第八条合同的解除和终止1. 甲乙双方协商一致，可以解除本合同。
2. 乙方有下列情形之一的，甲方可以解除本合同：严重违反甲方规章制度；严重失职、营私舞弊，给甲方造成重大损害；同时与其他用人单位建立劳动关系，对完成甲方工作任务造成严重影响，或者经甲方提出拒不改正；因乙方过错致使劳动合同无效；被依法追究刑事责任。
3. 有下列情形之一的，乙方可以解除本合同：甲方以暴力、威胁或者非法限制人身自由等手段强迫劳动；甲方未按照劳动合同约定支付劳动报酬或者提供劳动条件。
4. 在合同期内，因不可抗力致使本合同无法履行的，可以解除本合同。

ARTICLE 2: TRIAL PERIOD第二条：试用期2.1The trial period will start on the date of sig nature of this CONTRACT. The durati on of the trialperiod is three (3) mon ths. Duri ng the trial period the EMPLO YEE will be bound by all articles ofthis eon tract.试用期自本合同签署之日起开始，时间为三个月。
在试用期间，该员工受本合同全部条款所约束。
2.2After the specified trial period and if no no tice of term in ati on is give n the EMPLO YEEautomatically becomes employed un der the terms and con diti ons of this CONTRACT.在约定的试用期内，若该员工没有收到关于解除劳动关系的通知，在试用期满后，该员工自动转为本公司正式员工，执行本合同规定的条款。
3.1The duration of this CONTRACT is twen ty-four (27) mon ths.本合同期限为27个月。
3.2This CONTRACT maybe exte nded upo n agreeme nt of both PARTIES. An exte nsio n t this CONTRACT shallcome into force only after a writte n agreeme nt has bee n sig ned by both PARTIES.本合同经合同双方同意后可以续签。
只有在合同双方签署书面协议后，续签的合同方能生效。
ARTICLE 4: SALAR Y第四条：工资4.1The COMPANY shall define its own salary policy in accordance with regulations stipulate by the stateand municipal government. The COMPANY shall ensure that the monthly salary of the EMPLOYEE is not lessthan the minimum pay standard set by the local gover nment.本公司将依照中华人民共和国和北京市有关政策法规制定本公司的员工工资标准。
本公司保证该员工的月工资将不低于当地政府规定的最低工资。
4.2The EMPLOYEE will receive a gro^m onthly o口annual salary of 3,000.00renminbi (RMB3,000.00) and in crease thereafter the basis of the staff performa nee, the econo micdevelopme nt of the COMPA NY and accord ing to the salary policy of the COMPAN Y approved by the Boardof Directors of the COMPA NY, and etc.该员工税前工资将为r每月或口每年叁仟元人民币，今后将按照该员工的工作表现、本公司的经济效益以及由本公司制定并经董事会批准的工资标准每年递增。
4.3Such salary shall be transferred to the bank account designated by the EMPLOYEE betwee n the third andfifth day of each mon th.上述工资将于每月3号至5号期间汇入该员工所指定的银行账户。
ARTICLE 5PREMIUM & BONUS第五条：奖金及分红5.1At the full discretion of the Chairman and based upon his/her general attitude and theresult of his/her work and fulfilment of his/her objectives detailed with his/her man ager and at the beg inning of each cale ndar year the EMPLO YEE will be en titled to an annual bonus not exceedi ng one (1) month of salary and shall be paid to the EMPL OYEE for each full cale ndar year which the EMPLO YEE works for the COMPAN Y in two (2) in stalme nts the followi ng year.经本公司董事长同意，并且根据该员工的工作态度、工作成果及其上级主管规定之工作目标的完成状况，该员工将有权在每个公历年初享受年终奖金(奖金总额不超过该员工的月工资)。
员工为公司工作满一年时，奖金将于次年分两次发放给个人。
ARTICLE 6: PERSONAL INCOME TAX第六条：个人所得税6.1The EMPLO YEE shall pay in dividual in come tax in accorda nce with the releva nt laws and regulations of the People ' s Republic of China. Thamount and pay it to the compete nt tax bureau.该员工须按照中华人民共和国相关法律法规缴纳个人所得税。
本公司将为该员工代扣代徼个人所得税，并将应纳税款上交相应税务机关。
ARTICLE 7: TRAINING第七条：培训7.1The COMPAN Y will establish an EMPLO YEE trai ning system and provide necessary trai ning to theEMPLO YEE in accorda nee with the releva nt laws and regulati ons of the People epublicsoR Chi naand as the COMPA NY needs.本公司将依照中华人民共和国有关法律法规及公司需求，为该员工设计一套培训体系，向该员工提供必要的培训。
ARTICLE 8: WORKING HOURS第八条：工作时间8.1The COMPAN Y will impleme nt worki ng hour system of forty minim um(40) hours per week in accordanee with the releva nt laws and regulatio ns exclusive of lunch time.本公司依照相关法律法规实行每周40小时工作制(每周工作时间不得少于40小时)，不包括午餐时间。
