DATO' TAN LIAN HOETimbalan Menteri Perdagangan Dalam Negeri Koperasi Dan KepenggunaanPejabat Menteri,Aras 12 (Menara),No. 13, Persiaran Perdana, Presint 2,62623 Putrajaya.YB Dato’ Tan,RE: COURT ORDER TO REPOSSESS VEHICLES - NOT ECONOMICALLY VIABLE AND INCREASING BACKLOG OF INCOMPLETE COURT CASESWe refer to the above-mentioned matters in which the first reading to be tabled in the coming Parliament meeting, we reckoned the unworkable and wasteful manner of the new approach.We represent the motorcycle dealers throughout Malaysia and are proud to say that this industry generates a revenue of RM3.0375 billion for the year of 2009 (assuming the total sale of 450,000 new motorcycles at an average price of RM5,000 per unit and 315,000 second hand motorcycles at an average price of RM2,500 per unit in 2009) .Private Licenced Banks are not providing any financial assistance to the consumers to purchase motorcycles due to small loan of less than RM5,000.00. Our members have instead offered to provide such facilities to the consumers to enable them to purchase motorcycles by way of instalments. In the absence of our members’ financial assistance, the handsome revenue will drop by 80% sharply because probably only 20% of the total consumers can afford to purchase motorcycles by cash or other means, bearing in mind that most of the purchasers are working class people.Hire Purchase Act 1967 has provided avenues for the owner as well as the hirer to seek remedies and is currently the law governing hire purchase of vehicles. Our members have relied on the Act to repossess the motorcycles in the event of default by the hirer without resorting to Court.Imaging 20% of our member’s customers default payment each year and the tenure for the hire purchase is 5 years, the Court is bogged down by additional 153,000 new cases each year in the event that the Government’s implements new law requiring Court’s Order to repossess vehicles. This figures will be doubled or probably tripled if we include private licensed bank’s legal action to recover non performing loan on cars, vans, lorries, tractors and other vehicles.Eventually our members will start increasing the selling price of each motorcycles so as to include contingent costs in seeking legal advice and obtaining Court’s Order.The implementation of new law may protect the rights of some consumers but it will adversely affect the majority of the consumers ultimately.We wish to appeal to the Government that:1) To hear the view of all relevant parties before implementation2) To withdraw the proposed amendment.Yours faithfully,Malaysia Motorcycle & Scooter Dealers Association______________________________Chairman: Wee Hong DSM,KMN,AMNAppendixCurrent Practice-Under Hire-Purchase Act 1967(Act212)New Court Order Rules Repossession took place when ;After two months successive defaults of payments, a notice served on the Hirer (Fourth Schedule) and upon expiry of the notice of twenty-one days.Time frame ;two months three weeks arrearsCost: Minor paper work Upon expiry of Fourth Schedule, an estimated duration of two months needed to obtain the Court Order.Time frame ;Four months three weeks arrearsCost : Rm1,000.00 (includes lawyer fees, court filing, orders fees, and others admin charges)IMPACT:1.Unworkable due to tremendous work load for court to issue orders for some hundredsof thousands Repossession Court Orders to be send out every day and progress of approximate two months to obtain the said order is too tedious to comply with.2.Costing of about RM1,000.00 per order is wasteful and unpractical.3.Court order delayed the repossession process, causing financial lost, hence,cumulating bad debts damaging the growth of the hire purchase industry.
