目前我国的法律硕士专业学位类似于美国的J.D（Juris·Doctor），但两者在内涵和层次上又不同，美国的J.D主要是培养律师的，而且在层次上属于Doctor（博士）；我国的法律硕士专业学位培养的对象比较宽泛，涉及律师、法官、检察官以及法律服务、法律监督和经济管理、社会管理等方面的法律专门人才，在层次上属于Master（硕士）。

根据这种情况，为了叫法上的方便和国际交流的需要，借鉴MBA的做法，“法律硕士专业学位”的英文对应名称为Juris·Master，简称JM。

1.2 法律硕士专业学位研究生的毕业择业法律硕士专业学位研究生毕业后主要从事立法、司法、行政执法、法律服务和企业管理等实际工作。

根据《中华人民共和国法官法》、《中华人民共和国检察官法》的规定，担任高级人民法院、最高人民法院法官，担任省、自治区、直辖市人民检察院、最高人民检察院检察官，均应当具备法律专业硕士学位以上文化程度。

另外，有些法律硕士专业学位研究生毕业后，考取了法学博士研究生。

因此，对于广大非法律专业考生来说，考取法律硕士专业学位研究生，是在高起点上直接从事法律工作或进一步深造的最佳选择。

法大法硕（非法学）考研经验——初试备考经验各位师弟师妹们好，我是法大18级在读研究生，本科是工科。

先介绍一下我的分数：政治66，英语68，专业课一119，专业课二123，总分376。

写这篇文章，是想与师弟师妹们分享我的一些经验，希望能够帮到师弟师妹们。

一、书籍先介绍一下考法硕非法学需要用到的书籍。

法硕非法学是全国联考，也就是全国一套卷子，所以各位师弟师妹不必担心不同学校用到的书不同。

1、考试分析即《2019年全国硕士研究生入学统一考试法律硕士（非法学）专业学位联考考试分析》2、真题高等教育出版社出版的《2019年法律硕士联考历年真题及答案详解》3、练习册《2019年法律硕士联考考试分析基础配套练习》《2019年法律硕士联考考试大纲配套练习》人大版《2019年法律硕士联考标准化题库》人大版《2019年法律硕士联考考试分析基础配套练习》（在上述几本练习册中，前两本比较基础，后两本用来提升能力，如果要冲刺北大清华，建议标准化题库也要做一做。

）4、法律法规汇编二、专业课备考1.刑法刑法偏重理解，因为是零基础备考，可以听一下老师的课，可以听陈永生老师的，这些课程可以帮忙打下基础。

刑法总则需要看分析，在第三章犯罪构成那里有一点难但是特别重要，要结合着课程多看几遍，理解一下。

量刑和缓刑假释那里也有一些繁杂，需要多看几遍。

在学习分则时，可以先听一遍课程，结合着老师的讲义看人大出版社出的指南上的分则。

注意：只有刑法分则需要看指南，别的科目以及刑法总则都看分析，不用看指南。

在看刑法的时候，注意结合着高教版出的法律法规汇编，在这本法律法规汇编中，可以看一下司法解释。

在听课的同时，也可以做一下人大版指南配套练习，巩固所学的知识。

2.民法民法也偏重理解，因此前期也应该听一下老师讲课，我当时听的凯程田浙铭的课程，但是不同的人有不同的风格，所以大家可以看看田浙铭和以及凯程法硕的其他老师，谁的课程更适合自己，选定一个老师跟下来即可。

法大法硕（非法学）考研经验——唯有努力，方能成功先说说我的基本情况吧：毕业时候在人才市场被筛选千万遍之后，方知学历这块敲门砖的重要性，于是决定考研。

考研的时候在选专业的时候徘徊许久之后，决定考一个法大的法硕。

原因是：一是深知本科四年的逃课睡觉浪费掉自己的时间，并不热爱自己的本科专业，内心一直向往法学；二是名校情结，想要去一个最好的法学院校感受一下学习氛围。

我报考的是中国政法大学中欧法学院法律硕士（非法学），专业笔试成绩为：政治64，英语77，专业课一112，专业课二113，专业笔试成绩总分366；外语复试64，专业课笔试83，专业课面试73.6，复试成绩74.5.总成绩73.85。

写下这篇经验贴，一是为了给学弟学妹们提供一些可借鉴的经验，帮助他们实现自己的理想；二是感谢在我考研期间给予我指导帮助老师和学长学姐，希望可以把这份正能量传递下去。

一、法硕和法考能否同时准备认为绝大多数战友都不适合法硕和司考一起准备，因为知识点冲突、时间冲突。

1.知识点冲突法硕刑法的犯罪构成是四要件传统理论，而司考却是二阶层理论，一些司考老师天天抨击法硕的四要件，但是，咱们法硕就是要四要件。

司考的宪法、法理、法制史占比很少，而在法硕考试中，这三门可是专业课半壁江山。

2.时间冲突鉴于法考的改革，由一次考试改为两次考试，司考时间跨度太长，客观题时间在九月二十号左右，主观题考试结束后十月份二十号左右，如果你司考结束之后在准备考研，时间肯定来不及。

现在法硕竞争越来越激烈，如果你想考一个还不错的学校，建议你一心一意准备。

如果你想准备法考，那建议你就不要分精力到法硕上了。

哪怕你是二战或者是法本的同学，我也如此建议。

法考通过率，在法硕考生当中是非常高的，且法考客观题全国通过率50%左右，主观题通过率也在30%以上。

二、英语我的英语基础相对来说一般，所以对于我自己来说，整个备考期间，我都没有放弃对英语的复习。

我的复习规律一般是每天早晨7点左右我都会先背80个量的单词，划出其中不会的。

然而期末考试自习偶遇了二战的老同学（我休学过一年），聊了大概10分钟，可能是觉得她口中的法硕发展前景良好，也可能被她坚持考人大的决心鼓舞，7月15日期末考试结束就给实习公司打电话推了实习，于是一个法律小白从大三暑假的7月20日开始正式学习了。

英语：80分很多人认为，我是英语专业的，英语比他们占有优势，然而并不是，考研英语跟我们专四专八应试培养方向不同，之前听说有学姐考研英语没及格，所以也是早做准备，9月以前每天早上早起背单词。

买了星火最近的真题，从10月份以后才开始一周一套，11月份一周两套，7真题刷了两遍，个人认为与其买各种阅读和翻译练习，不如把真题当做练习反复的做。

针对写作，我是结合网校的作文课，一共背了10篇小作文，10篇大作文，然后总结了自己的写作模板，但是这里要提醒大家，看再多的作文模板，也要下笔写，不然你可能会惊恐的发现即使你看了很多作文，你写！不！出！来！重三遍：字要写好。

平时学累了，用刷微博的时间练一篇字吧。

政治：77分高中是理科生，一开始完全看不懂政治讲义，尤其是马原部分，但是都说政治准备太早没有意义，政治复习我是听的米鹏的网课，另外也用的米鹏的全套书。

前期多花时间在选择题客观题上面，我那时候是把网校那边发的讲义刷了3遍，在这里强烈建议，不要提前浪费太多时间做大题，11月出米鹏6套卷，12月出米鹏3套圈，把的大题背诵了，（11月出）时事政策一定要拿分，大题基本都OK 了，我政治花了太多时间，然而回报率不成正比，我一研友，就花了几天时间背了米3，政治72分。

当然这也是见仁见智。

建议：1，前期慢一点没关系，那就比别人多花一点时间，基础要打牢固，后期就是刷真题，刷出感觉了，你一看到题就知道坑在哪儿。

非全日制法硕考试科目
非全日制法硕考试科目主要包括以下内容：

政治和英语这两门公共课是全国统一的，和其他任何考研专业是一样的，政治英语满分各100分。

总之，法律硕士毕业生不会像工科毕业生找工作那样严重受自己专业限制。

二、法律硕士复习参考书目首先说明一点，法律硕士复习千万不能在书籍上贪多贪全，否则考完试之后就追悔莫及。

1.法硕指南，全称“全国法律硕士专业学位研究生入学联考考试指南第X版”2011年的是第11版。

此书内容详细，方便考生打基础，特别适合法学零基础的考生。

本书内容涵盖了法硕专业课考试的所有五门课程，初学的同学必须通过法硕指南快速掌握法律知识。

本书变化不是很大，如果有最近两年的，可以不买最新的。

同时法硕指南一般都是在每年8月份以后出新书，所以大家只能看前一年的书籍，否则从准备考研到新书出来，有小半年的时间浪费掉了。

法硕指南只有人民大学出版社出版，目前市面上有打着指南的旗号乱出书的现象，万学网校法硕考研辅导老师特别提醒同学们在买书的时1 / 2候要认准出版社，谨防上当受骗。

2.考试分析，全称“全国硕士研究生入学统一考试法律硕士专业学位联考考试分析”，每年也都有更新版本。
