“…一个本可以有所作为的国家,却招致这样的命运,这是自作孽不可活。
这是历史上的一大悲剧,也是一大教训。
”谈话对象:Sir William(以下简称卫) Dr. Mei(即梅汝璈先生,简称梅) No.1审判会议法官坐次安排问题梅汝璈先生对老卫的一段有理有趣的话卫:We affirm that as the members of the International Military Tribunal of the Far East, we won’t do it against the military justice according to law, without fear, favor, or prejudice, according to our consciousness and the best of our understanding; and that we will not discord or discover the vote of any member of the tribunal upon the finding or opinion of particular sentence, but we’ll preserve the inviolate secrecy of every member. So help us our sky(?).Find a seat. Before we start, there is a few things to clarify.First of all, we are not to be too formal among us ourselves. Please just call me William. We should treat each other equal and considering as member of our family.I will hope we will be as pleasant as possible to be together. Now, as the trial of the conductor of the basis of common law system, the seating order of the judges will be as follows:The United States, Great Britain, China, The Soviet Union, Canada, France, Australia, The Netherlands, India, New Zealand, and Philippines. 梅:I can’t agree the arrangement.卫:Dr. Mei, what do you mean?梅:The seating of the judges in this trial should follow the order of the signature of Japanese Insurance Surrender.(?)China is on the second on the list. Therefore, the judge from China should be seated right after the United States.卫:Dr. Mei, this is the courtroom, isn’t the real rite of surrender.梅:Then, perhaps, Sir William, why should you reinforce this arrangement?卫:Dr. Mei, this is common practice.梅:Common practice? Whose practice? Is the vote of order of signature of the Japanese Insurance Surrender(?) common practice and that common practice?卫:Dr. Mei, we are coming here to here the war criminals, why make a fuss over such a trifle matter?梅:This is not a trifle matter. Besides, our consciousness(?) is what is right and what is wrong. Nothing trifle about it.卫:Dr. mei, please suggest a fair method.梅:if we are not going to follow the order on the signature of the surrender documents, maybe we have another fair method. We put our judges on the scale. And the sitting order will be determined by weight.(laughter bursting out)卫:(rather embarrassed) The message you suggested it may mean a fair one, but it would be appropriate to apply it to boxing ring.梅:If sitting arrangement is not going to be determined by weight, the only fair and just criteria is the order of the signatures on the Japanese Insurance Surrender. I’m not wishing at all the International Military Tribunal will becoming a boxing ring.No.2: 审判彩排关于法官坐次安排问题梅汝璈先生对老卫义正词严的话卫:Good afternoon! Please be seated. Since International MilitaryTribunal will begin its ceremony to open its cases tomorrow, I will now announce the sitting order of the judges for today’s final judges rehearsal. He sitting order of the judges will be as follows:The United States, Great Britain, China, The Soviet Union, Canada, France, Australia, The Netherlands, India, New Zealand, and Philippines.梅:(Rising to his feet indignantly, leaving the meeting to protest)卫:(Hurrying to follow Dr. Mei to the resting room, and awkwardly) Dr. Mei, allow me to explain. Please calm down and listen.梅:(Staring at Sir W, keeping up his prestige) I’m listening.卫:the main reason I place the American judges and British judges at my left and right was because they have a better understanding of the common laws. And that will help the trial to go more smoothly. This decision is absolutely not to bring any prejudice against China.梅:Forgive me for being frank. We all know it, this is the international tribunal, not British or American. And I don’t see any need to sit the British judges in the center.卫:Dr. Mei, please reckon this problem from another angle. In this arrangement, you’ll sit between the American and French judges, but not the judges from Russian generals…I would imagine that it will please you.梅:(Angrily) This is insulting! As a Chinese judge, it’s so wrong myduty to imagine to come to Tokyo “to please”! and I didn’t come to Tokyo to come in for pleasure. My homeland, China, has been invaded and oppressed by Japanese for over fifty years. To the Chinese people, to try the Japanese war criminals is a heavy responsibility, and the greatest of all responsibility. We’re not here for pleasure.卫:Dr. Mei, I’d like as long to remind you as well that this arrangement was directed by the Supreme Commander ***himself. It would be extremely unfortunate, if your decision is to refuse this arrangement, with result in the affection of the United States and Chinese relationship. Your government might not agree your decision.梅:(With even more anger and said quickly) I refuse this arrangement is not without reasons. In this war against Japanese aggression, Chinese suffered the most, for the longest, and the hardest. The United Kingdom, on the other hand, has only been retreating and surrendering time and time again. It is unbelievable that Chinese place in this trial should be arranged under the UK!I don’t believe, the government of China will agree this arrangement. And I doubt if it is really came from the Supreme Commander himself.(being about to leave)卫:(Hurriedly stop Dr. Mei) Hold on! Let me discuss this with the other judges and let’s meet in not more than ten minutes.卫:(being lost and frustrated) I’m sorry to disappoint you, Dr. Mei. What we all want today is just a rehearsal and there is nothing more. Why don’t we just take a few pictures on the rehearsal now, and then, tonight, we’ll open the fourth discussion on the real…梅:Sir William. I’ll disappoint you as well. I definitely refuse to present at this arrangement. The whole world of photographers and reporters are now in the trial court. They are going to take photos, and they’ll report. I definitely refuse this arrangement. When these photos and reports reach China, do you know what’s going to happen? The entire Chinese people will reproach me for my coward and incompetence. If I did agree this arrangement, I’d have been insulting my country, I’d have been insulting all my countrymen, suffering and sacrifice, resisting the Japanese aggression. EVERYTHING!Sir William, can you understand? Therefore, with this reason, I will not take part in this rehearsal. As for myself, I will report to the leaders of my government to cease this appointment. If they don’t, I will resign immediately. And I’ll ask them to replace it.卫:(A little frightened) please don’t leave. How about this? I’ll gather all other judges discuss this again. I absolutely don’t want you to leave. I’ll be back at most ten minutes.梅:I’ll wait another ten minutes.卫:(Coming back, a little embarrassed and a little reluctance) You win. Your country should be proud of a fighter like you.梅:(Smile on face, saying calmly) I’m not a fighter. I am a judge—a Chinese judge.卫:(Admiringly) Old Mei, could you do me a little favor?梅:Of course.卫:Please call me William梅:William.No. 3对战犯是否执行死刑判决表决前梅汝璈先生的一段精彩绝伦的演说。
