1.简述民法的调整对象。

（1）民法调整平等主体之间的财产关系。根据《民法通则》第2条的规定，我国民法调整平等主体之间的财产关系、所谓财产关系，是指人们在产品的生产、分配、交换和消费过程中所形成的具有经济内容的关系。

（2）民法调整人身关系。根据《民法通则》第2条的规定，我国民法不仅调整平等主体之间的财产关系，而且也调整他们之间的人身关系。所谓人身关系，是指没有财产内容但有人身属性的社会关系。人身关系是基于一定的人格和身份产生的，体现的是人们精神上和道德上的利益，它包括人格关系和身份关系两类。

2.简述民法的特点。

（1）民法是权利法。

民法的渊源是指民事法律规范借以表现的形式，它主要表现在各国家机关根据其权限范围制定的各种规范性文件之中，包括宪法；民事法律；国务院发布的民事法规、决议和命令；最高法院的指导性文件；国务院各部委依据法律、行政法规所制定的规范性文件；地方性法规；国家认可的民事习惯。

4.简述民事法律关系的分类。

5.简述民事法律关系的构成要素。

（1）民事法律关系主体。

（2）行为，是指当事人的有意识的活动。

7.简述准民事行为。

准民事行为是指行为人实施的有助于确定民事法律关系相关事实因素的意愿表达或事实通知行为。此类行为并非民事行为，没有包含行为人对于民事主体间利益关系安排的设想，不以直接引起民事法律关系的变动为目标，但可以准用民事行为的相关规则。属于准民事行为的主要有与请求权或法律关系有关的催告、通知等。这些催告、通知是行为人有意为之，并借助这些催告和通知间接推动民事法律关系的变动或为民事法律关系的变动创造条件。
