法律英语词汇学习的基本方法
一、法律英语词汇学习的必要性及难点
法律英语难学，基本上是当代中国法律人的一个共识。难在何处呢？可能法律英语词汇的掌握就是第一只拦路虎。当我们打开英文法律文件时，经常会发现非常难以理解，即使是常用的合同条款中也充斥着大量的难以理解的词汇。例如：
“Limits on Indemnification. No indemnification is required under Section [insert the number of the Section in which Seller agrees to indemnify Buyer] until the aggregate amount of Losses [plus Litigation Expenses] exceeds [$500,000], and then only for the amount by which the aggregate amount of Indemnifiable Losses exceeds [$500,000].”
学过法律英语的人都知道，这个句子实际上在法律英语句子中是比较短小和简单的一句，语法问题难不倒我们，难得是里面的几个关键的词汇，比如indemnification、indemnify 、Indemnifiable 、aggregate、Litigation以及exceed。如果我们知晓上面的列举的几个所谓法律英语词汇的含义分别是：补偿（名词）、补偿（动词）、补偿（形容词）、总计、诉讼、超出，那么本句就很容易理解。它的含义实际上就是指：
“补偿限额。只有损失总额（加上诉讼费用）超过（$500,000）时，才能根据第（插入卖方同意补偿卖方的条款编号）条要求补偿，此时也只对可补偿费用中超过（$500，000）的部分进行补偿。”
除了生僻的词汇以外，我们还有注意大量的我们平时熟悉但不能按照普通英语含义理解的词汇。这样的词，我们称之为“熟词生义”。这些词汇的存在也是我们必须解决的一个问题。比如，“abandon”这个词汇。大家都知道它的含义是“放弃”，但在法律英语里它的常见含义却变成了“弃权”和“委付”，即：在一般的民事法律关系中，其可以被理解为“弃权”，在商事保险法律关系中，其可以理解为“委付（保险标的物发生推定全损时，由被保险人把保险标的物的所有权转让给保险人，并向保险人请求赔偿全部保险金）”。再比如“service”，大家对这个词非常熟悉，都知道它是“服务”的意思，但在法律英语中它的含义却被特定地引申成了“送达”，经常被用在与法律诉讼程序相关的表达上，比如“accept service of the writ”即可以理解为“对令状送达的接受”。
除了以上我们遇到的两类词汇外，还有一类法律英语专用词汇。它们基本上之出现在法律英语中，在其他地方根本见不到他们的身影。比如在法律文件中我们会见到大量的像therein（在其中）、thereinafter（在下文中）、thereof（其）、thereto（附随）、herewith（与此一道）、whereas（鉴于）、thence（从那里）、aforesaid (上述的)等词汇中，由here/there/where 等表示方位的副词与in/after/in/of/with等介词连在一起构成的古旧英语。此外也会见到一些英语的外来词，比如拉丁词汇。我们知道在英国的法制史上，法律曾有一段是用拉丁文写就的。所以，不可避免的在当代英美法律文件中仍可以见到一些拉丁文身影。对此，我们将在下文专门讨论。
二、法律英语词汇学习的准备工作
（一）心理准备
“为学有难易乎？为之则难者亦易矣，不为则易者亦难亦”，这是学习的基本规律。学习法律英语词汇首先要端正自己的学习心态，我们所有人都是学而知之，没有人生而知之，更不可能有一劳永逸的学习方法。所以，要告诫自己，法律英语学习绝不是一两天就能背下来并且理解的。即使是普通英语中的词汇，根据有些人的研究，同一个词汇也必须在反复出现8次以上的时候才能将其记牢。法律英语词汇，作为专业词汇，其本身又与法律，特别是“普
通法”的制度和理念息息相关，所以我们更不可有“速成”的心态。
（二）准备一本法律英语词汇书。法律英语难学的问题还在于我们在市场上还很难见到法律英语词汇书籍。背诵词典太厚太难；蜻蜓点水式的词汇汇编又不可能解决实际问题。所以，笔者以自学习法律英语8年以来的经验，倾自己之所知编著了这本词汇使用手册，希望对大家学习法律英语有帮助。但要强调的是，如果大家能够亲自动手将日常见到的法律英语用心摘录并作注释，相信是最好的一种学习法律英语词汇的方法。在没有自己做之前姑且阅读笔者的拙著可能也是一项必要的准备工作。
（三）准备一本词典工具书。笔者向大家推荐的既不是作为全球经典《BLACK法律词典》也不是开大陆之先河的《元照英美法词典》，而是《韦氏法律词典》(Werriam Webster’s Dictionary of Law)以及LAWSPIRIT教学平台上的法律词典。究其原因很简单，因为前两本词典太过厚重，并不适宜初学者学习词汇。而《韦氏法律词典》却是一本实用的用普通英语注释法律英语词汇的著作，它有两大特点：第一，为读者提供了复杂词汇的“构词法”，便于记忆理解；第二，是注释全面且简洁。推荐LAWSPIRIT网络平台上的词典在于，它是集LAWSPIRIT多年翻译的经验并利用互联网技术的网络词典，其本身就是一个专业的数据库，因为其团队的长期坚持和广大网友的支持，使其成为当代大陆法律英语翻译的一个不可或缺的资料库。
三、法律英语词汇的背诵和理解的方法
笔者认为，法律英语的背诵和理解的方法与普通英语词汇的背诵和理解方法既有共性又有不同。其共性在于，它同样可以使用“构词法”进行背诵，而且在我们学习了5000基本词汇后使用该方法进行专业词汇扩展时尤其实用。同时，还可以使用在背诵普通英语词汇时常用的“联想记忆”的方法，对无法使用“构词法”进行分析的词汇进行学习。其不同点在于，在记忆法律英语词汇时我们还应当将词汇与具体的法律制度，即词汇背后的那些法律知识联系起来。比如，在背诵“liquidate”这个词的时候，我们首先可以用“构词法”进行记忆：liquid 液体→用液体清洗+ate→清理。但我们知道它的法言法语是“勾销，结清债务”。为什么呢？为了更深一步理解，我们就要对这个词背后的法律制度有所涉及。但问题是怎样与具体法律制度结合呢？答案是：利用与之相关的常见词组。比如，我们会见到“liquidated damages”和“liquidated debts”这两个词组。第一个词组中，liquidated由“流动的”被引申为“流通的货币”，继而在词组中被定义为“金钱的”，所以整个词组即可以被理解为“金钱赔偿”，最后再结合合同当事人经常在合同中进行事先约定的惯例，我们最终可以把这个词组理解为我们所熟悉的“约定违约金”（更进一步，我们可以借助《韦氏法律词典》将其等同于“stipulated damages”）。第二个词组比较简单，与debt（债务）联系，自然就是“清算的债务”的含义。
所以，本教程的编排方法即体现了以上两点，既注意从“构词法（兼顾其他方法）”为基础的背诵词汇的基本方法，又注意以法律短语为核心展现英美普通法的文化，从而为读者最终掌握法律英语词汇打下坚实的基础。故此，我们法律英语词汇课程的学习方法大致为：从研究每个词汇的“词根”和“词缀”入手理解法律英语词汇的基本含义，然后从研究法律英语词汇在法律短语中的作用和含义以理解这些词汇在实践中的法言法语和功能，最后再回到“词根”和“词缀”对相同词根的单词进行拓展，以使大家尽可能地在短期内事半功倍地掌握这些最核心的法律英语词汇的基本含义和用法。

常用法律英语词汇 Ab initio 从开始形容事件由开始时的状态，例如合约从开始便已经无效，称为“The contract was void ab initio”。 Accused 被告Accused通常指刑事案件的被告，民事诉讼的被告称为Defendant；而申索案件中的被索偿的一方称为Respondent（答辩人）。 Acquittal 罪名不成立刑事案件经审讯后，被告罪名不成立被释放，称为“The accused is acquitted”。Acquittal是名词。 Adjourn 休庭，押后法庭在聆讯途中暂时休庭30分钟，称为“adjourned for 30 minutes”。如要将聆讯押后再排期重审，称为“adjourned to a date to be fixed”。 Affidavit 誓章以宗教仪式发誓后签署的书面证供称为Affidavit，而以真诚发誓所签署的证供称为Affirmation，两者的格式用词有些分别，但主要作用相同。 Allegation 声称诉讼陈词中未经证实的声言，例如：The Plaintiff alleged that his loss was due to the Defendant’s breach of contract，原告声称他的损失是被告违约所引致。Allegation是名词。Assault 殴打，侵犯以武力侵犯他人的行为，称为Assault，一般性质的殴打，称为“Common Assault”；严重者称为Aggravated Assault；未经许可触摸他人身体，可以被控非礼，称为Indecent Assault。As is 现状“As is”常用于物业买卖的合约中，指物业的现状。“The prop erty is and will be sold on an “as is” basis …”即物业将会以其现状出售。 Bail 保释刑事案中的疑犯或被告，可以暂时被释放。保释可以是有条件的，也可以是无条件的。保释的条件包括缴交指定金额的保释金、提供人事担保及定时向警署报到等。 Balance of Probabilities 可能性较高者这是民事案件中举证的标准，法庭对原告和被告所提出的证据，认为那一方的可信性较高，便会判处该方胜诉。相对刑事案而言，民事案中败诉的后果一般都只是经济利益，所以法庭对举证的要求，相对也较刑事案为低。 Beyond reasonable doubt无合理疑点这是刑事案件中举证的标准，控方向法庭提出的证据，必须是在合理的情况下并无疑点，法庭才会判处被告有罪。刑事罪的后果对被告而言，较为严重，举证标准的要求也因此而较民事案严格，如果法庭认为证据有任何疑点，都会将疑点的利益“benefit of doubt”归于被告。 Binding 有约束力的“binding”通常的解释是连结一起，但法律上则多用作有约束力的，例如：This provisional agreement is a binding contract。这份临时协议是有法律约束力的。 Body Corporation
