Chapter1. The Contract in according to following documents:

1.3省市相关规定和本工程的实际情况。
Provincial and municipal regulations and the actual situation of the project.
第二章设计咨询范围及内容Scope of design consultation and content
乙方设计咨询范围Scope of design consultation for Party B
本次设计景观总面积约为平方米。甲方同意委托乙方承担其景观设计咨询工作。
The total area of the landscape design is square meters. Party A agrees to entrust Party B for the consultative and design work.
本合同包括的工作阶段：景观的方案设计、扩初设计、施工图设计。
The work stage of this contract include: project design of landscape, preliminary design, construction drawing design
第三章甲方需向乙方提交的相关资料、文件及时间
The related data, document and time that Party A should submit to Party B
甲方在规定的时间内向乙方提交基础资料及文件，并对其完整性、正确性、及时性负责。
Party A shall submit the basic data and document on time, and responsible for its integrity, correct and timeliness
3.1 甲方应于方案设计开始前提交的相关资料

4.1第一阶段：方案设计First phase：Scheme design

b景观方案总平面图；Floor plan of the overall landscape scheme
c分析图（包含景区分布、功能布置、空间及场所分析、交通分析）；
Analysis (includes scenic layout, space distribution, function and place analysis, traffic analysis)；
d主要区域景观方案放大设计图；Enlarge chart of the main regional landscape plan designed
e主要景点效果图；Impression drawing of major attractions；
f园林小品示意图；Gardens sketch diagram
g景观设计示意图；Landscape design diagram
h其他彩色图片；Other color pictures
I提交A3图册六份；Deliver six atlas of A3 size
j汇报方式为草案汇报和电脑汇报。Report method shall be draft report and computer report

4.2第二阶段：扩初设计The second phase: Preliminary design
4.2.1 按甲方同意的方案进行扩初设计。
Designed according to Party A agreed scheme for preliminary design.
4.2.2此阶段的设计成果有This stage of design work result include
a景观初设总平面图；Preliminary landscape set general layout
b局部放大平面图、剖面图；Local enlargement of the plan, section plan；
c园林小品平、立、剖面图；Gardens sketch layout, elevation and section plan
d种植图(主要树种及载植方式)；
The planting layout (Main tree species and cultivated methods)
e竖向图；Vertical plan；
f局部景观立面图及剖面图；Partial landscape elevations and section plan
g灯具及栏杆式样；Lamps and railing style
h提交A3图册三份。Deliver three atlas of A3 size
4.2.3此阶段用时工作日。This stage takes workdays
4.3第三阶段：施工图设计The third phase ：Construction drawing design
4.3.1 在扩初设计经甲方认可后，乙方将进行施工图的设计工作。
After the design of preliminary design approved by Party A, Party B will start the construction drawing design.
4.3.2 此阶段设计成果有：This stage of design work result include：
a总平面图；. General layout
b局部放大平面图；Local enlargement of the floor plan；
c放线图；Line figure
d种植图；. Plant figure
e铺装图；Install figure
f竖向图；Vertical plan；
g 环境配电图；Surrounding power distribution chart ；
h 环境给、排水图；Surrounding water supply and drainage
i设计说明、各种详图、植物名录；Design instruction, the detailed map, plants list
j提供8套施工图纸。Deliver eight sets design drawing
4.3.3此阶段用时工作日。This stage takes workdays
4.4现场服务阶段The site service stage
4.4.1在项目进入施工阶段后，乙方提供现场服务。
After commencing the construction phase of the project, Party B provide on-site service.
4.4.2此阶段成果有：This stage of design work result include：
a与施工方现场交底；communicate with construction contractor for the design intention.
b现场效果控制；Jobsite construction control
c材料封样；Sealed sample materials
d 植物主材选定。Plants selected
4.4.3 此阶段用时工作日。This stage takes workdays
第五章设计费及支付方式Design fee and the payment method
5.1 本合同项目的设计费，总额为人民币，小写元整。（按景观面积平方米，单价元/平方米），
The total project design fee of this contract is, RMB, ￥ . ( square meters of total landscape area, price: /square meter)
5.2 乙方基本服务费用根据不同阶段分列如下：
Party B basic service fees according to the different stages are as follows:
5.2.1 方案设计阶段：提交成果后个工作日内，委托方应支付设计费人民币：元整，小写元（合同金额的%）。：

5.2.2 方案扩初阶段：提交成果后个工作日内，委托方支付设计费人民币元整，小写元（合同金额的%）。：

5.2.3 施工图阶段：提交成果后个工作日内，委托方支付设计费人民币

5.2.4 施工期间现场配合阶段：景观工程竣工验收后个工作日，委托方支付费用为人民币元整，小写元（合同金额的%）。
Jobsite cooperating phase: the client shall pay RMB of design fee, ￥: ( % of contract total amount) within business day after the landscape construction completed and pass the acceptance examine:
5.3 其它：Others
甲方需委派一位人员，就此工程设计方向的事宜上，负责批复乙方的设计。如甲方要求乙方对已同意的设计提供重大修改，或进行合同之外的设计工作，应被视为额外服务项目，收费应由甲乙双方共同协定。
Pa rty A shall appoint a staff to in charge of Party B’s engineering design approval. If Party A request Party B to be make major adjustment on the design approved by Party A, or work on the design out of this contract scope, should be considered an additional service, fees should be design by mutual agreement of both parties.
第六章双方责任Chapter6 Responsibilities of parties
6.1 甲方责任Responsibilities of Party A
6.1.1 甲方按本合同协定提交的内容，在协定的时间内向乙方提交资料及文件，并对其完整性、正确性及时限负责。另外，甲方还应提供关于场地条件的数据，包括公用事业、地理条件、道路使用权、限制条件等。
Party A shall submit the data and documents content in according to this contract stipulated, in agreed time limit, and be responsible for its integrity, correctness and time limit. In addition, Party A shall also provide the data about the conditions at the jobsite, including utilities, geographical conditions, road use right, constraints, etc. 6.1.2 甲方提交上述资料及文件超过规定期限15天以内，乙方按合同规定交
付设计文件时间顺延；期限超过15天以上时，乙方有权重新确定提交设计文件时间。
Party A delay to submitted the data and documents referred above in excess of the prescribed period within 15 days, Party B postpone deliver the design documents in according to the contract stipulation time. If the delay time more than 15 days, Party B has the right to determine a new submitted time for the design documents
6.1.3 甲方变更委托设计项目、规模、条件或因提交的资料错误，或所提资料作较大修改，以致造成乙方设计需返工时，双方除需另行协商签订补充合同（或另订合同）、重新明确有关条款外，甲方应按乙方所耗工作量向乙方支付返工费。
Party B design reworked causes by Party A change design projects, scale, conditions or because of the presented material mistakes, or mentioned material major revision. Both parties shall sign a supplementary agreement (or sign a new agreement) and redefine relevant terms, Party A shall pay associated rework fee to Party B in according to the workload.
6.1.4 在合同履行期间，甲方要求终止或解除合同，乙方未开始设计工作的，不退还甲方已付的定金；已开始设计工作的，甲方根据乙方已进行的实际工作量，另行议定。
