COMMISSION DECISIONof 21 October 2005amending for the purposes of adapting to technical progress the Annex to Directive 2002/95/EC of the European Parliament and of the Council on the restriction of the use of certain hazardous substances in electrical and electronic equipment(notified under document number C(2005) 4054)(Text with EEA relevance)(2005/747/EC)欧盟委员会于2005年10月21日为了适应技术发展,针对指令2002/95/EC附录关于欧盟议会和欧盟理事会在电气电子设备中限制使用某些有害物质进行修改的决定。
THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Community, Having regard to Directive 2002/95/EC of the European Parliament and of the Council of 27 January 2003 on the restriction of the use of certain hazardous substances in electrical and electronic equipment (1), and in particular Article 5(1)(b) thereof, Whereas:欧洲共同体委员会,注意到成立欧洲共同体的条约,注意到欧洲议会和欧盟理事会2003年1月27日第2002/95/EC 号关于在电气电子设备(1)中限制使用某些有害物质指令,特别是其中第5(1)(b)条,鉴于:(1) In accordance with Directive 2002/95/EC the Commission is required to evaluate certain hazardous substances prohibited pursuant to Article 4(1) of that Directive.(1)遵照第2002/95/EC号指令,欧盟委员会需要对指令第4(1)条所禁令的某些有害物质进行评估。
(2) Certain materials and components containing lead and cadmium should be exempt (or continue to be exempt) from the prohibition, since the use of these hazardous substances in those specific materials and components is still unavoidable.(2)自从在一些特定材料和组件中使用这些有害物质仍然是不可避免的,某些包含铅和镉的材料和组件应从禁令中豁免(或继续被豁免)。
(3) Some exemptions from the prohibition for certain specific materials or components should be limited in their scope, in order to achieve a gradual phase-out of hazardous substances in electrical and electronic equipment, given that the use of those substances in such applications will become avoidable.(3)对于某些特定材料或组件之禁令的豁免应限制其内在范围,为了达到一个在电子电器设备中有害物质的逐渐淘汰,就可以避免这些物质在一些应用中进行使用。
(4) Pursuant to Article 5(1)(c) of Directive 2002/95/EC each exemption listed in the Annex must be subjected to a review, at least every four years or four years after an item is added to the list, with the aim of considering deletion of materials and components of electrical and electronic equipment if their elimination or substitution via design changes or materials and components which do not require any of the materials or substances referred to in Article 4(1) are technically or scientifically possible, provided that the negative environmental, health and/or consumer safety impacts caused by substitution do not outweigh the possible environmental, health and/or consumer safety benefits thereof.按照第2002/95/EC号指令第5(1)(c)条,在此指令附录中所列出的每一项免除至少每隔四年对附录进行一次检查,或者在将一项加入到附录后四年对附录进行检查,加入新项的目的是考虑取消附件中的电子电气设备材料和组件,如果它们的去除或通过设计改变而使用替代品或使用不包括第4(1)款的材料或物质的材料和组件在科技上是可行时,条件是替代品对环境、健康和/或消费者安全产生的负面影响不可能大于其对环境、健康和/或消费者安全带来的正面利益。
(5) Directive 2002/95/EC should therefore be amended accordingly.(5)因此第2002/95/EC号指令应相应作出修改。
(6) Pursuant to Article 5(2) of Directive 2002/95/EC the Commission has consulted producers of electrical and electronic equipment, recyclers, treatment operators, environmental organisations and employee and consumers associations and forwarded the comments to the Committee established by Article 18 of Council Directive 75/442/EEC of 15 July 1975 on waste (2), hereinafter ‘the Committee’.(6)遵照第2002/95/EC号指令第5(2)条,欧盟委员会将专门与电子电器设备生产者、回收者、垃圾处理者、环保组织和雇员与消费者协会咨询磋商。
