定基础。
因此97/23/EC 指令亦应符合这一决议。
(4)本指令包含了新投入欧盟市场的压力设备和组件,也就是说,他们或是一个新的压力设备或由欧盟制造商所组装的组件,或是从第三国进口的压力设备和组件,无论是新设备还是二手的。
(5)本指令适用于包括远程销售的所有形式供应。
(6)本指令应适用于最大允许压力(PS)大于0.5 Bar 的压力设备。
最大允许压力不超过0.5 Bar 的压力设备不存在重大压力风险。
因此,此类产品在欧盟内自由流通不应该有任何阻碍。
(7)本指令也适用于由几件压力设备组装成的,构成一个功能整体的组合件。
PED认证是压力设备指令PED(Pressure Equipment Directive)的简称。
从2002年5月28日起销往欧盟的压力设备类产品(诸如灭火器、压力表、阀件、安全阀、空气柜、塔槽、管路、管件、蒸汽设备等装载或输送流体的设备)必须符合压力设备指令PED(Pressure Equipment Directive, PED, 97/23/EC)。
凡是设计压力超过0.5bar的设备,无论其压力、容积为何,均须符合CE-PED 的规定。
由于压力设备之中储存着蕴含巨大能量的气体,所以具有危险性。
而当其中的流体本身就是危险性流体(可燃性、有毒性)时,更是危险。
主要的先进发达国家在过去数十年间落实国内法规,到今日已经达到相当的安全水平。
鉴于欧共体的市场是一个没有国家边境的市场,也为使在此范围内的所有商品、人员、服务及资本的自由往来得到充分的保障;鉴于欧共体各国在法律、法规及行政条例的范围及程度上的差别;鉴于欧共体各国在认证和检验压力设备时程序上的差别等等因素有可能成为国家间的贸易壁垒;所以欧盟理事会于1997年5月29日通过了“有关压力的法律趋于一致的指令(97/23/EC)”,即PED指令。

2定义2.1“压力设备”是指容器、管道、安全附件和压力附件。
适用时,压力设备还可包括装在承压部件上的零件,如法兰、喷嘴、连接件、支撑、吊耳等。
2.1.1 “容器”是指设计制造用来盛装承压液体的壳体,包括将其与其他设备相连的连接点上的直接附件。
容器可以有一个以上的腔室。
2.1.2 “管道”是指供输送液体用、连接在一起构成一个压力系统整体的管道零件。
管道包括管子或管系、管件、配件、伸缩接头、软管、或其他适当的承压零件。
由冷却或加热空气用的管子构成的热交换器应视为管道。
2.1.3“安全附件”是指设计用于保护压力设备不超过允许极限的器件。
这种器件包括:——直接限压器件,例如,安全阀、防爆膜安全器件、弯曲杆、可控安全释压系统(CSPRS);——限制器件,用于启动校正装置或保证关闭或关闭和切断的器件,如,压力开关或温度开关或液位开关及“与安全有关的测量控制和调节”(SRMCR)器件。

为便于参考,额定尺寸为一整数,与制造尺寸只是大体有关。
其表示方法为:D N后面加上数字。
2.7“流体”是指单相的气体、液体和蒸气及其混合物。
流体中可带有固体悬浮物。
2.8“永久性接头”是指除非用破坏性方法才可断开的接头。
2.9“欧洲材料批准书”是指规定旨在反复用于制造任何协调标准均未涉及的压力设备的材料特性的技术文件。
3不适用本指令范围的设备3.1由管道或管道系统组成的管线,用于将流体或物质从位于某个设施(岸上或近海)范围内最后一个隔开的装置开始(包括该装置),向该设施输送到或从其输出。
本款不适用在减压站或加压站可见到的那类标准压力设备。
