一、劳动合同期限

六、劳动保护、劳动条件和职业危害防护
1. 甲方应建立健全生产工艺流程,制定操作规程、工作规范和劳动安全卫生制度及其标准。甲方对可能产生职业病危害的岗位,应当向乙方履行告知义务,并做好劳动过程中职业危害的预防工作。
2. 甲方应为乙方提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品,对乙方从事接触职业病危害作业的,应定期进行职业健康检查。
3. 甲方应按照国家有关规定对乙方进行职业培训,提高乙方的职业技能。
4. 乙方在劳动过程中应严格遵守各项规章制度,服从甲方的管理,正确佩戴和使用劳动防护用品。
七、劳动合同的解除和终止
1. 经甲乙双方协商一致,可以解除本合同。
2. 乙方有下列情形之一的,甲方可以随时解除本合同:
(1)在试用期间被证明不符合录用条件的;
(2)严重违反甲方规章制度的;
(3)严重失职、营私舞弊,给甲方造成重大损害的;
(4)被依法追究刑事责任的;
(5)法律法规规定的其他情形。
3. 有下列情形之一的,本合同终止:
(1)本合同期满的;
(2)双方约定的终止条件出现的;
(3)甲方破产、解散或者被依法撤销的;
(4)乙方死亡或者被人民法院宣告死亡的;
(5)法律法规规定的其他情形。
八、经济补偿和违约责任
1. 甲方依照本合同第七条第 2 项规定解除本合同的,应向乙方支付经济补偿。
2. 乙方违反本合同约定解除本合同或违反本合同约定的保密义务或竞业限制义务,给甲方造成损失的,乙方应向甲方支付违约金。

十、争议解决
