五、社会福利和福利待遇第十一条甲方根据国家有关规定为非农业户口乙方缴纳上海市城镇社会保险(养老、医疗、失业、住房公积金),个人缴纳部分由甲方从乙方工资中代扣代缴;为农业户口乙方缴纳上海市小城镇社会保险小三金(失业、生育、工伤);外来员工由甲方缴纳综合保险。
甲乙双方解除、终止劳动合同时,甲方按有关规定为乙方办理社会保险相关手续。
第十二条乙方工伤待遇按国家和地方有关政策法规规定执行。
第十三条因公出差按公司规定实行差旅费报销与补贴。
六、劳动纪律第十四条合同期间,乙方应严格遵守国家的各项法律法规及甲方依法制定的各项规章制度及要求,严格遵守劳动安全卫生、操作规程及工作规范;应爱护甲方财产,遵守职业道德,积极维护公司荣誉和利益。
第十五条乙方违反劳动纪律,甲方可依据本公司的规章制度给予纪律处分,直至解除本劳动合同。
另外,由于乙方的原因对甲方造成经济损失的,原则上必须按照实际损失金额由乙方向甲方承担损害赔偿责任,数目重大者甲方有权追究其法律责任。
第十六条在本合同履行过程中,甲方根据国家有关规定可以制定新的规章制度,也可以对公司制定的规章制度进行修改,发布的各种规章制度、操作规定、通知、公告等均对乙方有约束力。
第十七条若本合同条款与国家新规定及甲方新规章制度相抵触,乙方同意服从国家新规定和甲方新规章制度。
七、劳动合同的履行和变更第十八条甲方应按照约定为乙方提供适当的工作场所、劳动条件和工作岗位,并按时向乙方支付劳动报酬。
乙方应当认真履行自己的劳动职责,并亲自完成本合同约定的工作任务。
第十九条甲、乙双方协商一致,可以变更本合同内容,并以书面的形式确定。
八、劳动合同的解除、终止和续订第二十条经甲、乙双方当事人协商一致,本合同可以解除。
双方应提前三十日(试用期为提前三日)以书面形式通知对方,方可解除本协议。
第二十一条乙方有下列情形之一的,甲方可以随时解除本合同:1、严重违反劳动纪律和规章制度的;2、严重失职,营私舞弊,给甲方造成重大损失的;3、乙方没有经过甲方同意,同时与其他用人单位建立劳动关系,对完成甲方的工作任务造成严重影响,或者经甲方提出,拒不改正的;4、因劳动合同期满致使本合同无效的;5、依法被追究刑事责任或劳动教养的;6、乙方利用职务之便收受贿赂的或泄漏公司机密造成公司损失的。
第二十二条有下列情形之一的,乙方可以随时通知甲方解除本合同。
1、在试用期内的;2、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;3、甲方未按照劳动合同约定支付劳动报酬或者提供劳动条件的。
第二十三条符合下列情形之一的,甲方提前三十日(试用期为提前三日)以书面形式通知乙方,解除本合同:1、患病或非因工负伤,在规定医疗期满后,不能从事原工作,也不能从事甲方另行安排的工作的;2、乙方不能胜任工作,经过调整工作岗位,仍不能胜任工作的;3、本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,经甲、乙双方协商,未能变更本合同内容达成协议的;4、按照相关法规及程序甲方依法裁员的。
第二十四条乙方有下列情形之一的,甲方不得按本合同第二十四条的约定与乙方解除劳动和同:1、在甲方工作期间患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;2、患病或因工负伤,在规定的医疗期间的;3、女职工在孕期、产期、哺乳期的;4、法律、行政法规规定的其他情形。
第二十五条符合下列情形之一的,本劳动合同即可终止:1、劳动合同期满;2、乙方死亡、或者被法院宣告死亡或者宣告失踪的;3、甲方依法被宣告破产的;4、甲方被吊销营业执照、责令关闭、撤销或者甲方决定提前解散的;5、法律、行政法规规定的其他情形。
九、赔偿责任、违约责任第二十六条乙方未能提前书面提出解除劳动合同的赔偿金:未按照《劳动合同法》提前三十日书面形式通知甲方解除劳动合同,需按照乙方日工资的标准来补足时间的赔偿。
第二十七条乙方造成直接损失的赔偿金:赔偿金按乙方实际造成的损失计算,赔偿金的范围包括:1、乙方损坏甲方财物而导致的直接经济损失;2、乙方疏忽导致的甲方直接经济损失;3、乙方拒绝合理的工作安排而导致甲方经济损失。
第二十八条甲方根据乙方的要求出资为乙方办理了外省市专业技术人员、管理人员的调动引进手续,在入户手续完毕后,必须在本公司服务期满年。
服务期内,乙方不得提出辞职解除合同。
若在服务期内自行离开公司或违纪被甲方解除合同的,按元人民币的赔偿额,根据乙方未服务满的年限,按比例折算(年平均赔偿金额)赔偿。
第二十九条甲乙双方任何一方违反本合同,给另一方造成经济损失的,根据违约者责任大小,需承担违约责任。
第三十条乙方不得在任何情况下将甲方的保密资料直接或者间接泄露给任何外人,如经甲方发现按甲方损失大小赔偿。
十、劳动争议的处理第三十一条甲乙双方协商解决。
第三十二条甲乙双方协商不成,可由争议的一方申请劳动仲裁。
十一、其他第三十三条本合同未尽事宜,按国家和当地政府有关法律、法规规定办理。
第三十四条从本合同签订生效之日起,原合同即日废止。
第三十五条本合同一式两份,甲乙双方各执一份,经甲乙双方签字盖章后生效。
