3.开球后,必须使任何⼀颗⽬标球⼊袋或⾄少4颗⽬标球碰触台边。

承包方:(以下简称乙方)室内窗台石材工程经协商由乙方承担,为明确工程内容及双方责任,本着互利合作,分工负责的原则,商定以下条款,供双方信守。
第一条:工程概况

第三条:承包范围
1-31层飘窗板及窗台板石材安装,具体详见3层样板间。
材料要求:天然大理石板厚17mm,板厚误差值±1mm,所有楼层的板材要求同一批次生产出厂,同一批次的板材不能有色差,如果石材材质和样板不一致,板材厚度超出误差值或同一批次的颜色不一致,甲方要求无条件退货并索赔30%的赔偿。
第四条:计价方法及付款方式
计价方法
1、楼层内包干价,8#楼窗台板每层单价价格为元。
付款方式:
签订合同之后付订金30%,工程量完成80%之后付款50%。
验收合格双方确认结算后付至工程总造价的,余保修金,待保修期满后30天之内付清。
3、凭正式发票付款。
第五条:工期及质量要求
1、从开工之日起总工期30天(具体开工日期以甲方通知为准)。
2、质量要求符合国家有关技术标准。
第六条:双方责任
一、甲方责任
1、提供脚手架、水、电源的连接点及必要的临时施工用地。
2、负责及时确认乙方提交施工方案。
3、协调乙方与土建等施工单位的配合工作,不再向乙方收取施工配合费。
4、协调乙方组织工程竣工验收工作,并按合同约定支付工程款和办理结算。
二、乙方责任
1、与石材供应商共同提出石材加工尺寸及数量,并做好材料进场检查工作。
2、按相关质量及安全要求组织施工,并与合同生效后向甲方提供施工方案。
3、落实安全措施,遵守安全施工规程,施工中所发生的一切安全事故均由乙方负责承担。
4、服从甲方现场施工管理,及时配合现场其他交叉施工班组工作。
5、如工程质量和效果达不到施工技术标准要求,乙方应及时返工并承担费
用。
6、服从甲方总体计划安排,积极配合装修单位施工,若乙方拖延工期或施
工队伍技术素质差,能力不能满足施工要求,甲方有权更换队伍,乙方应在两日内无条件撤离现场,所做工程待工程竣工后结算。
7、工程竣工未交付使用前,乙方负责对现场的一切设施和工程成品进行保
护,若有损坏乙方负责。
第七条:安全生产
1、为确保工程的安全文明施工,减少意外事故的发生顺利完成竣工任务,同时为加强管理,为各承包方创造一个良好的适用范围。
乙方必须规范施工对进场工人要进行安全教育和培训,实名登记,如果在施工过程中由于乙方安全管理人员不到岗或其他原因造成安全事故导致本工程施工人员伤残、死亡所造成的一切费用全部由乙方承担(医药费,人身伤残费,死亡费等),甲方不承担任何费用,也不负连带责任,甲乙双方在本合同中特此约定。
约定的目的就是要求乙方在施工过程中尽职尽责,精心细致的做好预防八大安全隐患,保证在施工过程中无一安全事故发生。
2、工地内严禁酗酒及酒后上岗,如果在施工中发生意外安全事故乙方全权责,甲方有权取消合同且对乙方已完成施工量不予结算,并且乙方还需承担由于安全事故对甲方所造成的名誉损失。
所有施工工人进场后乙方必须为进场施工人员办理人身意外伤害保险,乙方对现场施工人员签订安全施工责任书。
3、进入施工现场的所有施工人员必须佩戴安全帽,要安全文明施工,如果乙方施工人员在施工中违规操作不重视安全生产,不听从甲方安全管理人
员的合理要求和安全事故责任交底,甲方书面通知3次以上在乙方施工过程中造成的人员伤残或死亡,所产生的一切费用由乙方承担。
4、乙方在分项施工中,每日工前应将当日产生的垃圾清理至指定地点作到“工完料清场地净”。
5、乙方对于工友如实完成上报工作(上报至项目安全主管),上报内容需包含工友姓名、籍贯、身份证号码、联系电话、预计入兰时间等信息;针对疫情爆发严重区域(如武汉,以国家发布疫情地图标示区域为准)的工友对其劝退。
对于外省工友在返岗前应当取得户籍所在地医院身体检查合格证明,且返岗后需在兰州定点医院再做进一步体检筛查,身体合格后才准予进入施工现场和办公生活区、在项目开工后此类人员同时进行重点关注,如不如实上报所造成的损失乙方全权负责。
第八条:保修
1、本工程保修期为一年,从竣工验收合格之日算起。
2、保修责任范围:凡属乙方施工质量原因造成的工程质量问题,
属乙方保修责任范围。
3、报修内容:合同条款所包含的工程项目、设计变更或修改、现场签证或
文字约定、双方或多方会议纪要约定的全部内容。
4、保修期内乙方应在接到甲方通知后两天内派员到场修理,乙方承担保修
范围内的费用,若乙方接到通知两天内派员到场修理,甲方有权另叫有同等施工资质单位检修,所发生费用由乙方承担。
第九条:违约责任
1、乙方须严格按有关施工规范组织施工,保质,保量按期完成该项工程,
属于施工质量造成返工、停工费用由乙方自负,赔偿由此引发的损失。
2、乙方必须如期交付工程确保使用,如乙方原因造成工程延误,每延误一天
每天罚款3000元。
第十条:争议
本合同履行过程中发生争议,双方应本着友好协商原则解决;如协商不成,可向有管辖权的人民法院起诉。
第十条:其他
1、本合同未尽事宜,双方可另行补充协议,与本合同具有同等法律效力。
2、本合同经双方盖章后生效,保修期满后自行失效。
3、本合同一式四份,甲方执叁份,乙方执壹份,均具有同等效力。
