(hereinafter called “the Employee”)
雇主希望雇员在其尼日利亚的工厂维修设备(主要是石材加工设备等)
The Employer try to employ the employee maintenance some equipment (the main equipment is stone processing machine etc.)
经友好协商, 现双方同意如下条文：
After friendly discussion, both party agree the following terms:
第一条:工作期限:
Article 1: working period
一年. 如双方满意, 合同期满前签订第二年的合同, 合同期限为12个月, 包括一个月的带薪休假.
One year. If both parties agreed, this contract could be extended for another one year with one month vacation and should be signed before the first year finished.
第二条:甲方的权利与义务:
Article 2: Party A’s rights and obligations:
1)雇主应按尼日利亚的有关规定办理雇员在尼日利亚的居留、工作许可证,签证,机票等
并承担其费用.
2)保障人员在尼日利亚的安全
3)雇主应为雇员免费提供适宜的住房,必要的设施及必要的家具.
1)The Employer shall undertake the employee’s residence and work permit , visa, and ticket to
Nigeria etc. in accordance with the relevant regulations of Nigeria at all the expenses.
2)Ensure the safety of the Employee while in Nigeria
3)The Employer shall provide the Employee free of charge with suitable house, with utilities
and proper furniture.
第三条:乙方的权利与义务:
Article 3: Party B’s rights and obligations:
1)2011年月日前办好因私护照.
2)遵守尼日利亚的法律和法令，尊重当地风俗习惯,
3)除非雇主同意, 雇员在执行本合同期间内外, 对于本工程的一切资料及情况应对第三
者保守秘密。
1)The Employee’s personal passport should be ready before Jun.30,2011.
2)Abide by the laws and regulations prevailing in Nigeria, and respect the local customs and
traditions
3)Employee shall keep confidential to any third party all documents and information related to
the Project during and after the execution of this CONTRACT, except permitted to reveal by the Employer.
第四条合同工资
Article 4 Contract Wages
1) 雇员的第一个月工资为RMB8,000.00,相当于美元:1,250.00 如工作得到雇主认可, 第
二个月开始, 月工资为RMB9,000.00, 相当于美元1,406.00(如汇率浮动, 以人民币为准). 在每月的最后一天国内支付.
2) 雇员的月生活费为奈拉:35,000.00, 在每月的第一天在尼日利亚支付.
1) For the first month, the salary is RMB8,000.00, same as USD1,250.00, if the employee’s work accepted by employer, from the second month , The monthly contract wages shall be based on RMB9,000.00 same as USD1,406.00(if the foreign exchange rate changed, should be based as RMB), shall be paid in the last day of each month, and paid in China.
2) The monthly food expensive for the employee shall be Naira:35,000.00, shall be paid in the first day of each month, and paid in Nigeria.
第五条不可抗力
Article 7 Force Majeure
如果由于自然灾害、战争、内乱、封锁、暴乱、疫病蔓延、政变等，致使本合同不能继续履行时，经协商后，本合同可以中止履行，雇主应负责人员的回程旅费。
The execution of this CONTRACT may be suspended after consultation between the parties if it can not be carried out further as a result of natural calamities ，war，internal commotion ，blockade ，insurrection，illness of epidemic nature，coup d'etat etc. Under such circumstances，the Employer shall bear the travel fares of the return Journey of the Employee.
第六条仲裁
Article. 8 Arbitration
在履行本合同中所发生的争议或与本合同有关的一切争议，应通过协商解决。如协商不能解决时，应提交仲裁。仲裁由中国国际经济贸易仲裁委员会进行。仲裁裁决是终局的，对双方有约束力。
All disputes arising from the execution of. or in connection with this CONTRACT shall be settled amicably through friendly consultation. In case no settlement can be reached through consultation，the case shall then be submitted for arbitration. The Arbitration shall be conducted the China international Economic and Trade Arbitration Commission. The arbitrate award is final and binding upon both parties.
第七条合同文字
Article 9 Language
本合同用中文和英文字写成。中、英文同样有效，双方各执一份。
This CONTRACT is in Chinese and English. Both Chinese and English shall have equal effect. Each party keeps one copy of the text.
