社会团体业务名称核准 一、社会团体的概念 社会团体是指中国公民自愿组成，为实现会员共同意愿，按照其章程开展活动的非营利性社会组织。（会员制组织形式） 二、申请成立社会团体应当具备的条件 （一）有50个以上的个人会员或者30个以上的单位会员，个人会员和单位会员混合组成的，总数不少于50个（个人会员应具有中国国籍的公民，单位会员是除国家机关以外的独立的社会组织）（二）有规范的名称、章程和相应的组织机构 （三）有固定的住所（社会团体对其住所应有独立使用权，不得与其他机构合属办公，不得设置在私人寓所内。住所应相对稳定。）（四）有与其业务活动相适应的专职工作人员（专职工作人员主要是指专门从事社团工作，由社团以自有资金解决其工资、保险和福利待遇，没有其他正式工作的人员） （五）有合法的资产和经费来源，活动资金不低于3万元人民币（六）有独立承担民事责任的能力 三、社会团体名称的要求 1.申请成立社会团体，应当经其业务主管单位同意，由发起人向民政部门申请登记。社会团体的发起人应当不少于五人；单位作为发起人的，应当不少于三个；个人和单位共同作为发起人的，应当不少于五个。（发起人/单位应与社会团体行政一致） 2.社会团体的名称应当符合法律、法规的规定，不得违背社会道德风尚。社会团体的名称应当与其业务范围、成员分布、活动地域相一致，准确反映其特征。 3.社会团体名称的构成：行政区域的名称、业务范围的反映、社会团体性质的标识。（石家庄市****协会）
4.社会团体一般不以人名命名 5.社会团体的名称要符合社会主义精神文明的要求，要与我国的国情相适应，不得含有封建迷信、落后、不健康的习俗以及与我国现实国情不符的内容 6.组织形式为：协会、商会、学会、研究会、促进会、联合会。 7.业务范围符合规定，涉及其他职能部门职权的应有相关部门的授权文件。 四、禁止性条件 （一）有根据证明申请筹备的社会团体的宗旨、业务范围不符合条例第四条的规定的（第四条社会团体必须遵守宪法、法律、法规和国家政策，不得反对宪法确定的基本原则，不得危害国家的统一、安全和民族的团结，不得损害国家利益、社会公共利益以及其他组织和公民的合法权益，不得违背社会道德风尚。社会团体不得从事营利性经营活动）； 1.擅自冠以“中国”、“全国”、“中华”，甚至“亚洲”、“世界”等字样； 2.名称不得包含字号； 3.名称中的组织形式与组织类型不一致，如将社会团体登记为社会服务机构，将社会服务机构登记为基金会； 4.社会组织特别是其分支机构、代表机构名称使用不规范； 5.有根据证明申请筹备的社会团体的宗旨、业务范围不符合《社会团体登记管理条例》第四条的规定的； 6.在同一行政区域内已有业务范围相同或者相似的社会团体，没有必要成立的； 7.发起人、拟任负责人正在或者曾经受到剥夺政治权利的刑事处罚，或者不具有完全民事行为能力的； 8.在申请登记时弄虚作假的；

社会团体章程（草案）范式 说明 一、根据1998年10月25日国务院颁布的《社会团体登记管理条例》和国家有关政策制订此章程范式。 二、此章程范式，旨在为社会团体制订章程时提供依据，规范社会团体行为。 三、社会团体制订章程，原则上应包括此章程范式所涉及的内容，并可根据实际情况作适当的补充。 四、社会团体据此范式制订的章程，须报社团登记管理机关核准方能生效。社团登记管理机关将以核准后的章程为据进行监督管理。 第一章总则 第一条本团体的名称（包括英文译名、缩写）（社团的名称应当符合法律、法规的规定，不得违背社会道德风尚。社团的名称应当与其业务范围、成员分布、活动地域相一致，准确反映其特征。全国性的社会团体冠以“中国”、“全国”、“中华”等字样的，应当按照国家有关规定经过批准；地方性的社会团体应冠以本行政区域名称，不得冠以“中国”、“全国”、“中华”等字样。社会团体的名称，不得使用已由社团登记管理机关明令撤销或取缔的社会团体的名称）。 第二条本团体的性质（其中必须载明：组成的人员或

一、成立社团应具备的条件 成立社团，必须具备法人条件，即： （一）达到一定的规模 有50个以上的个人会员或者30个以上的单位会员；个人会员、单位会员混合组成的，会员总数不得少于50个。 （二）有规范的名称和相应的组织机构 规范的社团名称应由三方面构成： 1.行政区域的名称。全国性的社团，名称冠以“中国”、“全国”、“中华”等字样的，应当按照国家有关规定经过批准；地方性的社团的名称不得冠以“中国”、“全国”、“中华”等字样，而应冠以相应的行政区域名称。 2.业务范围的反映。业务范围是指社团开展业务活动的领域，社团名称应反映出社团的业务范围。 3.社团性质的标识。为有别于机关、企业、事业单位，社团一般称为协会、商会、基金会等。按照社团的分类，学术性社团一般称为协会、研究会；行业性社团一般称协会；专业性社团一般称协会、促进会，联合性社团一般称联合会、联谊会等。 社团命名时，应注意符合国家法律、法规的规定。凡我国现行的法律、法规禁止的内容，不能在社团名称中体现。同时，社团的名称要符合社会主义精神文明建设的要求，不得含有封建迷信、落后、不健康的习俗以及与我国现实国情不符的内容。不得使用易被认为是机关、企业事业单位的名称，新成立的社团也不能使用已被社团管理机关明令撤销或取缔的社团名称。 社团作为一个具有法人地位的社会组织，必须建立相应的组织机构。社团的组织机构，一般有最高权力机构、执行机构、其他机构，如办事机构、分支机构、代表机构等组成。 （三）有固定的住所 （四）有与其业务活动相适应的专职工作人员 （五）有合法的资产和经费来源
