韩非提出“以法为教”是对商鞅“燔诗书而明法令”的发展。
商鞅认为:“法令者,民之命也,为治之本也。
”韩非后来解释说:“以表示目,以鼓语耳,以法教心。
”法是一种依据或准则,有了法,就使人行为有规矩可循。
百姓知法、守法,社会就安定;官吏知法、执法,就不会残害百姓。
因此,不论吏民,都要教其知法、畏法、守法,这样国家就没有不强盛的。
法家主张将法令文书公之于众,并使家喻户晓,由此实现法治教育。
在秦国“以法为教”颇为成功。
当商鞅失势,仓皇出走时,竟然找不到一个躲身之处。
因为商鞅曾规定:留人住宿而所留者无身份证,要罪及舍主人。
所以,秦国的强大与普遍的法治教育有很大关系。
如果说“以法为教”主要表达了法家推行法治教育的内容,而“以吏为师”则主要表达了法治教育的实现手段。
尽管“以吏为师”是古已有之,但这仅是形式上近似。
实质上,法家提出的“以吏为师”其着眼点不在“师”而在“吏”,或者说是在“法”而不在“教”,即为了实行法治,选择那些知法的官吏来担任法令的解释者和宣传者,仅此而已。
因此,法家所谓“师”并非教师意义上的“师”。
韩非发展了商鞅设置吏师的主张和实践,明确把这种制度表述为“以吏为师”,以保证“以法为教”。
但韩非的“以吏为师”中还包含着一层意思:理想的国家与社会是不需要许多人来从事文化、知识和教育工作的,这样的人一多,就会破坏社会秩序。
妥善的做法就是“以吏为师”。
这样,韩非就更为强调了法的教育,而否定了知识教育及其实施者,走向了极端。

近代以来,西方文化伴随着工业革命成为一种强势文化,这种强势文化也影响到东方国家。
在中国近代,不少人认为中国走向现代化只能批判自己的文化,走西方之路。
这种西方文化优越论掩盖了一个基本历史事实,即东方文化与西方文化曾长期互相影响,东方文化也曾是西方文化发展的重要动力;只是在19世纪西方国家取得了世界发展的主导权后,它们将西方文化标榜为人类最优秀的文化,不断向外传播,西方中心主义才盛行起来。
