COUNCIL DIRECTIVEof27July1976on the approximation of the laws,regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances andpreparations(76/769/EEC)THE COUNCIL OF THE EUROPEAN COMMU-NITIES,Having regard to the T reaty establishing the EuropeanEconomic Community,and in particular Article100thereof,Having regard to the proposal from the Commission,Having regard to the opinion of the European Parliament(1),Having regard to the opinion of the Economic and SocialCommittee(2),Whereas any rules concerning the placing on the market ofdangerous substances and preparations must aim at pro-tecting the public,and particular persons using such sub-stances and preparations;Whereas they should contribute to the protection of theenvironment from all substances and preparations whichhave characteristics of ecotoxicity or which could pollutethe environment;Whereas they should also aim to restore,preserve and im-prove the quality of human life;Whereas dangerous substances and preparations are gov-erned by rules in the Member States;whereas these rulesdiffer as to the conditions of their marketing and use;whereas these differences constitute an obstacle to tradeand directly affect the establishment and functioning of thecommon market;Whereas this obstacle should therefore be removed;where-as this entails approximating the laws governing the matterin the Member States;Whereas provisions relating to certain dangerous sub-stances and preparations have already been laid down inCommunity Directives;whereas it is still necessary to es-tablish rules for other products,in particular for those inrespect of which international organizations have decidedon restrictions such as polychlorinated biphenyls(PCB),adecision restricting the production and use of which wasadopted by the Council of the OECD on13February1973;whereas such a measure is necessary to prevent theabsorption of PCB by the human body and the resultantdanger to human health;Whereas detailed examinations have shown that polychlori-nated terphenyls(PCT)entail risks similar to those pres-ented by PCBs;whereas the marketing and use of suchsubstances should also be restricted;Whereas it will be necessary,moreover,periodically to re-view the whole problem with a view to moving graduallytowards a complete ban on83/478the products,a single colour contrasting with thebackground colour is sufficient.2.The label mentioned in this Annex shall be affixed inaccordance with the following rules:(a)on each of the smallest units supplied;(b)if a product has asbestos-based components,it issufficient for these components only to bear thelabel.The labelling may be dispensed with ifsmallness of size or unsuitability of packagingmake it impossible for a label to be affixed tothe component.belling of packaged products containing asbestos3.1.The following particulars shall appear on clearly leg-ible and indelible labelling on the packaging of pack-aged products containing asbestos:(a)the symbol and relevant indications of danger inaccordance with this Annex;(b)safety instructions which must be selected in ac-cordance with the particulars in this Annex,inas-much as they are relevant for the particularproduct.Where additional safety information is provided onthe packaging,this shall not weaken or contradict theparticulars given in accordance with(a)and(b).belling in accordance with3.1shall be effected bymeans of:—a label firmly affixed to the packaging,or—a(tie-on)label securely attached to the package,or—direct printing of the packaging.3.3.Products containing asbestos and which are packagedonly in loose plastic wrapping or the like shall be re-garded as packaged products and shall be labelled inaccordance with3.2.If products are separated fromsuch packages and placed on the market unpackaged,each of the smallest units supplied shall be accompa-nied by labelling particulars in accordance with3.1.belling of unpackaged products containing asbestosFor unpackaged products containing asbestos,label-ling in accordance with3.1shall be effected by meansof:—a label
