网络领域的违法犯罪现象也已成为现代社会难以拒绝的“不速之客”。

如今，传播计算机病毒、剽窃资料库机密、网上恐怖活动、网上盗窃、传播色情等日益猖蹶，鉴于计算机网络犯罪已经严重威胁因特网的生存与发展，对网络犯罪的规制、打击和预防已成为现代社会、国家和政府的重大课题。

要有效地防治网络犯罪，在预防方面，必须坚持以预防为主，打防结合，标本兼治的综合防范体系；在社会对策方面，既要加强“三位一体”的社会教育，又要加强网络自身的管理和安全；在刑事对策方面，既要加强刑事立法方面的建设，又要加强刑事司法方面的建设。

有鉴于此，本文着力对网络犯罪的概念、特征、现状、危害等方面从刑法规制的角度进行了初步的分析与探讨，并提出一些防范措施，进而更好地对网络犯罪进行预防和规制。
