农村法治文化建设工程调研报告 建设社会主义新农村,推进城乡一体化,必须同步实施农村法治文化建设工程。法治 文化是一个国家或地区对于法律生活所持有的以价值观为核心的思维方式或行为方式,包 括人们的法治意识、法治观念、法治思想、法律价值取向等。法治文化是法治的灵魂和源泉,是法治社会的精神支柱和内在动力。要实现依法治国、建设社会主义法治国家的目标,建设和谐社会,离不开法治文化的支撑。只有在农村基层加强法治文化的建设,才能为社 会主义新农村建设提供有力的法治保障。 一、加强农村法治文化建设已成为当前的紧迫课题 法治文化是法治建设的根本内驱力。当前,在我国加强法治文化建设,不仅具有重大 的理论价值,更具有重大的现实意义。 三是实施了农村饮水安全工程。今年完成了XX年农村饮水安全工程总投资3223万元,现已完成57%的工程量;XX年农村饮水安全工程总投资为1549万元,该工程由于招投标工 作周期长,拖延了施工时间,导致项目开工迟,现只完成10%的工程量。 近年来,随着经济的发展,我乡文化建设在上级各部门和乡党委、政府的关心重视下,致力于统筹城乡协调发展,把加强农村基层文化建设放在了重要的位置,努力贯彻落实文 化艺术的“二为”方向和“双百”方针,文化建设进一步加强,文化活动进一步丰富,文 化市场不断繁荣,乡农村文化阵地建设和文化活动的开展在一定程度上取得了长足的发展。 为切实加强和改进街道社区党的建设,根据区委组织部的工作部署,结合办事处实际,我们组织人员对街道社区党建工作进行了深入调研。现将有关情况报告如下: (一)加强农村法治文化建设是建设社会主义法治国家的必然要求。党的十六大确立了 依法治国、建设社会主义法治国家的伟大战略目标。十多年来,我国在法治建设进程中取 得了巨大成就。但是,也毋庸讳言,在农村现实生活中仍存在大量与法治社会相悖的现象,侵害农民合法权益的事情还时有发生。究其原因是多方面的,但没有在全社会建立起深入 人心的法治文化,则是最深层的、最根本的原因。可以说,离开了法治文化,一个国家的 法治建设就成了无源之水、无本之木。我国是一个农业大国,13亿人民有9亿生活在农村,要加快依法治国进程,推进农村基层民主法治,加强农村法治文化建设已成为当务之急。 (二)加强农村法治文化建设是基于扬弃中国传统法律文化的现实需要。 产生于小农经济基础上的中国传统法律文化,从根本上来说是“人治”文化,是与现 代法治观念相悖的。中国传统法律文化的主要特点是:重礼轻法,重德轻刑;“人治”高 于“法治”;重刑轻民,重义务,轻权利等等。这些传统法律思想直到今天仍然具有强大 的影响力,仍然在阻碍着我国法治的现代化进程,特别对农村基层民主法治建设产生着阻 碍作用。要消除传统法律文化的不良影响,就必须对中国传统法律文化进行扬弃,并借鉴 国外现代法治经验和整个人类文明成果,努力建设有中国特色的农村法治文化。

当前农村法治建设的调查报告 当前农村法治建设的调查报告 当前农村法治建设的调查报告 一、我乡农村当前法治工作的现状 1、对农村法治工作的重要性认识存在偏差。 随着改革的不断深入,农民群众越来越看重物质利益和经济效益,并以钱作为看问题、办事情、论实绩的标准,因此,农民对依法办事及农村法治工作的认识大大减少,而村民委员会借口抓经济工作是硬指标,对农村法治工作采取消极应付的态度,认为组织农民学法是增加农民负担,而且农村中的老人因年纪大且没文化,对法律法治搞不懂、听不进、没法用。作为村民委员会,忽视了农村法治工作对以法治村及提高广大农民法律意识的重要作用。 2、农村法治工作三无现象依然存在。 所谓三无是指农村无专职依法治理工作队伍、无专门的工作手段、无专项活动经费,农村法治基本流于形式,大多数村普遍存在简单、陈旧的宣传手段和形式,在一定程度上影响了农村法治工作的深入开展。 3、农村法治存在的难点。 一是集中村民学习难。主要是居住分散,外出务工人员多,在家大多是不识字的老人,在时间、地点上无法统一,若分小组分散学习、人员太少,所以很难集中组织学习。

二是农村中法治骨干难找。农村的村社干部文化水平低,对他们的法律培训又少,他们所掌握的法律知识不多,让他们给村社讲解法治,也只能念念法律条款,所以学习法律的效果不明显。 三是难抓到点子。村民整体文化素质较低,学法基本上处于被动,大多数村民只有遇到纠纷才去了解法律。 四是认同度不高。一些村民认为,在农村抓法治是搞形式,导致权大法的认识存在,个别村民遇到涉法问题时,习惯于求助家族势力,找关系,托熟人解决,这些现象的存在影响了村民学法的积极性。 4、农村依法治理基本保障有待及时落实,依法治理力度不强。 目前,我乡没有司法助理员,有阵地无人员的现象长期存在,给开展依法治理工作造成不便。 二、我乡农村法治工作难开展的原因 1、法治观念上重视不够,认识不清。一是村民法纪观念淡薄,工作难以开展,上面只停留在口头上,行动上不重视,村里干部不会主动搞,个别村干部认为村民越懂法,工作越被动,因此对依法治理工作应付了事。 2、对法治工作责任不明确。区、乡的依法治理工作机构健全,但到了村一级就无人接招,农村依法治理工作就成了无人管事的工作,责任不明确的现象较为突出。 3、开展法治工作力度不大,措施不硬。首先,上级缺乏对农村依法治理工作的分析研究,形式过多,活动开展较少,未达到应有的效果。 三、我乡农村法治工作的对策
