英语写作（不仅仅是法律英语写作）一共可能传达六种信息：who，when，where，what，how，why.如果你试图在一个句子里把这六种信息同时都传达出来，很可能最后会写出几十个单词的恼人的长句子。所以在忍不住写长句子时，时刻在脑子里记着的一点应该是——我这句话想要表达什么信息？有必要把这么多信息都塞到一个句子里吗？能不能断个句？脑子里把这六种信息分清楚，时刻有这个概念，不仅仅对于写出逻辑清晰的句子有帮助，对于阅读一些句式复杂的文章，
快速掌握其要表达的含义也非常有帮助。

其实在美国法学院上过写作课的同学都应该听说过这个概念，不过大概不会所有人都真的认认真真的做case chart。起码根据我身边的sample，即使写作老师强调了case chart的重要性，很多人也觉得是无用功又耗时间，不会真的去做。
先讲讲什么是case chart吧，其实这个对原始信息进行归纳整理的方式，不仅对于法律检索很有帮助，对于任何需要进行资料收集、归纳分类和总结提纳的工作，比如写paper写报告准备模拟法庭比赛，都是一项黄金技能点呢。
美国法律英语写作是以案例为基础的。还记得我们上节课讲到的bluebook大·法吗？这套规则就是教你怎么在文章中表述引用找到的案例。在具体写作的时候，每一个法律规则，都必须伴随着案例的引用和说明。
所以说，正常写memo/brief的流程都是先阅读facts →根据facts识别出法律问题（这个步骤通畅在课堂里可以省略，因为老师
会指定你需要关注的法律问题。但是在实践中，如何根据客户的具体情况而识别出需要处理的法律问题，当然是要自己来做的）→根据识别出来的法律问题进行法律检索→找到一大堆案例、论文、评述→根据找到的资料总结出现行法律规则，并讲法律规则适用到facts 中→讲规则和规则的适用写出来，得出结论。
Case chart，顾名思义，就是在那个通过找案例/论文/评述而归纳出法律规则的阶段，非常有用的一个小工具——把所有案例都归纳在一个eXcel表格里。在美国，初级阶段的法律检索都是通过westlaw 或者leXis，根据已有的issue会找到很多案例，根据该issue的复杂程度，找到的案例从几十个到上百个不等。即使是几十个案例，要把每个案例的法律规则都总结出来，最后总结出你memo/brief应该组织成什么结构，都是一项浩大的工程。一般没经验的新手，就是把这堆案例全部读一遍，头昏脑胀之后再读一遍，慢慢有个概念之后开始写，写着写着发现好像漏了点什么于是又回去看案例，再修改自己写的东西。
但是如果在查到第一个案例的时候，就开始做case chart，就完全可以避免了这种查漏补缺的写作模式，省了很多无用功。

什么是一个句子的核心结构？英语语法101呀，主－谓永远是一个句子的核心结构。所谓将句子最重要的信息放在核心结构里，就是为了避免写出以下这种东西：
There are several procedures involved，which，if there is

把这个句子拿个一个初中生看，ta会迅速指出句子的核心结构是——There are procedures！这是什么鬼？这句话主要想表达的难道是这世界上有一些程序吗。如果翻译过来的话，你肯定也会调整句式，翻译成，公司收入有所增加时，必须严格遵循相应程序。所以这句话的主要信息是：必须严格遵循相应程序。什么时候遵循？公司收入有所增加时。
阅读英文时，人的习惯是下意识寻找主谓结构来确定句子的核心含义。（没有这种习惯的就要学会培养这种习惯了。）所以上面那个句子很容易让人第一遍读完摸不着头脑，必须回过头来再看一遍才能恍然大悟。虽然也就多个零点几秒的时间，但如果一篇memo/brief 种大量充斥着这种结构的句子，难免会让人抓狂。
那应该怎么改呢？试试把重要信息放在核心的主谓结构里，写成这样：
Several procedures must be carefully followed to increase corporate income.
用更少的单词更清楚准确地表达同样的意思，这就是法律英语写作的艺术啦。
随便再举两个栗子：
接下来想讲的第三个原则，其实不叫原则，只能说是一个小窍门吧，所以叫法律写作小技巧之三、擅用bullet point！
这一点可能比较冷门，甚至有些美国法学院一年级的法律写作课上都不会讲这个方法，但我个人经历的两个写作老师都非常推崇这种方式。有些写作流派也可能表述为擅用tabulation。但是其背后的理念都是一样的，那就是——不管你用什么方法，要不择手段的提升写作的清晰程度，以让读者最省事最快速最轻松的抓取信息为唯一目标。而bullet point/tabulation大·法这时候就起作用了。
简单表述，这个小窍门是这样用的。当你一段话/一句话需要表述两个或以上平行且有点重复的信息，用bullet piont或tabulation 将它们以列表的形式展现出来。这个大·法配上法律引注尤其好用。还是随便找一篇自己的memo来举栗子，这里我想表达的法律规则是，法院在判断根据美国统一商法典(UCC)，一个合同是否为买卖合同时，会考虑合同的两种特征：（1）双方在合同中是否被称作买方和买方，（2）该合同对标的描述是履行服务还是商品买卖。因为这两种合同的特征是平行的，每种特征又必须伴随着具体案例的引用，我就选择用bullet point的形式来写这个规则。
反正我作为bullet point爱好者，写memo/brief的时候从来都是抓住一切机会用这种逻辑超级清楚的方式来展现信息。但是也要记住不可盲目用bullet point，具体什么时候合适，还是要看个人的写作功力，在具体环境下多琢磨琢磨，如果用好了，会把本来纷繁复杂的信息清楚的列出来，给法官/律所老板(你写的brief/memo的主要阅读者)眼前一亮的感觉。
在用bullet point进行法律英语写作的时候，谨记一条原则就
是每个bullet point后面跟着的句式和语法结构一定要平行！至于到底什么算是真正平行的句式，又可以写一节课了。最简单的，上面那个例子，两个whether从句就是平行，但如果是动名词(describing)和动词(to describe)就不是平行的。
其实相似的小技巧还有很多很多，我们期末的时候老师给了一份关于雕琢语言的checklist，一共有30个规则。所以一堂完整的法律写作课能教的东西，真的不是一次两次科普可以讲完的呀。想深入学习的同学就去找下面的阅读书目来看咯。

我自己的case chart是长这样的——左边第一排纵列是案例名字，为了以后复制粘贴方便，我通常在做case chart的阶段就会把完整的bluebook citation整理出来。
上面第一个横排就是针对每一个案例，你要总结哪些方面。上图列出来的依次是：
以上就是一个case chart的基本构成——一般法学院的写作课也就是教到这里了，其实这些点跟平时读reading时做case brief 的结构差不多。记录每个案例时候的详略程度也跟你个人的风格和习惯有关。有的人呢，只是写个大概，有一个整体的结构就好。但是我个人的风格就是能做多细做多细，有时候直接复制原文并附上页码，这样我后期写作的时候，根本不用回头去翻案例，只看这张表格就够了。
具体要详细到什么程度，还是要在你具体做case chart的时候
慢慢揣摩，根据你自己的写作习惯来决定哪种方式最适合你。像有些人就觉得，一开始做的太细了是浪费时间，反正最后写作的时候都要回头仔细仔细的看案例来进行对比。所以要时刻关注自己的个人写作倾向，找出对自己写作最有效率帮助最大的一种方式来总结案例。
下面来讲一个我自己做case chart的进阶版小技巧，就是针对每个案例，除了基本的facts/holding之外我还会总结啥。
在动笔开始写任何一个memo/brief前，第一个要搞清楚的事就是这个法律问题要从哪几个方面来分析，从而确定memo/brief的基础结构。比如说，你要分析的问题是法院能否强制给精神病人注射药物使其能够正常参与审判工作，最高法院的案例说要分析下面几个因素：政府是否有正当理由主张强制注射、注射的药品能否保证生效、以及强制注射是否是使病人恢复正常认知能力的唯一手段。那么，你的memo/brief一定是从这三个点着手，依次分析根据本案的事实，这三个要素能否同时满足。
确定结构这一部分有时候很简单，比如说如果有一个最高院的案例明确给出了三个要素，那肯定就是这个分析结构没跑了。但有的时候，你所在的管辖区(jurisdiction)的最高法院并没有分析过这个问题，这时候你只能根据上诉法院的一大堆判例，自己总结出一个法律规则出来。比如说我要分析根据伊犁诺伊斯州的法律，合同违约方的救济补偿措施是否满足合同约定，而伊州的高院并没有给出一个明确的test说要考虑哪些因素，这时候我只能自己读了一堆案例后总结出来，伊州上诉法院曾经考虑过这些因素：违约方的救济补偿措施是
否本质上诚实善意(good-faith)合同标的物是否是高科技产品，使得产品售后维修变得异常困难等等。而法院在判定违约方是否“诚实善意”的时候，又考虑过几个次级因素(sub-issues)：比如说维修工作是否及时、违约方是否承担了主要费用等等。
这样看了几个案例后，你脑子里就自然形成了这个法律问题的分析体系了：A+B+C，其中A又可以从1、2、3、点进行分析。
这个时候高能预警来了——你的case chart应该反映出针对每一个点，应该用哪些案子进行分析——换句话说，你应该标记清楚哪些案子属于A，哪些案子属于B，哪些案子属于A1或A2、很多人在最开始做case chart的时候意识不到这一点，所以通常就是针对每个案子总结出facts/holding/reasoning就完了。但是到后来真正动笔写作的时候才发现，你写作是按照issue来写的啊！所以当你开始论证A了，尽管你的case chart上记录了每个案子的判决结果和理由，但是并没有分类标记可以适用于哪些issue，这时候case多的同学就懵逼了，要花很多时间回去重新读案子。
所以我自己的完整版case chart最有用的是后半部分：
最上面一个横排是我这个memo/brief可能涉及到的所有issue，这里我并没有标记是A1还是A2还是B什么的，因为每个问题属于论证结构的哪个部分已经在我脑子里了，我只是通过case chart来记录这些案子讨论了这些issue。第二个横排记录的是本案针对这些issue的事实，方便我看其他案子的时候进行对比分析。下面三排每排代表一个案例，比如说第四排那个案例，涉及到三个issue，我在
做case chart的时候就会把法院的分析记录下来，有的时候直接复制粘贴。这样后期在写memo/brief的时候，比如说该写违约方是否有Good faith这个问题了，那我只需要看Good Faith这个纵列（左边第二列）看看现有案子是怎么分析这个问题的，再根据本案进行比对，然后就可以落实到纸上把我对两个案子的交叉对比写出来咯！
讲真我也是法学院第一个memo写完后，才恍然意识到case chart 这样做可以节约很多时间。一开始我也是像做case brief那样只记录基本的facts和reasoning，但是发现了这个根据issue分类记录大·法后，虽然前面research阶段要多花一点时间，但是后期写作的时候简直是手到擒来战无不胜速度飞快。进行到每一个issue的时候，只需要看相应的纵列，如果那个案子分析复杂的话再稍微看一下原文，就可以开始嗖嗖的动笔写了。
这个做case chart的方法论，其实我觉得同样可以适用于一些其他需要事先收集很多资料的写作过程。比如说你要写论文，也是有ABCD的结构，这时候你一开始查找资料的时候，就可以做个eXcel，记下来每个资料能用在ABCD的哪个阶段，并简要总结一下针对那个问题该资料的核心论点是什么，后期写作的时候看纵列，就可以直接定位所有的source了呢！
来回顾一下，做出一个超级有用可以帮你节约时间的case chart 需要三步：1、根据阅读大量案例先确定分析论证的结构，2、根据结构回顾并检索新的案例，并记录下每个案例分析了那些论点。3、后期写作的时候，只需要回顾每个论点(纵列)下面记录的案例，与本案
事实进行交叉对比就可以开始写作啦！
