电气设备安全管理制度条例背景电气设备在现代工业和生活中占据着重要地位,它们的使用不仅使生产效率提高,而且使人们的生活更加方便,但与此同时,电气设备也带来了安全隐患。
据相关统计数据显示,在使用电气设备过程中,因电气安全事故造成的人员伤亡和财产损失严重,甚至有多起大型火灾、爆炸事故发生。
因此,为制定电气设备安全管理制度来保障人员的生命安全和财产安全就变得尤为重要。
目的为加强电气设备的安全管理,保障人员生命和财产安全,制定本条例。
适用范围本条例适用于企事业单位和个人使用的电气设备,不适用于交通运输、广播电视、通讯、军事、国防等特定领域的电气设备,特定领域的电气设备可以根据实际情况制定特别管理制度。
电气设备安全管理制度一、电气设备的管理1.企业应当建立完善的电气设备管理制度和管理体系,定期组织电气设备的检修和维护,确保设备的正常运行。
2.企业应当建立电气设备管理档案,定期进行备份,确保数据的安全性和完整性。
二、电气设备安全保障1.企业应当按照国家安全标准要求采取必要的安全措施,确保电气设备的安全运行。
2.企业应当根据实际情况制定应急预案,确保在电气设备发生故障、事故或者特殊情况时,能够及时、有序地处理。
三、电气设备的使用1.企业应当按照国家安全标准要求使用电气设备,不得私自改动设施、使用过期或者失效设备。
2.企业应当指定专人负责电气设备的使用,确保设备的安全性和稳定性。
四、电气设备的维护和检修1.企业应当制定电气设备的检修计划,并落实到实际操作中,不得误操作或漏检。
2.企业应当进行设备保养和维护,确保设备的正常使用。
3.企业应当按照规定周期对设备进行定期检修,确保设备的稳定性和安全性。
五、电气设备的巡视1.企业应当建立完善的电气设备巡视机制,定期进行巡视,及时发现设备问题。
2.巡视发现问题应立即采取措施进行处理和修复。
后果与处罚对于不符合安全管理制度规定的企业或个人,应当给予相应的处罚,包括罚款或者吊销资质等。
2024年电气设备安全管理规定____年电气设备安全管理规定第一章总则第一条为了加强电气设备的安全管理工作,防止和减少电气设备的事故、故障和损坏,保障人民生命财产安全,根据《中华人民共和国安全生产法》和其他相关法律法规的规定,制定本规定。
第二条本规定适用于在中华人民共和国境内生产、销售、使用、维护和检测的所有电气设备。
第三条电气设备安全管理的目标是确保电气设备具备安全可靠的运行状态,防止事故发生,并及时排除安全隐患。
电气设备安全管理应以预防为主,综合运用法律、技术、经济和管理手段,全面提高电气设备的安全性能和管理水平。
第四条电气设备应具备符合国家标准和行业标准的安全技术要求,生产过程应符合相关法律法规的要求。
第五条电气设备安全管理应坚持科学、严谨、公正、公开的原则,倡导全员参与、协作共治和风险共担的理念。
第六条电气设备安全管理应当积极推广先进技术和管理经验,加强国际合作与交流,根据国际电气设备安全标准和国际行业发展趋势,及时修订和完善本规定。
第二章电气设备的安全要求第七条电气设备应满足以下安全要求:(一)电气设备应符合国家和行业标准的要求,具备产品合格证明文件。
(二)电气设备的设计、制造和安装应符合相关技术规范和标准,保证设备的可靠性和安全性。
(三)电气设备的保护措施应健全,能够防止电气触电、漏电、过电流、过压、过温等事故发生。
(四)电气设备的维护保养工作应按照设备说明书和相关规定进行,确保设备运行的安全可靠。
(五)电气设备的运行状态和安全性能应定期进行监测和评估,及时发现和解决安全隐患。
第八条电气设备的生产企业应具备以下条件:(一)有独立的研发、设计和生产能力,拥有一定的技术力量和生产设备。
(二)采用先进的管理模式和质量控制措施,确保产品质量符合国家和行业标准。
(三)建立有效的质量管理体系,并通过相关认证。
第九条电气设备的销售商和使用单位应具备以下条件:(一)对电气设备的质量、技术性能和安全要求具有充分的了解,并提供相关的技术支持和服务。

LED照明产品要进入日本市场,首先要满足《电气用品安全法》及其相关实施法规的要求。
目前LED 产品中受《电气用品安全法》管控的主要是电源模块,如果电源是外置的,则需依据J61347-2-13(即JIS C 61347-2-13)进行检测,合格之后加贴菱形PSE标志。
在电磁兼容方面,则要满足J55015标准,这也是强制性的。
此外,还有一些安全标准日本法规中并没有作强制性要求,如JIS C 8154、JIS C 8121-2-2、J60968、J60598系列、JIS C 6802等,但企业也应该参照这些标准进行生产,以保证产品的质量。
在LED照明产品的性能要求方面,JIS C 8153规定了LED模块用交直流控制装置的性能要求。
另外,日本还是最早制定白光LED检测标准的国家,本章也将会对该标准作简要介绍。

METI成立于1949年5月,原名通商产业省,是主管贸易和投资的政府部门之一,负责贸易政策和吸引外资政策的制定与实施、从事进出口审批和许可等管理工作。

電気用品安全法施行令(昭和三十七年八月十四日政令第三百二十四号)最終改正:平成二四年三月三〇日政令第九六号内閣は、電気用品取締法(昭和三十六年法律第二百三十四号)第二条、第二十八条第二項、第四十五条第一項及び第五十四条から第五十六条までの規定に基づき、この政令を制定する。
(電気用品)第一条電気用品安全法(昭和三十六年法律第二百三十四号。
以下「法」という。
)第二条第一項の電気用品は、別表第一の上欄及び別表第二に掲げるとおりとする。
(特定電気用品)第一条の二法第二条第二項の特定電気用品は、別表第一の上欄に掲げるとおりとする。
(証明書の保存に係る経過期間)第二条法第九条第一項ただし書の政令で定める期間は、別表第一の上欄に掲げる特定電気用品ごとにそれぞれ同表の下欄に掲げるとおりとする。
(検査機関の登録の有効期間)第二条の二法第三十二条第一項の政令で定める期間は、三年とする。
(外国登録検査機関の事務所等における検査に要する費用の負担)第二条の三法第四十二条の四第二項の政令で定める費用は、同条第一項第八号の検査のため同号の職員(同条第三項の規定により独立行政法人製品評価技術基盤機構(以下「機構」という。
)に当該検査を行わせる場合にあつては、機構の職員)がその検査に係る事務所又は事業所の所在地に出張をするのに要する旅費の額に相当するものとする。
この場合において、その旅費の額の計算に関し必要な細目は、経済産業省令で定める。
(報告の徴収)第三条法第四十五条第一項の規定により経済産業大臣が電気用品の製造又は輸入の事業を行う者に対し報告をさせることができる事項は、その製造又は輸入に係る電気用品の型式、数量、製造又は保管若しくは販売の場所、検査記録の内容、主たる販売先並びに当該電気用品の使用に伴い発生した危害及びその再発の防止のために講じた措置に関する事項その他当該電気用品の製造又は輸入の業務に関する事項とする。
2法第四十五条第一項の規定により経済産業大臣が電気用品の販売の事業を行う者に対し報告をさせることができる事項は、その販売に係る電気用品の種類、数量、保管又は販売の場所、購入先及び主たる販売先に関する事項その他当該電気用品の販売の業務に関する事項とする。
电器用品安全法逐条解说第1章总则目的:第1条本法律在规制电气用品的制造,销售的同时,以确保电气用品的安全性,促进民间企业者的自主活动,防止电气用品产生的危险及障碍为目的。
解说:该法律是以防止电气用品产生的危险及障碍为目的,明确确保电气用品的安全性及参与并维持了公共安全。
为了达成该目的,国家制定了技术标准,规定了禁止一系列没有标记的电器用品的销售和使用。
1有关[电器用品]参照第2条2在[电器用品的制造、销售]里包括电器用品的使用。
3有关[确保电气用品的安全性的情况,促进民间企业者的自主活动]中[民间企业者]指包含了电器用品的制造、输入、销售的企业家及民间检察机关两者。
也就是说确保电器用品的安全性的根本意义是明确了民间活动。
[自主的活动]是指[自我为主体的活动]4[由于电器用品产生的危害]上,有火灾、触电等事故。
第2条在这个法律中,所谓的【电器用品】是指如下:一一般用电器用品零部件部分(第38条第一项),或者和其连接用的机械,器具或者材料。
在政令中规定二携带发电机,在政令中规定三蓄电池,在政令中规定2 在这个法律中【特定电器用品】是指,从构造或者使用方法等其他使用状况来看,有可能有危险或者障碍发生的电器用品,在政令中规定。
解说1电器用品范围(第1项)一关于电器用品范围是指,在第1项中规定,电器事业法中的一般用电器零部件部分和政令(电器安全法施行令)中规定的和其相关用的机械,器具或者材料。
二第1项第二号是指,在政令中规定的额定电压在30伏以上300以下的产品2特定电器用品的指定(第2项)一第2项:根据由于构造或者使用方法等的使用状况,发生了触电、火灾等危害或者障碍的轻重来定,如果其程度较重的话,视其为特定电器用品,国内登录检查机关或者外国登录检查机关有义务进行适合性检查。
第2章业者申报第3条进行电器用品的制造和进口的制造业者,要根据经济产业省令所规定的电器用品的区分,从事业开始日开始后30天之内,必须向经济产业大臣提出申报一姓名(法人时以代表者名),名称,地址二经济产业省令规定的型式区分三制造工厂,事业场所的名称,所在地(在进行电器用品的进口时,该电器用品的制造业者的姓名,名称及地址)变更的申请第5条申报业者在第3条的各项中出现事项的变更时,不能延迟,必须向经济产业大臣提出申报。
电气安全用具管理规定范本第一章总则第一条为了保障企业电气设备的安全使用,防止电气事故的发生,保障员工的生命财产安全,根据《中华人民共和国安全生产法》等相关法律法规,制定本管理规定。
第二条本管理规定适用于企业内所有使用电气设备的岗位,包括但不限于生产线、办公区域、配电室、设备维修等。
第三条企业应当建立健全电气安全管理制度,明确责任和权限,加强对电气设备的安全监管和管理。

第三章电气安全用具使用第十一条员工在使用电气安全用具时,应按照操作规程进行操作,并严禁擅自改动或修理。

第十八条员工应当加强对电气设备的安全防护意识,自觉遵守本管理规定。
第五章处罚与奖励第十九条对于违反本管理规定的员工,将按照公司相关制度予以相应处罚。
电气安全用具管理规定范文第一章总则第一条根据《安全生产法》等相关法律法规的规定,为保障职工安全使用电器设备,预防和减少电气事故的发生,制定本管理规定。
第二条本管理规定适用于本单位所有电器设备的管理和维护工作。
第三条电器设备管理的基本原则是安全第一、预防为主、综合治理。
第四条本单位应建立健全电器设备管理制度和安全工作机构,明确责任分工。
第五条职工应接受必要的电器设备操作和维护培训,提高电器安全意识和技能。

第三章电器设备的维护与保养第十一条电器设备的维护与保养应严格按照生产厂家的操作规程进行,不得擅自更改和调整电器设备的参数。
第十二条定期维护应包括外观检查、电源线检查、接地线检查、防护罩检查等项目。
第十三条电器设备应定期进行防雷击和过压保护装置的检查和试验。
第十四条电器设备的保养工作应包括清洁、润滑、紧固、防锈等项目。
第十五条定期维护和保养的记录应详细、真实,并保存至少三年。
第四章电器设备的检查与试验第十六条本单位应定期对电器设备进行安全检查和试验,确保设备的安全可靠。
第十七条安全检查和试验应由具备相关资质的专业人员进行,检查和试验的内容应全面、细致。
第十八条安全检查和试验应包括设备的外观检查、接地、绝缘、漏电、动作特性等方面。
第十九条安全检查和试验的结果应及时整理、分析,并进行相应的处理措施。
第五章电器设备的报废与更新第二十条对出现重大故障、超龄、不再适用的电器设备,应及时进行报废处理。
电气产品技术基准省令1 电气产品安全法(1961年法律第234号。
以下称“法”)第八条第一项经济产业省令规定的技术基准,针对下表中上一栏列出的每一电气产品种类,在该表下一栏中均给出相应的技术基准。
此时,对于电气产品安全法实施规则(1962年通商产业省第84号)附表第二的“产品名”项所列出的具有2个以上电气产品功能的电气产品来说,分别适用于各产品名相关的技术基准。
一、材料1.容器的材料要能够承受通常使用状态下的温度,(BP温度-40°,以平常温度上升的状态来判断)2.电器绝缘物及热绝缘物,要能够承受其接触和接近的物体的温度,且无吸湿性,(在使用温度的上限表中的数值以下,以周围温度30°判断)3.机器的零部件及构造材料,为非可燃性物质4.绝缘物,不会因为电弧造成变形和变质5.铁及钢,要经过电镀,喷粉,油防护等的防锈处理6.导电材料为铜或者铜合金(在高温部位和弹性部位等有特例)7.屋外用的产品的外部材料,为金属,合成橡胶,陶瓷器或者含有耐热性的合成树脂(77°—83°1小时无异常发生)8.电源用端子螺母的材料,为铜,铜合金,不锈钢9.地线用端子的材料,为铜,铜合金,不锈钢10.容器的部品材料中不含有PCB11.和饮用水,食品有接触的部分的材料,是无害的二、构造1.在通常使用状态下,不可能发生火灾,触电,伤害等,安装良好,运转顺利,多为保管,收纳,环境,使用者考虑2.远隔操作器具,除了开关或者控制系统以外均不能操作(不会由于外来电波,音波而发生误运转)3.易发生翻倒的情况下会有危险发生,在倾斜到如下角度的时候不会发生翻倒(倾斜15°,滑到,移动)4.安装到木材上(床,墙壁)的材料,要容易安装并且能够坚固的固定住5.由于开关的开和关,会形成电弧6.将卸下的东西卸下时,手指不要接触到充电部位7.空间距离。
离地面距离适合以下空间距离的测定,对容器外施加30N,容器内施加2N的力进行测定(单位mm)15V以下 1 0.5 1 0.550V截止 1.5 1.2 1.2 1.2 2150V截止 2.5 1.5 2 1.5 3300V截止 3 2 2.5 2 48.绝缘厚度适合以下容器外部0.8mm以上内部0.3mm以上绝缘带0.4mm以上,无砂眼如果是耐电压,耐热材料,耐伤材料的话,厚度不需要问(规定试验要求确认)9.连接部分通常使用状态下不要发生松弛有效螺纹,确保金属2个,合成金属5个以上导线在三股以上拧成的话要用焊锡焊接10.容器内部配线适合以下即使以2N的力接触高温部位也无异常用2N的力,可动部位不发生振动现象以2N的接触引擎部位无损伤可动部位可以承受弯曲试验(往返1000回,断线率30%)连接部位来回拔5次后,有5N以上的保持力11.电线的贯通部位12.来拽电线,来回插入,给连接部位施加力,套管不掉下来(30N小于自重*3小于100N,能够承受15S)13.器具间的电线,要设立短络,过电流,低络等保护装置(附表61(3)14.导管中的导电部位,在连接金属部位的时候,不能和金属部位的导电部位有接触15.屋外使用器械,充电部位不能浸入水,水中的部分要有防水构造16.由于吸湿在燃烧和触电部位需要有防湿处理17.由于温度上升,过电流,过负荷等可能会发生危险,要设立保护装置(保护装置通常状态下不运转)18.超过150V的器械要连接地线,(二重绝缘。
电气工器具和防护用品使用管理规定第一章总则第一条为了保障电气工作人员的安全,确保电气工作的顺利进行,根据相关法律法规的要求,制定本规定。
第二条本规定适用于所有从事电气工作的人员。

第十四条防护用品的保管应当专人负责,存放在干燥、通风、无腐蚀性物质的地方。
第十五条防护用品应当配备齐全,并保证质量合格。
第十六条防护用品的使用人员应当妥善保管,正确使用,并按照规定进行必要的检查。
第四章监管和教育培训第十七条监督部门应当定期检查电气工作的实施情况,发现问题及时整改。
第十八条电气工作人员应当定期接受相关培训,提高工作技能和安全意识。
第十九条各级管理部门应当加强对电气工作人员的安全教育和宣传,提高他们的安全意识。
第五章附则第二十条本规定自发布之日起执行。
第二十一条本规定解释权归本单位所有。

The following documents shall be attached to the written report of the preceding paragraph.(1) In the case of a person who has acceded to the position of a Reporting Supplierby being assigned the whole business covered by the Report pursuant to the provisions of the Law, Article 4, Paragraph 1, a document based on Form 3.(2) In the case of a successor, selected by the agreement of all of two or moresuccessors, who has acceded to the position of a Reporting Supplier pursuant to the provisions of the Law, Article 4, Paragraph 1, a document based on Form 4 and a certified copy of said person’s family registration.(3) In the case of a successor, other than the successor of the preceding item, whohas acceded to the position of a Reporting Supplier pursuant to the provisions of the Law, Article 4, Paragraph 1, a document based on Form 5 and a certified copy of said person’s family registration.(4) In the case of a juridical person which has acceded to the position of a Reporting Supplier by merger pursuant to the provisions of the Law, Article 4, Paragraph 1, a certified copy of the registration of the juridical person.(Report of Change) Art Article 6icle 6icle 6 Any person who intends to make a report of change in the reported matters of a business pursuant to the provisions of the Law, Article 5, shall submit a written report based on Form 6 to the Minister of Economy, Trade and Industry. (Changes in Minor Details) Article 7Article 7Minor changes stipulated by Ministry of Economy, Trade and Industry Ordinance of the proviso of the Law, Article 5 shall mean a change in the name of the representative of a juridical person when the Reporting Supplier is a juridical person.(Report of Dissolution) Article 8Article 8 Any person who intends to make a report of dissolution of business pursuant to the provisions of the Law, Article 6, shall submit a written report based on Form 7 to the Minister of Economy, Trade and Industry. (Provision of Information) Article 9Article 9Any person who intends to request the provision of information pursuant to the provisions of the Law, Article 7, shall submit a document describing the matters listed next to the Minister of Economy, Trade and Industry:(1) Name and address(2) Description of information intended to requestChapter 3 Conformity Assessment of Electrical Appliances and Materials Etc. (Application for Approval of Exemption of Obligation to Comply with Requirements etc.) Article Article 10 10 101. Any person who intends to obtain approval of the Law, Article 8, Paragraph 1, Item 1 shall submit a written application based on Form 8 to the Minister of Economy, Trade and Industry.2. The Minister of Economy, Trade and Industry may request the submission of a sample or a record of testing of the electrical appliance or material covered by the application from the applicant when deeming it necessary when there is an application for approval of the preceding paragraph.(Method of Testing Etc.)Article 11Article 111. The type of the testing in the testing pursuant to the provisions of the Law, Article 8, Paragraph 2 shall be in accordance with Appendix 3.2. The matters which a Reporting Supplier should describe in the record of testing pursuant to the provisions of the Law, Article 8, Paragraph 2 shall be as follows:(1) The name and classification of type of the electrical appliance or material and adescription of the construction, materials, and performance(2) The date and place where the test was conducted(3) The name of the person conducting the test(4) The quantity of the electrical appliance or material tested(5) The method of the test(6) The results of the test3. The period for which the record of the testing should be kept pursuant to the provisions of the Law, Article 8, Paragraph 2 shall be three years from the date of the test.(Storage by Electromagnetic Means)Article 12Article 121. The record of the testing stipulated in the Law, Article 8, Paragraph 2 may be prepared and kept by recording the matter described in the items of that Article, Paragraph 2 by an electromagnetic means (meaning an electronic method, a magnetic method, or another method not able to be discerned by the human senses, same in Article 28).2. When keeping records pursuant to the provisions of the preceding paragraph, the record of testing of that paragraph shall be made able to be immediately displayed using a computer or other apparatus according to need.3. When keeping records pursuant to the provisions of Paragraph 1, effort shall be made to ensure the standards stipulated by the Minister of Economy, Trade and Industry.(Equivalent of Certificate)Article 13Article 13A certificate stipulated by the Ministry of Economy, Trade and Industry Ordinance deemed to be equivalent to the certificate of the Law, Article 9, Paragraph 2 stipulated in the Article, Paragraph 1 shall be any one listed in the following items:(1) When a foreign manufacturer manufacturing said specific electrical applianceor material has a document issued from an authorized conformity assessment body or approved conformity assessment body (hereinafter referred to overall asa "conformity assessment body") and certifying conformity with the technicalrequirements stipulated in the Law, Article 8, Paragraph 1 and the standards stipulated in Article 15 by testing by a method given in the following article fora type of specified electrical appliance or material which a Reporting Supplierintends to import, a copy of that document issued by the issuing conformity assessment body at the request of the manufacturer for a period until the date of elapse of the period stipulated by Cabinet Order of the Law, Article 9,Paragraph 1 for each specified electrical appliance and material counted from the date of receipt of the document by the manufacturer.(2) Anything in addition to that given in the preceding item specially recognized asequivalent by the Minister of Economy, Trade and Industry.(Method of Conformity Assessment)Article 14Article 14The method given in the Law, Article 9, Paragraph 1, Item 2 among the methods of testing stipulated by Ministry of Economy, Trade and Industry Ordinance of that Article, Paragraph 2 shall be a method deemed suitable for confirming conformity with the technical requirements stipulated in the Law, Article 8, Paragraph 1 and a method deemed suitable for confirming conformity with the standards stipulated in the next article in the plant or place of business of the Reporting Supplier covered by the conformity assessment for testing facilities and other matters stipulated by Ministry of Economy, Trade and Industry Ordinance.(Standards Stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 9, Paragraph 2)Article 15Article 15The standards stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 9, Paragraph 2 shall be those given in the column of Technical Requirements of Appendix 4 for each type of testing facility given in the column of Testing Facility of that appendix.(Matters Described in Certificate)Article 16Article 16The matters described in the certificate of the Law, Article 9, Paragraph 2 shall be those given in the following items:(1) Name of conformity assessment body(2) Name and address of applicant(3) Classification of type of specified electrical appliance or material(4) Name and address of plant or place of business producing the specifiedelectrical appliance or material (for importer, the name and address of themanufacturer producing the specified electrical appliance or material and the name and address of the plant or place of business producing the electricalappliance or material)(5) Method of test(6) Fact of conformity with the technical requirements stipulated in the Law,Article 8, Paragraph 1 and the standards stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 9, Paragraph 2 (only relating to tests relating to the Law, Article 9, Paragraph 1, Item 2)(7) Date of issue of certificate(Method of Marking)Article 17Article 171. The method of marking stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 10, Paragraph 1 shall be based on the methods of marking stipulated in Appendix 5 for the matters to be marked given in the following items:(1) For specified electrical appliances and materials given in the left section of theEnforcement Ordinance, Appendix 1, the symbol stipulated in Appendix 6, the name of the Reporting Supplier, and the name of the conformity assessment body from which the certificate stipulated in the Law, Article 9, Paragraph 2 was issued(2) For electrical appliances and materials given in the Enforcement Ordinance,Appendix 2, the symbol stipulated in Appendix 7 and the name of the Reporting Supplier2. For the name of the Reporting Supplier or Conformity Assessment Body to be marked pursuant to the provisions of the preceding paragraph, use may be made of an approved abbreviated name or a reported registered trademark (meaning registered trademark of the Trademark Law (Law No. 127 of 1959), Article 2, Paragraph 2) when the person has obtained the approval of the Minister of Economy, Trade, and Industry or has reported it to the Minister of Economy, Trade and Industry.3. A Reporting Supplier intending to obtain approval or make a report pursuant to the provisions of the preceding paragraph shall submit a written application or written report based on Form 9 to the Minister of Economy, Trade and Industry.Chapter 4 Restriction on Sales(Application for Exceptional Recognition relating to Sale)Article 18Article 18The provisions of the paragraphs of the Article 10 shall apply mutatis mutandis to applications for approval of the Law, Article 27, Paragraph 2.Chapter 5 Authorized Conformity Assessment Bodies Etc.Section 1 Authorized Conformity Assessment Bodies (Classification of Authorization)Article 19Article 19The classifications stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 29 shall be as follows:(1) Cables and cords(2) Fuses(3) Wiring accessories(4) Current limiters(5) Single-phase small power transformers and discharge lamp ballasts(6) Heating appliances(7) Electric motor-operated appliances(8) Electronic appliances(9) Alternating current electrical appliances (except those given from (2) to thepreceding items)(10) Transportable engine generators(Application for Authorization)Article 20Article 20Any person intending to apply for authorization pursuant to the provisions of the Law, Article 29 shall submit a written application based on Form 11 attached with the following documents to the Minister of Economy, Trade and Industry:(1) Articles of incorporation, act of endowment, or certified copy of registration(2) Inventory of assets and balance sheet on final day of fiscal year immediatelybefore fiscal year including date of application(3) Business plans and profit and loss statement and budget for fiscal yearincluding date of application and next fiscal year (differentiating between items relating to work of conformity assessment and items relating to other work) (4) Documents describing the following matters1) Names and curricula vitae of officers and names and curricula vitae ofconstituent members stipulated in the following article (hereinafter in thisitem simply referred to as "constituent member") or the business owners(when the constituent member is a juridical person, the name of thatjuridical person) and the ratio of the constituent members2) Name and address of place of business3) Number, performance, and location of machinery and equipment and otherfacilities used for work of conformity assessment4) Results of work resembling conformity assessment relating to applicationfor authorization5) The qualifications and numbers of persons engaged in the work ofconformity assessment6) Types and descriptions of work when engaged in work other than work ofconformity assessment(5) Document explaining that the applicant does not fall under the provisions ofthe items of the Law, Article 30(6) Document explaining that the applicant conforms to the provisions of the itemsof the Law, Article 22(Constituent Members of Authorized Conformity Assessment Body)Article 21Article 21The constituent members stipulated in the Ministry of Economy, Trade and Industry Ordinance according to the type of juridical person of the Law, Article 31, Item 2 shall be those given in the following items of the types of juridical person given in the items:(1) Juridical persons established based on the provisions of the Civil Code (LawNo. 89 of 1896), Article 34: Company employees(2) Limited partnerships and general partnerships of Commercial Law (Law No.48 of 1900), Article 53 and limited companies of Limited Liability CompanyLaw (Law No. 74 of 1899), Article 1, Paragraph 1: Company employees(3) Joint stock companies of Commercial Law, Article 53: Shareholders(4) Business cooperatives, small business cooperatives, and corporate associationsof the Law on the Cooperative Association of Small and Medium Enterprises (Law No. 181 of 1949), Article 3, and agricultural cooperatives of theAgricultural Cooperative Law (Law No. 132 of 1947), Article 4, Paragraph 1: Association members(5) Federations of cooperatives of the Law on the Cooperative Association of Smalland Medium Enterprises, Article 3 and federations of agricultural cooperatives of the Agricultural Cooperative Law, Article 4, Paragraph 1: Persons directly or indirectly comprising the same(6) Other juridical persons: Persons resembling those given in the preceding itemsfor juridical persons(Requirements for Conformity of Authorized Conformity Assessment Bodies) Article 22Article 22The standards stipulated by Ministry of Economy, Trade and Industry Ordinanceof the Law, Article 31, Item 3 shall be established so that the organization relating to the performance of conformity assessment, the method of conformity assessment, the method of calculating fees, other systems for performing the work for conformity assessment conform with the following items:(1) Specific persons shall not be improperly treated in a discriminatory fashion.(2) There shall be no effect from business relations with the person receiving theconformity assessment or other interests(3) There shall be no other liability of hindering fair performance of conformityassessments in addition to the above items(Proceedings for Renewal of Authorization)Article 23Article 23The provisions from Article 19 to the preceding article shall apply mutatis mutandis when an authorized conformity assessment body intends to obtain renewal of the authorization pursuant to the provisions of the Law, Article 32, Paragraph 1.(Report of Change in Place of Business)Article 24Article 24An authorized conformity assessment body shall submit a written report based on Form 12 to the Minister of Economy, Trade and Industry when reporting a change of location of the place of business pursuant to the provisions of the Law, Article 34.(Rules of Operation)Article 25Article 251. An authorized conformity assessment body shall submit a written report based on Form 13 attached with the Rules of Operation to the Minister of Economy, Trade and Industry up to two weeks before the date at which it intends to start work of conformity assessment when reporting Rules of Operation pursuant to the provisions of the Law, Article 35, Paragraph 1.2. The provisions of the preceding paragraph shall apply mutatis mutandis to a report of a change in the Rules of Operation stipulated in the provisions of the Law, Article 35, Paragraph 1, second half.3. The matters to be stipulated in the Rules of Operation of the Law, Article 35, Paragraph 2 shall be the following:(1) Matters relating to the hours of work for conformity assessment and holidays(2) Matters relating to the locations of work for conformity assessment(3) Matters relating to the stationing of assessors(4) Matters relating to the calculation of fees relating to conformity assessments(5) Matters relating to the issuance of certificates relating to conformityassessments(6) Matters relating to the appointment and dismissal of assessors(7) Matters relating to the storage of applications for conformity assessments(8) Matters relating to the method of conformity assessment(9) Matters given in the following 1) to 5) relating to another business whenconsigning part of a conformity assessment to that business1) Name and address2) Articles of incorporation, act of endowment, or certified copy of registrationor document resembling the same3) Document explaining technical competence relating to conformityassessments4) Document explaining that there is nothing liable to hinder the fairperformance of conformity assessments5) Document explaining where the responsibility for conformity assessmentslies and the division of the work(10) The name of the international commitment and the matters given in 1) and 5)of the preceding item when using the results of testing of another business (only one having an overseas address) based on an international commitment established by public announcement by the Minister of Economy, Trade and Industry.(11) Other necessary matters than those given in the preceding items relating tothe work of conformity assessment.(Suspension or Dissolution of Operation)Article 26Article 26An authorized conformity assessment body shall submit a written report based on Form 14 to the Minister of Economy, Trade and Industry when reporting suspension or dissolution of all or part of the work of conformity assessment pursuant to the provisions of the Law, Article 36.(Record Books)Article 27Article 271. The matters stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 42, Paragraph 1 shall be as follows:(1) The name and address of the person applying for the conformity assessmentand, for a juridical person, the name of its representative(2) The date of receipt of the application for conformity assessment(3) The product relating to the application for conformity assessment and theclassification of type stipulated by Ministry of Economy, Trade and Industry Ordinance of the Law, Article 3, Item 2 relating to the product(4) The name of the specified electrical appliance or material assessed forconformity and a description of its construction, material, and performance(5) The date the conformity assessment was performed(6) The name of the assessor performing the conformity assessment(7) A description of the conformity assessment and its results2. An authorized conformity assessment body shall differentiate between each type of specified electrical appliance and material in entries when entering matters given in the items of the preceding paragraph in the record books.3. The period for which the record books must be stored pursuant to the provisions of the Law, Article 42, Paragraph 2 shall be as given in the right section of Appendix 1 of the Enforcement Ordinance for each specified electrical appliance or material given in the left section of the Appendix.(Storage by Electromagnetic Means)Article 28Article 281. When the matters given in the items of Paragraph 1 of the preceding article are stored by being recorded by electromagnetic means and the records can be immediately displayed using a computer or other apparatus in accordance with need, it is possible to use the storage of these records in place of the storage of the record book recording the matters stipulated in the Law, Article 42, Paragraph2.2. When keeping records pursuant to the provisions of the preceding paragraph, effort shall be made to ensure the standards stipulated by the Minister of Economy, Trade and Industry.Section 2 Approved Conformity Assessment Bodies(Application for Approval)Article 29Article 29The provisions of Article 20 shall apply mutatis mutandis for applications for approval stipulated in the provisions of the Law, Article 42-3, Paragraph 1. In this case, the "Law, Article 29" in the article shall be read as the "Law, Article 42-3,Paragraph 1", the "act of endowment, or certified copy of registration" in the Article, Item 1 as "act of endowment, and certified copy of registration or something resembling the same", the "Law, Article 30" in the Article, Item 5 as the "Law, Article 30 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", and "Article 22" in the Article, Item 6, as "Article 22 applied mutatis mutandis in Article 30".(Application Mutatis Mutandis of Provisions Relating to Authorized Conformity Assessment Body)Article 30Article 30The provisions from Article 21 to Article 28 (except Article 25, Paragraph 3, Item 10) shall be applied mutatis mutandis to approved conformity assessment bodies.In this case, the "Law, Article 31, Item 2" in Article 21 shall be read as the "Law, Article 31, Item 2 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", the "Law, Article 31, Item 3" in Article 22 as the "Law, Article 31, Item 3 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", the "Law, Article 32, Paragraph 1" in Article 23 as the "Law, Article 32, Paragraph 1 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", "Article 19" as "Article 20 and Article 30 applied mutatis mutandis in Article 29", the "Law, Article 34" in Article 24 as the "Law, Article 34 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", the "Law, Article 35" in Article 25 as the "Law, Article 35 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", the "Law, Article 36" in Article 26 as the "Law, Article 36 applied mutatis mutandis in the Law, Article42-3, Paragraph 2", the "Law, Article 42, Paragraph 1" in Article 27 as the "Law, Article 42, Paragraph 1 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2", and the "Law, Article 42, Paragraph 2" in Article 28 as the "Law, Article 42, Paragraph 2 applied mutatis mutandis in the Law, Article 42-3, Paragraph 2".(Amount of Travel Expenses)Article 31Article 31The amount equivalent to the amount of travel expenses of the Enforcement Ordinance, Article 2-3 (hereinafter referred to as the "equivalent of travel expenses") means the amount of travel expenses to be disbursed pursuant to the provisions of the Law Relating to the Travel Expenses of National Civil Servants (Law No. 114 of 1950, hereinafter referred to as the "Travel Expense Law").
