第六章巴西第一节巴西反倾销调查的法律框架一、主要反倾销法律法规巴西主要反倾销法律法规有巴西《反倾销条例》（1995年8月23日的第1602号政令，本章下称“《反倾销条例》”）和2001年11月28日的第59号通告。
二、反倾销主管机构及职能巴西负责反倾销的主管机构是巴西发展、工业和外贸部外贸秘书处（SECEX）下属的贸易保护司（DECOM）。
根据巴西现行法律，巴发展、工业和外贸部外贸秘书处（由贸易保护司具体负责）负责确定反倾销案件的倾销幅度、损害和因果关系的技术报告，巴西财政部长与发展、工业和外贸部长共同决定所需采取的措施。
三、有关非市场经济地位的规定巴西政府第1602号政令和第59号通告对市场经济地位问题作了规定。
第1602号政令第7条规定，对于非市场经济国家，可以在市场经济第三国相似产品售价的基础上确定正常价值或推定正常价值，或以该市场经济第三国向除巴西在内的其他国家的出口价格为正常价值。
当这些方法均不可行时，可以基于任何合理价格来确定正常价值，包括经必要调整的、包含合理利润的巴西国内市场相似产品实际支付或应支付价格。
一个恰当的市场经济第三国即替代国的选择应考虑进行选择时的任何已提交的可靠信息，应考虑调查的时间框架，如果可行，将以一个同时被调查的市场经济第三国为替代国。
根据第59号通告的规定，巴西在评估市场经济条件是否存在时，所审查的标准包括：①政府对企业或生产资料的控制程度；②国家对资源分配、价格和企业生产决策的控制水平；③有关产权、投资、税收和破产方面的立法；④雇主和雇员之间在谈判中确定工资的自由程度；⑤从中央控制经济体系承袭的，在有关资产摊销、其他资产减除、直接的资产交换和以债务补偿形式进行支付等方面依然存在的扭曲水平；⑥国家对货币兑换的干预水平。
第二节巴西反倾销调查基本程序一、反倾销原审调查（一）申请反倾销申请提交后20天内，调查机构将通知预审结果，即申请合格或需要补充材料。
如果是后者，申请人须提交补充材料。

四、两国领导人共同出席了中巴工商界峰会闭幕式，一致认为双边贸易和投资的积极发展对深化两国经济伙伴关系具有重要意义，充分肯定中巴企业家委员会作为两国政府和企业对话的主要渠道发挥了突出作用。
五、两国领导人积极评价近年来双边经贸合作的发展，重申将为工业（航空、食品加工、机械设备，汽车和高科技产品）、能源（油气、电力、可再生能源）、基础设施（铁路、港口、水运）、矿业、农牧业、服务业等领域合作提供更大便利，以继续推动双边贸易和投资的稳定增长和多元化发展。
双方同意在中巴高层协调与合作委员会（以下简称中巴高委会）经贸分委会下增设服务贸易促进工作组，并将继续通过投资工作组推进两国产业投资合作。
两国领导人对巴西规划、预算和管理部与中国国家发展和改革委员会签署关于开展产能投资与合作的框架协议表示祝贺。
该框架协议将进一步促进两国在基础设施、物流、能源、矿业、制造业、农业贸易等领域的投资和合作。
六、两国领导人签署了《中华人民共和国政府与巴西联邦共和国政府2015年至2021年共同行动计划》。

一、双方一致认为，自1979年2月8日中葡建交，特别是自2005年建立全面战略伙伴关系以来，两国政治互信不断增强，经贸、投资、能源、金融、文化、教育、科技、司法、交通和安全等各领域合作成果丰硕。
二、2019年中葡将迎来建交40周年。
双方认为，在国际形势发生复杂深刻变化的大背景下，进一步加强中葡全面战略伙伴关系，赋予其新的内涵，符合两国和两国人民的根本利益，有利于维护世界和平稳定和发展繁荣。
鉴此，双方一致决定本着相互尊重、平等相待、互利共赢原则，从战略高度和长远角度出发，共同努力，加强合作，进一步提升两国关系发展水平，推动中葡全面战略伙伴关系迈上新台阶。
三、双方一致认为，高层交往对促进双边关系发展具有决定性作用。
两国愿继续加强各级别交流与合作。
两国外交部同意就双边关系及共同关心的国际和地区问题深化政治磋商。
四、双方重申尊重对方主权和领土完整，在涉及彼此核心利益和重大关切问题上相互理解、相互支持。
葡萄牙重申奉行一个中国原则，在台湾问题上支持中方立场。
你必须要了解的巴西与中国的双边税收协议中国与巴西于1991年8月5日签署了《中华人民共和国政府和巴西联邦共和国政府关于对所得避免双重征税和防止偷漏税的协定》，保护两国居民与非居民的所得不被重复征税。
该协议主要针对中国的个人所得税、中外合资经营企业所得税、外国企业所得税和地方所得税，针对巴西的联邦所得税。
所涉及的领域主要涵盖以下几个方面：1.不动产取得缔约国一方居民从位于缔约国另一方的不动产取得的所得（包括农业或林业所得），可以在该缔约国另一方征税。
2.营业利润缔约国一方企业的利润应仅在该缔约国征税，但该企业通过设在缔约国另一方的常设机构在该缔约国另一方进行营业的除外。
如果该企业通过设在该缔约国另一方的常设机构在该缔约国另一方进行营业，其利润可以在该缔约国另一方征税，但应仅以属于该常设机构的利润为限。
3.海运和空运以船舶或飞机经营国际运输业务所取得的利润，应仅在企业总机构（即实际管理机构）所在缔约国征税。
4.联属企业缔约国一方企业直接或者间接参与缔约国另一方企业的管理、控制或资本，或者同一人直接或者间接参与缔约国一方企业和缔约国另一方企业的管理、控制或资本。
在上述任何一种情况下，两个企业之间的商业或财务关系不同于独立企业之间的关系，因此，本应由其中一个企业取得，但由于这些情况而没有取得的利润，可以计入该企业的利润，并据以征税。
5.利息发生于缔约国一方而支付给缔约国另一方居民的利息，可以在该缔约国另一方征税。
然而，这些利息也可以在该利息发生的缔约国，按照该缔约国的法律征税。
但是，如果收款人是利息受益所有人，则所征税款不应超过利息总额的15%。
发生于缔约国一方而为缔约国另一方政府、其行政区、地方当局及其中央银行或者完全为其政府所有的金融机构取得的利息，包括其发行公债、债券或信用债券取得的利息，应在该缔约国一方免税。
6.特许权使用费发生于缔约国一方而支付给缔约国另一方居民的特许权使用费，可以在该缔约国另一方征税。

巴西各州及首府名称汉葡对照巴西联邦共和国（República Federativa do Brasil，The Federative Republic of Brazil）位于南美洲东南部，面积651.49万km²，为世界第五大国。
人口186957906（2008年6月2日）。
古代巴西为印地安人居住地。
1500年4月22日，葡萄牙航海家佩德罗·卡布拉尔抵达巴西。
他将这片土地命名为“圣十字架”，并宣布归葡萄牙所有。
由于葡萄牙殖民者的掠夺是从砍伐巴西红木开始的，“红木”（Brasil）一词逐渐代替了“圣十字架”，成为巴西国名。
