浅谈建设工程合同管理的重要性

摘要

论述建设工程合同管理的概念。建筑工程合同是维系市场运转的载体。建设工程合同是承发包双方为实现建设工程目标,明确相互责任、权利、义务关系的协议,是承包人进行工程建设并获取合理利润的源泉,同样也是发包人支付价款,控制工程项目质量、进度、投资,进而保证工程建设活动顺利进行的重要法律文件。从而明确加强合同管理的意义。即加强合同管理是保证承发包人全面履行合同约定的义务,是确保实现建设目标(质量、投资、工期)的重要手段。

本论文对建设工程合同管理等概念进行了解释,就合同管理的特点和目前我国建设工程合同管理的现状,并列举出存在的主要问题,如中海外承担波兰公路项目,深圳山体滑坡事故。通过合同管理的特点、现状、存在的主要问题来阐述加强建设工程合同管理的意义、地位及作用。

Discuss the importance of the construction project contract management

【Abstract】

This article discusses the concept of contract for construction project management .The carrier of construction project contract is to maintain the market operation.Contract for construction project was contracting parties for the realization of the construction project goals,Defining the responsibilities, rights and obligations relations agreement, whereby the contractor performs project construction and obtain reasonable profit source, is also the developer shall pay the price,Control project quality, progress, investment, and guarantee the engineering construction activities smoothly important legal documents,To clarify the significance of strengthening contract management. As strengthening contract management is to ensure that the contracting people fully fulfill their contractual obligations, is to ensure that the construction goals (quality, investment and time limit for a project).

In this paper for the interpretation of the contract for construction project management concept, the characteristics of contract management and the present

situation of the construction project contract management in our country at present, citing the main problems, such as overseas undertaking highway project in Poland, the landslide accident in shenzhen. Through the characteristics of contract management, the present situation, the main problems of the significance to strengthen the management of contract for construction project is to, status and role.

建设工程合同及合同管理的概念

合同又称契约,合同的概念有广义和狭义之分。广义的合同泛指发生一定权利义务关系的协议;狭义的合同专指双方或多方当事人关于设立、变更、终止民事法律关系的协议。

建设工程合同是指在工程建设过程中发包人与承包人依法订立的、明确双方权利义务关系的协议。在建设工程合同中,承包人的主要义务是进行工程建设,权利是得到工程价款;发包人的主要义务是支付工程价款,权利是得到完整、符合约定的建筑产品。

施工合同是指承包方完成工程建筑安装工作,发包方验收后接受该工程并支付价款的合同。施工合同主要包括建筑和安装两方面内容。其中,建筑是指对建筑物、构筑物进行营造的行为,安装主要是指与建筑物、构筑物有关的线路、管道、设备等设施的装配。

合同管理就是对合同的编制、签订、履行、变更、转让、解除、终止以及计划、评审、监督、控制、协调等一些系列行为的总称。其中编制、签订、履行、变更、转让、解除、终止等是合同管的内容;计划、评审、监督、控制、协调等是合同管理的手段。合同管理是项目管理的重要内容,也是项目管理中其他活动的基础和前提。

建设工程合同根据承包的内容不同,可分为建设工程勘察合同、建设工程设计合同与建设工程施工合同。根据合同联系结构不同,可分为总承包合同与分别承包合同,还可分为总包合同与分包合同。
