新加坡建筑工劳工合约 (中英文)CONTRACT FOR FO EMPLOYMENT REIGN CONSTRUCTION WORKERSIN THE REPUBLIC OF SINGAPORE(雇佣外籍建筑工人合同)This Employment Contract (雇佣合同)is made between兹由 (1) ________________________________________________________ having its registered address at :(hereinafter referred to as the “Employer”) on one part and (以下简称雇主,为一方,与):Name (姓名)Nationality (国籍)Date of Birth (出生日期)Identification No.(身份证号码)Address(家庭住址)(hereinafter referred to as the “Employee”) on the other part who voluntarily bind themselves to the terms and conditions in this employment contract (以下简称为雇员,作为另一方,自愿达成以下雇佣条款):IT IS HEREBY AGREED THAT this employment contract, which includes the terms and conditions stated in Annex A and any documents referred to in them and any alterations, modifications, amendments or revisions to the same notified by theEmployer to the Employee form the contract of employment between the Employer and the Employee:同时,本雇佣合同也包括附件A及其提及的文件内容以及在执行过程中根据情况对这些内容进行的补充、修改和完善,并相应通知雇员。
1. General Principle(总则)1.1 The Employment Contract is to be signed by the Employee under his notion and common understanding. And it has been studied by himself and considered carefully under his own sanity and his family’s permission.本雇佣合同书是雇员在充分理解的基础上签订的。
雇员在签署时,神智清醒,无任何压力或引诱,并已取得家属支持后,经多次阅读和反复思考,完全自愿签署的。
1.2 After this Contract is signed, the employment relationship will be established. And it should be the behavior standard of the employee’s. Any breach for it,the Employee will accept the relative penalty for his own deeds.本合同签署后,雇员的一切言行必须以本合同为准则,若有违反,雇员自愿受罚。
2. Task (工作安排)2.1 The Employer may at their absolute discretion assign the Employee in a different trade/task from time to time. The Employer reserves their right to adjust the Employee’s pay accordingly if the Employee is unable and/or is incompetent to carry out the assigned trade/task.雇主有权根据需要将雇员安排在另一个职位工作。
同时,雇主保留因雇员不能胜任工作而对其工资进行调整的权利。
2.2 The Employee should be physically healthy and pass all the medical check by authorized doctors in Singapore. And the employee should be a qualifiedconstruction worker that can work at heights, bear heat, and any other tough working environment on site.雇员必须身体健康,能通过新加坡医院和诊所组织的体检。
雇员必须是合格的建筑工人,工作时做到能吃苦,不怕晒,不怕热、适应在高空、基坑或海上工作,能够从事各项建筑施工。
3. Duties of Employee (雇员职责)3.1 Location (工作地点)Any of the work sites designated by the Employer within the Republic of Singapore.新加坡共和国内任何一个雇主指定的工地。
3.2 Working Time (工作时间)The working time should be decided by the employee according the law of Singapore. 雇员的工作时间按照新加坡的雇佣法由雇主决定。
3.3 The employee should follow the regulations and instruction by the Employer. Any absence for work without a valid reason, the Employer could give the fine ofS$50.00. If the absence accumulated to 3 days, the Employer could perform the right and repatriate the Employee.雇员必须服从雇主的领导与管理。
对于旷工的雇员,雇主可处以每天50.00新币的旷工罚款。
连续旷工3天者,雇主可以取消其准证并遣送回国。
4. Contract period (合同期)4.1 The contract period is for two (2) years. All the employees shall strictly follow this 2 years’ contract period. Otherwise, the Employee shall compensate to the Employer according to the relative clause of this Employment Contract.本合同雇佣期为两年,雇员务必严格遵守。
否则,根据本雇佣合同相应条款,给予雇主补偿。
4.2 Upon completion of the first year’s employment, the Employer may at their absolute discretion decide not to renew the work permit for the secondary year without giving any reason and without being liable for any compensation to the Employee.在第一年雇佣期满后, 雇主根据工作需要及雇员的工作表现,为雇佣办理工作准证延期。
雇主有权辞退不合格的雇员,而不需给予原因和补偿。
4.3 If the Employee refuses to comply with this two (2) years’ contract period,the Employee shall be responsible for his own repatriation costs to his domicile country and all the compensation to the Employer which may be paid from the Employee’s salary.如果雇员在雇佣期内拒绝履行为期两年的雇佣合同,雇员必须自己承担相关遣返费用和对雇主的赔偿。
该费用由雇员从其工资中直接支付给雇主。
4.4 Upon completion of this two year’s employment, it could be extend under the consensus between the Employer and the Employee.两年雇佣期满,如果雇主与雇员双方同意,可以延长合同期限。
5. Work Permit (工作准证)The Employee shall hand over his travel/passport documents and Work Permit to the Employer during the employment in the Republic of Singapore for processing.雇员在到达新加坡的雇佣之日起,应将其护照及工作准证等有关证件交给雇主保管。
6. Salary (工资)The Employee’s salary shall be calculated strictly based on piecework system. Piecework system shall adopt the following quota rate (S$) which may be revised or adjusted by the Employer at their absolute discretion from time to time. Any revision or adjustment of the piecework rates per unit stated below will be notified to the Employee as and when made on the general notice board of each work site and available from the supervisors:(a) Timber formwork 4.00-8.00/m2(b) Metal formwork 4.00-8.00/ m2(c) Rebar 50.00-120.00/ton(d) Bricklaying 2.00—3.50/m2(e) Plastering 1.50—3.00/m2(f) Tiling 5.00—8.00/m2(g) Concrete 3.00—9.00/m2Based on the above piecework system, the Employee’s average income under fullattendance during this employment period shall be S$1350 per month or even higher, provided that the Employee can perform his duties competently and efficiently andcan deliver the qualified products according to the Employer’s requirements andassignments.雇员在新加坡的工资收入严格按计件工资制计算。
