《伦敦保险协会货物保险条款》(1982年1月1日修订)(一)伦敦保险协会货物条款(A)(仅供新的海上保险单格式使用)承保范围风险条款1.本保险承保除下列4、5、6、7各条规定除外责任以外的一切风险所造成保险标的的损失。

但随着我国对外经济贸易的发展,目前,在我国企业以CIF价格条件对外出口时,有些外商也常会要求采用国际保险市场上通用的英国伦敦保险协会所制定的“协会货物条款”(Institute Cargo Clauses,简称ICC)进行投保.为了达成交易,我国出口企业一般都予以接受。
因此我们有必要对CIC与ICC险别的责任范围进行比较,这样既有助于我们掌握各种险别的精神实质,也有助于我们在工作中做好投保的选择.一、伦敦保险协会货物保险条款概述伦敦保险协会货物保险条款是根据1906年英国《海上保险法》和1779年英国国会确认的“劳埃德船、货保险单价格”所制订,经多次修改后于1963年1月1日定型为“协会货物条款”(ICC).到1982年1月1日,为了避免命名与内容不符、易产生误解的弊端而改成现行的ICC。
该条款共包括6种险别:(1)协会货物条款(A)〔简称ICC(A)〕;(2)协会货物条款(B)〔简称ICC(B)〕;(3)协会货物条款(C)〔简称ICC(C)〕;(4)协会战争险条款(货物)(IWCC);(5)协会罢工险条款(货物)(ISCC);(6)恶意损害险(Malicious Damage Clause)。

(FOR USE ONLY WITH THE NEW MARINE POLICY FORM)INSTITUTE CARGO CLAUSES(C)RISKS COVERED(Risks Clause)1 This insurance covers, except as provided in Clauses 4,5,6 and 7 below,1.1 loss of or damage to the subject-matter insured reasonable attributable to1.1.1 fire or explosion1.1.2 vessel or craft being stranded grounded sunk or capsized1.1.3 overturning or derailment of land conveyance1.1.4 collision or contact of vessel craft or conveyance with any external object other than water1.1.5 discharge of cargo at a port of distress,1.2 loss of or damage to the subject-matter insured caused by1.2.1 general average sacrifice1.2.2 jettison.(General Average Clause)2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4,5,6 and 7 or elsewhere in this insurance.("Both to Blame Collision" Clause)3 This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment "Both to Blame Collision" Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said clause the Assured agree to notify the underwriters who shall have the right, at their own cost and expense, to defend the Assured against suchclaim.EXCLUSIONS(General Exclusions Clause)4 In no case shall this insurance cover4.1 loss damage or expense attributable to wilful misconduct of the Assured4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured4.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured (for the purpose of this clause 4.3 "packing"shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel4.7 deliberate damage to or deliberate destruction of the subject-matter insured or any part thereof by the wrongful act of any person or persons4.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.(Unseaworthiness and Unfitness Exclusion Clause)55.1 In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft.unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject-matter insured where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness. (War Exclusion Clause)6 In no case shall this insurance cover loss damage or expense caused by6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power6.2 capture seizure arrest restraint or detainment, and the consquences thereof or any attempt thereat6.3 derelict mines torpedoes bombs or other derelict weapons of war.(Strikes Exclusion Clause)7 In no case shall this insurance cover loss damage or expense7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions7.3 caused by any terrorist or any person acting from a political motive.DURATION(Transit Clause)88.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either8.1.1 on delivery to the Consignees' or other final warehouse or place of storage at the destination named herein8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either8.1.2.1 for storage other than in the ordinary course of tranist or8.1.2.2 for allocation or distribution.or8.1.3 on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge. whichever shall first occur.8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destinaiton.8.3 This insurance shall remain in force(subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.(termination of Contract of Carriage clause)9 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,or9.2 if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.(Change of Voyage Clause)10 Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being to the Underwriters.CLAIMS(Insurable Interest clause)1111.1 In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.11.2 Subject to 11.1 above the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.(Forwarding Charges Clause)12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 4,5,6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.(Constructive Total Loss Clause)13 No claim for Constructive Total Loss shall be recoverable hereunder thesubject-matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to be destination to which it is insured would exceed its value on arrival.(Increased Value Clause)1414.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering theloss and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.14.2 Where this insurance is on Increased Value the following clause shall apply:The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.BENEFIT OF INSURANCE(Not to Inure Clause)15 This insurance shall not inure to the benefit of the carrier or otherbailee.MINIMISING LOSSES(Duty of Assured Clause)16 It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder16.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss,and16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.(Waiver Clause)17 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party AVOIDANCE OF DELAY(Reasonable Despatch Clause)18 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their W AND PRACTICE (English law and practice Clause)19 This insurance is subject to English law and practice.NOTE:-- It is necessary for the Assured when they become aware of an event which is "held covered "under this insurance to give prompt notice to the Underwriters and the right to such cover is dependent upon compliance with this obligation .。

一、ICC和CIC的主要内容(一)ICC的主要内容伦敦保险协会货物保险条款(Institute Cargo Clause,简称I.C.C.),该条款共包括6种险别:1.协会货物条款(A)【简称ICC(A)】;2.协会货物条款(B)【简称ICC(B)】;3.协会货物条款(C)【简称ICC (C)】;4.协会战争险条款(货物)(IWCC);5.协会罢工险条款(货物)(ISCC);6.恶意损害险(Malicious Damage Clause)。
(二)CIC的主要内容中国人民保险公司根据中国保险工作的实际情况,参照国际保险市场的习惯做法(主要是参照ICC,即“伦敦保险协协会保险条款”),经多次修改,于1981年1月1日制定了“中国保险条款”(China Insurance Clauses,简称CIC)。
CIC条款中有基本险和附加险之分。
基本险有平安险、水渍险和一切险三种。
附加险别是基本险别责任的扩大和补充,附加险别有一般附加险和特殊附加险。
一般附加险有11种,它包括:偷窃、提货不着险,淡水雨淋险,短量险,渗漏险,混杂、沾污险,碰损、破碎险,串味险,受潮受热险,钩损险,包装破裂险,锈损险;特殊附加险包括:交货不到险,进口关税险,舱面险,出口货物到港九或澳门存仓火险责任扩展条款,罢工险,海运战争险等。
二、ICC与CIC的比较(一)两者在风险大小上的比较1.ICC(A)承保“除外责任以外的一切风险所造成的保险标的损失”,而其中除外责任包括一般除外责任、不适航和不适货除外责任、战争险除外责任和罢工除外责任四项。
英国伦敦协会货物险条款(C)(1982年修订)(仅供新的海上保险单格式使用)承保范围风险条款1除下列4、5、6、7各条规定除外责任以外,本保险负责:1.1保险标的损失可合理归因于:1.1.1火灾或爆炸;1.1.2船舶或驳船遭受搁浅、触礁、沉没或倾覆;1.1.3陆上运输工具的倾覆或出轨;1.1.4船舶、驳船或运输工具同除水以外的任何外界物体碰撞;1.1.5在避难港卸货。
1.2由于下列原因引起保险标的之损失:1.2.1共同海损的牺牲;1.2.2抛货。
共同海损条款2本保险承保共同海损和救助费用,其理算或确定应根据运输契约和/或有关法律和惯例办理。
该项共同海损和救助费用的产生,应为避免任何原因所造成的或与之有关的损失所引起的,但下列4、5、6、7各条或本保险其他条款规定的不保责任除外。

《英国伦敦保险协会货物保险条款》是对英国伦敦地区货物保险
条款精心设计的。
该条款是由英国伦敦保险协会(Lloyds of London)管理和维护的。
它的内容规定了货物保险的确认,投保义务,索偿范围,保险金额,保险时间,投保人的权利和义务,保险人的权利和义
务以及索赔的程序。
1、确认和投保:货物的供应商和接收人乙必须双方确认,并签署
保险条款,在本合同项下投保。
2、保险时间和投保范围:本合同项下的货物保险将从货物装运时起,在日夜中享受有效保险。
投保货物的索赔范围包括:货物的任何
直接损失和损坏,运输和中转中发生的任何损失和损坏,以及相关税
收和使用费用等。
3、保险金额:投保货物的保险金额最高不能超过货物在运输途中
的实物价值,由投保人和保险人双方确认。
4、投保人的权利和义务:
(1)投保人必须按时缴付并人规定的费用;
(2)投保人需对保险事故给予及时通知,提供货物丢失及损坏的证明;
(3)投保人有义务在索赔程序中全力配合保险人。
5、保险人的权利和义务:
(1)保险人必须根据条款的规定,按时为投保人支付索赔款;
(2)保险人有义务在索赔程序中对投保人予以全力支持;
(3)保险人有权要求投保人提供货物损失及损坏的证明,以便进行核实和计算索赔金额。
6、索赔:如果发生货物保险事故,投保人或其代表需要及时与保险人联系,指定某一保险公司,根据《英国伦敦保险协会货物保险条款》的规定,制定并签署索赔书,遵守索赔的相关要求,以便尽快实现索赔。
