This revision dated August 2006 changed the provision in ITA 18.1, Late Applications, and added a corresponding entry in the PDS, to offer the Employer the option to choose between two alternate treatments for applications received past the deadline for submission of applications.

Foreword

This Standard Procurement Document ―Prequalification Document for Procurement of Works and User’s Guide‖ has been prepared by the World Bank and is based on the Master Procureme nt Document ―Prequalification Document for Procurement of Works and User’s Guide‖ prepared by the Multilateral Development Banks and International Financing Institutions. This document reflects the majority view of these institutions and is to be used when a prequalification process takes place prior to the bidding process for procurement of works through International Competitive Bidding (ICB) in projects that are financed in whole or in part by the World Bank.

This document is organized into two (2) main components:

?The Prequalification Document for Procurement of Works; and

? A User’s Guide for the Prequalification Document for Procurement of Works.

This Standard Procurement Document (SPD) consists of the Prequalification Procedures for Procurement of Works‖ and it’s ―User’s Guide‖. A brief description of this document is given below.

PART 1 – PREQUALIFICATION PROCEDURES

Section I. Instructions to Applicants (ITA)

This Section specifies the procedures to be followed by Applicants in the preparation

and submission of their Applications for Prequalification (AFPs). Information is also

provided on opening and evaluation of AFPs. Section I contains provisions that are

to be used without modification.

Section II. Prequalification Data Sheet (PDS)

This Section consists of provisions that are specific to each prequalification and

supplement the information or requirements included in Section I, Instructions to

Applicants.

Section III. Qualification Criteria and Requirements

This Section contains the methods, criteria, and requirements to be used to determine

how Applicants shall be prequalified and later invited to bid.

Section IV. Application Forms

This Section contains the forms for the Application Submission Form and all the

forms required to be submitted with the Application.

Section V. Eligible Countries

This Section states the country eligibility policy of the Bank, and provides lists of

ineligible countries

and recommendations to Employers on how to prepare a Prequalification Document

for a specific procurement of Works and evaluate applications. The Guide is not a part

of the Prequalification Document.

This Prequalification Document (an update of the September 1999 document) for Procurement of Works (PQD) has been prepared by the World Bank’s Procurement Policy and Services Group and is based on the Standard Procurement Document ―Prequalification Document for Procurement of Works‖ issued by the World Bank, dated September 1999, revised March 2000. This PQD reflects the structure and the provisions of the Master Procurement Document ―Prequalification Document for Procurement of Works‖ issued by the Multilateral Development Banks and International Financial Institutions, except where specific considerations of the procurement policies of the World Bank have required a change. This PQD incorporates the new features of the May 2004 Procurement Guidelines.

Section I. Instructions to Applicants

A. General

1. Scope of

Application 1.1 In connection with the Invitation for Prequalification indicated in

Section II, Prequalification Data Sheet (PDS), the Employer, as defined in the PDS, issues this Prequalification Document (PQD) to applicants interested in bidding for the works described in Section VI, Scope of Works. The number of contracts and the name and identification of each contract, and the International Competitive Bidding (ICB) number corresponding to this prequalification, are provided in the PDS.

2. Source of

Funds 2.1 The Borrower or Recipient (hereinafter called ―Borrower‖) indicated in

the PDS has applied for or received financing (hereinafter called ―funds‖) from the International Bank for Reconstruction and Development or the International Development Association (hereinafter called ―the Bank‖) towards the cost of the project named in the PDS. The Borrower intends to apply a portion of the funds to eligible payments under the contract(s) resulting from the bidding for which this prequalification is conducted.

3. Fraud and

Corruption 3.1 It is the Bank’s policy to require that Borrowers (including

beneficiaries of Bank loans), as well as bidders, suppliers, and contractors and their subcontractors under Bank-financed contracts, observe the highest standard of ethics during the procurement and execution of such contracts.1 In pursuance of this policy, the Bank:

(a) defines, for the purposes of this provision, the terms set forth

below as follows:

(i) ―corrupt practice‖2 is the offering, giving, receiving or

soliciting, directly or indirectly, of anything of value to

influence improperly the actions of another party;

(ii) ―fraudulent practice‖3 is any act or omission, including a misrepresentation, that knowingly or recklessly misleads,

or attempts to mislead, a party to obtain a financial or other

benefit or to avoid an obligation;

(iii) ―collusive practice‖4 is an arrangement between two or more

2―another party‖ refers to a public official acting in relation to the procurement process or contract execution]. In this context, ―public official‖ includes World Bank staff and employees of other organizations taking or reviewing procurement decisions.

3 a ―party‖ refers to a public official; the terms ―benefit‖ and ―obligation‖ relate to the procurement process or contract execution; and the ―act or omission‖ is intended t o influence the procurement process or contract execution. 4―parties‖ refers to participants in the procurement process (including public officials) attempting to establish bid

parties designed to achieve an improper purpose, including to

influence improperly the actions of another party;

(iv) ―coercive practice‖5 is impairing or harming, or threatening

to impair or harm, directly or indirectly, any party or the

property of the party to influence improperly the actions of

a party;

(v) "obstructive practice" is

(aa) deliberately destroying, falsifying, altering or

concealing of evidence material to the investigation

or making false statements to investigators in order to

materially impede a Bank investigation into

allegations of a corrupt, fraudulent, coercive or

collusive practice; and/or threatening, harassing or

intimidating any party to prevent it from disclosing its

knowledge of matters relevant to the investigation or

from pursuing the investigation; or

(bb) acts intended to materially impede the exercise of the

Bank’s inspection and audit rights provided for under

sub-clause 3.1 (e) below.

(b) will reject a proposal for award if it determines that the bidder

recommended for award has, directly or through an agent,

engaged in corrupt, fraudulent, collusive, coercive or obstructive

practices in competing for the contract in question;

(c) will cancel the portion of the loan allocated to a contract if it

determines at any time that representatives of the Borrower or of

a beneficiary of the loan engaged in corrupt, fraudulent,

collusive, or coercive practices during the procurement or the

execution of that contract, without the Borrower having taken

timely and appropriate action satisfactory to the Bank to address

such practices when they occur;

(d) will sanction a firm or individual, including declaring ineligible,

either indefinitely or for a stated period of time, to be awarded a

Bank-financed contract if it at any time determines that the firm

has, directly or through an agent, engaged in corrupt, fraudulent,

collusive, coercive or obstructive practices in competing for, or

in executing, a Bank-financed contract; and

(e) will have the right to require that a provision be included in

bidding documents and in contracts financed by a Bank loan,

requiring bidders, suppliers, and contractors and their

sub-contractors to permit the Bank to inspect their accounts and

prices at artificial, non competitive levels.

records and other documents relating to the bid submission and contract performance and to have them audited by auditors appointed by the Bank.

4. Eligible

Applicants 4.1 An Applicant shall be a private, public or government owned legal entity,

subject to ITA 4.8, or any combination of them in the form of association(s) including Joint Venture (JV) with the formal intent, as evidenced by a letter of intent), to enter into an agreement or under an existing agreement. In the case of a JV, unless otherwise specified in the PDS, (i) all parties shall be jointly and severally liable, and (ii) there shall be no limit on the number of partners.

4.2 The eligibility criteria listed in this Clause 4 shall apply to the

Applicant, including the parties constituting the Applicant, i.e., its proposed partners, subcontractors or suppliers for any part of the Contract including related services.

4.3 An Applicant may have the nationality of any country, subject to the

restrictions pursuant to sub clause 4.11. An Applicant shall be deemed to have the nationality of a country if the Applicant is a citizen, or is constituted, incorporated or registered and operates in conformity with the provisions of the laws of that country, as evidenced by its Articles of Incorporation or Documents of Constitution, and its Registration Documents.

4.4 Applicants and all parties constituting the Applicant shall not have a

conflict of interest. Applicants shall be considered to have a conflict of interest, if they participated as a consultant in the preparation of the design or technical specifications of the Works that are the subject of this prequalification. Where a firm, or a firm from the same economic or financial group, in addition to consulting, also has the capability to manufacture or supply goods or to construct works, that firm, or a firm from the same economic or financial group, cannot normally be a supplier of goods or works, if it provided consulting services for the contract corresponding to this prequalification, unless it can be demonstrated that there is not a significant degree of common ownership, influence or control.

4.5 An Applicant shall submit only one application in the same

Prequalification process, either individually as an Applicant or as a partner of a joint venture. No Applicant can be a subcontractor while submitting an application individually or as a partner of a joint venture in the same Prequalification process. A Subcontractor in any application may participate in more than one application, but only in that capacity.

An Applicant who submits, or participates in, more than one application will cause all the applications in which the Applicant has participated to

be disqualified.

4.6 A firm that has been determined to be ineligible by the Bank in

relation to the Bank Guidelines On Preventing and Combating Fraud and Corruption in Projects Financed by IBRD Loans and IDA Credits and Grants shall be not be eligible to be awarded a contract.

4.7 An Applicant that is under a declaration of ineligibility by the Bank in

accordance with ITA 3, at the date of submission of the application or thereafter, shall be disqualified. The Bank maintains a list of firms and individuals that have been sanctioned by the Bank pursuant to Sub-Clause

3.1 (c) and are not eligible to participate in procurement financed by the

Bank. The list is regularly updated; its address is specified in the PDS. 4.8 Government-owned entities in the Employer’s Country shall be eligible

only if they can establish that they are legally and financially autonomous, and operate under commercial law, and that they are not dependent agencies of the Employer.

4.9 Applicants shall not be under execution of a Bid–Securing Declaration in

the Employer’s Country.

4.10 Applicants and all parties constituting the Applicant shall provide such

evidence of their continued eligibility satisfactory to the Employer, as the Employer shall reasonably request.

4.11 Applicants from an eligible country may be excluded if, (a) as a matter

of law or official regulations the Borrower’s country prohibits commercial relations with that country, provided that the Bank is satisfied that such exclusion does not preclude effective competition for the supply of goods or the contracting of works required; or (b) by an act of compliance with a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations, the Borrower’s country prohibits any import of goods or contracting of works or services from that country, or any payments to persons or entities in that country. Section VI, Eligible countries provide lists of ineligible countries pursuant to this Sub Clause 4.11.

5. Eligible Goods

and Related

Services 5.1 All goods and related services to be supplied under the Contract to be

financed by the Bank shall have as their origin in any country in accordance with Section V, Eligible Countries.

B. Contents of the Prequalification Document

6. Sections of

Prequalifica-

tion Document 6.1 The document for the prequalification of Applicants (hereinafter -

―prequalification document‖) consists of parts 1 and 2 which comprise all the sections indicated below, and should be read in conjunction with

any Addendum issued in accordance with ITA 8.

6.2 The ―Invitation for Prequalification Applications‖ issued by the

Employer is not part of the prequalification document. A sample form is provided as an attachment to this Prequalification Document for information only.

6.3 The Employer accepts no responsibility for the completeness of the

prequalification document and its addenda unless they were obtained directly from the Employer.

6.4 The Applicant is expected to examine all instructions, forms, and terms in

the Prequalification Document and to furnish all information or documentation required by the Prequalification Document.

7. Clarification

of Prequali-

fication

Document 7.1 A prospective Applicant requiring any clarification of the

Prequalification Document shall contact the Employer in writing at the Employer’s address indicated in the PDS. The Employer will respond in writing to any request for clarification provided that such request is received no later than fourteen (14) days prior to the deadline for submission of applications. The Employer shall forward copies of its response to all applicants who have acquired the prequalification document directly from the Employer including a description of the inquiry but without identifying its source. Should the Employer deem it necessary to amend the prequalification document as a result of a clarification, it shall do so following the procedure under ITA 8 and in accordance with the provisions of ITA 17.2.

8. Amendment of

Prequalifica-

tion Document 8.1 At any time prior to the deadline for submission of applications, the

Employer may amend the Prequalification Document by issuing addenda.

8.2 Any addendum issued shall be part of the Prequalification Document

and shall be communicated in writing to all who have obtained the prequalification document from the Employer.

8.3 To give prospective Applicants reasonable time to take an addendum

into account in preparing their applications, the Employer may, at its discretion, extend the deadline for the submission of applications.

C. Preparation of Applications

9. Cost of

Applications 9.1 The Applicant shall bear all costs associated with the preparation and

submission of its application. The Employer will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the prequalification process.

10. L anguage of

Application 10.1 The application as well as all correspondence and documents relating to

the prequalification exchanged by the Applicant and the Employer, shall be written in the language specified in the PDS. Supporting documents and printed literature that are part of the application may be in another language, provided they are accompanied by an accurate translation of the relevant passages in the language specified in the PDS, in which case, for purposes of interpretation of the application, the translation shall govern.

11. D ocuments

Comprising

the

Application 11.1 The application shall comprise the following:

(a) Application Submission Form, in accordance with ITA 12;

(b) documentary evidence establishing the Applicant’s eligibility to

prequalify, in accordance with ITA 13;

(c) documentary evidence establishing the Applicant’s

qualifications, in accordance with ITA 14; and

(d) any other document required as specified in the PDS.

12. Application

Submission

Form 12.1 The Applicant shall prepare an Application Submission Sheet using the

form furnished in Section IV, Application Forms. This Form must be completed without any alteration to its format.

13. Documents

Establishing

the Eligibility

of the

Applicant 13.1 To establish its eligibility in accordance with ITA 4, the Applicant shall

complete the eligibility declarations in the Application Submission Form and Forms ELI (eligibility) 1.1 and 1.2, included in Section IV, Application Forms.

14. Documents

Establishing

the

Qualifications

of the

Applicant 14.1 To establish its qualifications to perform the contract(s) in accordance

with Section III, Qualification Criteria and Requirements, the Applicant shall provide the information requested in the corresponding Information Sheets included in Section IV, Application Forms.

15. Signing of the

Application

and Number

of Copies 15.1 The Applicant shall prepare one original of the documents comprising

the application as described in ITA 11 and clearly mark it ―ORIGINAL‖. The original of the application shall be typed or written in indelible ink and shall be signed by a person duly authorized to sign on behalf of the Applicant.

15.2 The Applicant shall submit copies of the signed original application, in

the number specified in the PDS, and clearly mark them ―COPY‖. In the event of any discrepancy between the original and the copies, the original shall prevail

D. Submission of Applications

16. Sealing and

Identification

of

Applications 16.1 The Applicant shall enclose the original and the copies of the application in

a sealed envelope that shall:

(a) bear the name and address of the Applicant;

(b) be addressed to the Employer, in accordance with ITA 17.1; and

(c) bear the specific identification of this prequalification process

indicated in the PDS 1.1.

16.2 The Employer will accept no responsibility for not processing any

envelope that was not identified as required.

17. Deadline for

Submission of

Applications 17.1 Applicants may always submit their applications by mail or by hand.

When so specified in the PDS, applicants shall have the option of submitting their applications electronically, in accordance with electronic application submission procedures specified in the PDS.

Applications shall be received by the Employer at the address and no later than the deadline indicated in the PDS. A receipt will be given for all applications submitted.

17.2 The Employer may, at its discretion, extend the deadline for the

submission of applications by amending the Prequalification Document in accordance with ITA 8, in which case all rights and obligations of the Employer and the Applicants subject to the previous deadline shall thereafter be subject to the deadline as extended.

18. Late

Applications 18.1 Any application received by the Employer after the deadline for submission

of applications prescribed in accordance with ITA 17 will be treated as indicated in the PDS.

19. Opening of

Applications 19.1 Any specific electronic application opening procedures required if

electronic submission of applications is permitted pursuant to Sub Clause 17.1 shall be as specified in the PDS. Employer shall prepare a record of the opening of applications that shall include, as a minimum, the

name of the Applicant. A copy of the record shall be distributed to all Applicants.

E. Procedures for Evaluation of Applications

20. Confidential-

ity 20.1 Information relating to the evaluation of applications, and

recommendation for prequalification, shall not be disclosed to Applicants or any other persons not officially concerned with such process until the notification of prequalification is made to all Applicants.

20.2 From the deadline for submission of applications to the time of

notification of the results of the prequalification in accordance with ITA 28, any Applicant that wishes to contact the Employer on any matter related to the prequalification process, may do so but only in writing.

21. Clarification

of

Applications 21.1 To assist in the evaluation of applications, the Employer may, at its

discretion, ask any Applicant for a clarification of its application which shall be submitted within a stated reasonable period of time. Any request for clarification and all clarifications shall be in writing.

21.2 If an Applicant does not provide clarifications of the information

requested by the date and time set in the Employer’s request for clarification, its application may be rejected.

22. Responsive-

ness of

Applications 22.1 The Employer may reject any application which is not responsive to the

requirements of the prequalification document.

23. Domestic

Bidder Price

Preference 23.1 Unless otherwise specified in the PDS, a margin of preference for

domestic bidders shall not apply in the bidding process resulting from this prequalification.

24. Subcontrac-

tors 24.1 Applicants planning to subcontract any of the key activities indicated in

Section III, Qualification Criteria, shall specify the activity(ies) or parts of the works to be subcontracted in the Application Submission Form.

Applicants shall clearly identify the proposed specialist subcontractors in Forms ELI-1.2 and EXP (experience)-4.2(b) in Section IV. Such proposed specialist subcontractor(s) shall meet the corresponding qualification requirements specified in Section III, Qualification Criteria and Requirements.

24.2 At this time, the Employer does not intend to execute certain specific

parts of the Works by subcontractors selected in advance by the Employer (Nominated Subcontractors) unless otherwise stated in the PDS.

F. Evaluation of Applications and Prequalification of

Applicants

25. Evaluation of

Applications 25.1 The Employer shall use the factors, methods, criteria, and requirements

defined in Section III, Qualification Criteria and Requirements to evaluate the qualifications of the Applicants. The use of other methods, criteria, or requirements shall not be permitted. The Employer reserves the right to waive minor deviations in the qualification criteria if they do not materially affect the capability of an Applicant to perform the contract.

25.2 Only the qualifications of subcontractors that have been identified in the

application may be considered in the evaluation of an Applicant.

However, the general experience and financial resources of subcontractors may not be added to those of the Applicant for purposes of prequalification of the Applicant.

25.3 In case of multiple contracts, the Employer shall prequalify each

Applicant for the maximum number and types of contracts for which the Applicant meets the appropriate aggregate requirements of such contracts, as specified in Section III, Qualification Criteria and Requirements.

26. Employer’s

Right to

Accept or

Reject

Applications 26.1 The Employer reserves the right to accept or reject any application, and

to annul the prequalification process and reject all applications at any time, without thereby incurring any liability to Applicants.

27. Prequalifica-

tion of

Applicants 27.1 All Applicants whose applications have met or exceeded (―passed‖) the

specified threshold requirements will, to the exclusion of all others, be prequalified by the Employer.

28. Notification of

Prequalifica-

tion 28.1 Once the Employer has completed the evaluation of the applications it

shall notify all Applicants in writing of the names of those applicants who have been prequalified.

29. Invitation to

Bid 29.1 Promptly after the notification of the results of the prequalification the

Employer shall invite bids from all the Applicants that have been prequalified.

29.2 Bidders may be required to provide a Bid Security or a Bid Securing

Declaration acceptable to the Employer in the form and an amount to be specified in the Bidding Documents, and the successful Bidder shall be required to provide a Performance Security to be specified in the Bidding Documents.

30. Changes in

Qualifications

of Applicants 30.1 Any change in the structure or formation of an Applicant after being

prequalified in accordance with ITA 27 and invited to bid shall be subject to a written approval of the Employer prior to the deadline for submission of bids. Such approval shall be denied if as a consequence of the change the Applicant no longer substantially meets the qualification criteria set forth in Section III, Qualification Criteria and Requirements, or if in the opinion of the Employer, a substantial reduction in competition may result. 第一篇资格预审须知 铅山县紫溪至桐木关公路石垅至西坑段路面工程项目已列入上饶市交通局通达工程计划。该项目资金来源为:省、市交通部门补助及地方政府自筹。 1.投标范围 铅山县紫溪至桐木关公路石垅至西坑段路面工程项目经上级批准,采用国内公开竞争性招标方式选择施工单位。 铅山县交通局受铅山县黄岗山人民政府(以下简称“业主”)委托,负责本项目工程的资格预审和招标工作,现邀请有能力的合格施工单位就本项目的投标进行资格预审。 招标单位将就资格预审邀请书中“资格预审申请文件格式”中的内容对申请人进行资格预审,申请人可对该项目提出资格预审申请。 本次资格预审将面向具有公路工程施工总承包三级以上(含三级)的施工单位。 关于本工程的基本情况,如项目所在地的气候、水文、地形、现场道路、交通与通讯设备、项目路线、预计工期、以及业主提供的设施和服务及其他有关数据见附件1。 2.申请书的递交 资格预审申请文件必须经密封后,在2004年 8月10日上午9时(北京时间)前送至铅山县交通局四楼公路站。申请书封皮上要清楚地注明“铅山县紫溪至桐木关公路石垅至西坑段路面工程资格预审申请文件”字样。对迟交的申请文件招标单位将拒绝接收。 资格预审申请书封皮上还应清楚地注明申请人的名称、地址和联系电话。 资格预审申请文件正本一份,副本五份,正式语言为汉语。

申请人必须递交与其资格审查有关的关键资料,并及时提交招标人对所递交资料要求澄清或补充的材料,以便招标单位做出正确的评定。如果申请单位是由下属施工单位或专业公司投入本工程,则所填写的资格预审申报资料,除有申请单位本身外,还应重点填报实际投入本工程的施工单位的有关资料。申请文件中没有证据支持的业绩和其他资格水平不作为评审的基础。对在资格预审文件中提供虚假不实资料的申请人,我们将上报交通主管部门,由交通主管部门依据有关规定对其进行处理。 3.合格的投标人 申请人资质 投标人必须是具备相应资质的施工企业,投标人只有在全部满足了本工程施工所需的工程经验、人员和设备能力以及财务状况,才能通过资格审查。投标人在这些方面的情况将通过资格预审文件中资格预审表的回答来得到证实;业主有权忽略未对投标人履行合同的能力构成实质性影响的微小偏差。本工程不允许有自行分包现象。 人员能力 投标人应拥有满足本工程施工要求的人员来担任相应职务,此外还应为每个可能替换的职位提供一个替补人选,并提供主要候选人和替补人的有关资料。可能替换的职位不得超过20%;主要人员不得替换。 设备能力 投标人应自有或能保证以其它方式,如租赁、租借、签订购买协议或具备生产能力等,并处于完好工作状态的机械设备,根据已知的合同义务证明这些设备可以用于本工程需要。此外,投标人还应列出为本工程建设的备选设备并加以解释。

货物采购 国际竞争性招标文件 前言 财政部世界银行司于1991年组织编写出版了《世界银行贷款项目招标采购 文件X本》(以下称“X本”)一套三册共九种文本,供各项目单位和招标代理机构试用。 1993年5月,财政部与世界银行(以下称世行)决定根据试用的情况对“X本”进行修订,并组成了新“X本”编写组。在文本数量上,除原有的九种外, 新增加了《大宗商品国际竞争性招标文件》、《计算机系统国际竞争性招标文件》、《单个咨询专家咨询合同》以及《标准评标报告格式》等文本,以适应业务发展的需要。 1995年1月,世行对其“采购指南”进行了修改,出版了新版“采购指南”。随后世行根据新“指南”编写了“标准招标采购文件(SBD)”,并要求其借款国在 世行项目的采购中必须使用SBD。经过深入研究,我们认为世行的SBD确是其半个世纪采购经验的结晶,采用SBD的主要条款有利于我国利用世行贷款采购工作的制度化、规X化并与国际标准接轨。但是,考虑到我国的具体情况和采购管理经验,我们认为仍有必要根据中国特有的情况对世行的SBD加以补充。经与世行 充分协商,世行方面理解我们的看法,并同意继续修订和保留中国的“X本”,但要求其主要内容与SBD保持一致。这就对“X本”的修订工作提出了新的要求。 经过三年多的努力,“X本”编写组已先后完成了各主要文本的修订工作。世行也已完成对这些“X本”的终审,同意正式。根据财政部的规定,从1996年7月1日起,我国所有世行贷款项目中每次货物和土建工程的国际和国内竞争 性招标,必须使用财政部统一负责编制的相应的“X本”作为招标文件的商务部分。“X本”的标准条款任何单位不得擅自修改。同时还规定新“X本”的归财政部所有,任何单位不得自行打印、翻印,也不得使用盗版复制的“X本”。 下面把新“X本”的主要特点作一简要介绍: 1.新“X本”体现了世行新版“采购指南”规定的经济性、效率性和增加透明 度的原则。它保留了世行SBD中的投标人须知和合同通用条款,而这些条款在世界各地世行贷款项目的招标采购文件中都是一样的,这就增加了采购工作的透明

发改法规[2008]938号国家发展改革委关于抓紧做好标准施工招标资格预审文件和标准施工招标文件十点工作的通知 -------------------------------------------------------------------------------- (发稿时间:2012-04-05 阅读次数:221) 发改法规【2008】938号 各省、自治区、直辖市计划单列市、副省级省会城市、新疆兵团发展改革委: 国家发展改革委、财政部、建设部、铁道部、交通部、信息产业部、水利部、民航总局、广电总局联合编制的《标准施工招标资格预审文件》和《标准施工招标文件》(以下简称《标准文件》)已于2007年11月1日发布,于2008年5月1日起执行。按照九部委《关于做好标准施工招标资格预审文件和标准施工招标文件贯彻实施工作的通知》(发改法规[2007]3419号)有关规定,现就做好发展改革系统试点工作提出以下要求: 一、高度重视。《标准文件》是国务院有关部门针对实践中存在的突出问题,在总结和借鉴国内外经验的基础上编制的,标志着对招标投标活动管理的进一步深入,对于进一步统一招标投标规则、提高招标文件质量、规范招标投标活动、加强政府投资管理、预防和遏制腐败,以及促进形成统一开放、竞争有序的招标投标市场,将发挥积极作用。选好试点项目,是贯彻实施《标准文件》的关键环节,也是及时发现问题、总结经验,进一步修改完善《标准文件》的重要途径。各单位要高度重视,认真做好试点工作。为全面执行《标准文件》奠定扎实基础。 二、明确责任。国家发展改革委负责指导和协调全国《标准文件》贯彻实施工作,针对施行中反映出来带有普遍性的问题,会同国务院有关部门,对《标准文件》有关内容作出解释或调整。各单位要按照职责分工,指导、协调本地区《标准文件》贯彻实施工作,做好试点项目的选取、督促指导、情况跟踪和意见反馈等工作。 三、抓紧落实试点项目。各单位要结合实际情况,单独或会同本级人民政府有关部门选择一定数量的建设周期较长、施工工艺要求高、规模较大的政府投资项目进行试点,具体数量由各单位本着积极稳妥、实事求是的原则确定。对于国务院有关部门已经全面推开的行业领域,不再选择试点。省级发展改革部门可以结合实际,进一步明确本地区试点项目范围,条件成熟的地方,可以全面推开。

招标的标准

财政部为国际金融组织贷款项目招标 制定标准 自6月1日起,开展世界银行(以下简称世行)、亚洲开发银行(以下简称亚行)贷(赠)款项目下的国内竞争性招标,需统一使用新版《国际金融组织项目国内竞争性招标文件范本》(以下简称《范本》)。 为适应新的形势与政策变化,进一步加强国际金融组织贷(赠)款项目招标采购管理工作,财政部于近日印发了《财政部关于发布〈国际金融组织项目国内竞争性招标文件范本〉的通知》(财际〔2012〕67号)。世行和亚行对华所有贷款、赠款项目的国内竞争性招标采购适用该《范本》。这是自1997年重新出版《世界银行项目招标文件范本》以来最全面的一次修订。修订后的《范本》具有更广泛的适用性。 《范本》包括《货物采购国内竞争性招标文件》和《土建工程采购国内竞争性招标文件》。这两个招标文件均由3篇9章组成,分别包括第1篇“招标程序”、第2篇“采购要求”、第3篇“合同”。其中,招标程序包括投标人须知、招标资料表、评标和资格标准、投标文件格式以及合格国家等;合同包括一般合同条款、特殊合同条款以及合同格式;《货物采购国内竞争性招标文件》的采购要求内容为供货要求,包括货物清单和交货时间

表、相关服务清单和完成时间表、技术规格、图纸、检验和测试等,《土建工程采购国内竞争性招标文件》的采购要求内容为业主要求,包括技术规范、图纸、补充信息等。 考虑到使用的广泛性和具体项目的情况,这两个招标文件均含有固定条款和变动条款2类。固定条款为普遍适用的、不能修改的条款,主要是对投标人须知和一般合同条款的规定。变动条款为可以根据项目具体情况和采购要求进行调整的条款,采购要求和特殊的合同规定可以在投标资料表和特殊合同条款中反映。如投标资料表中,由世行、亚行不同资助方资助的项目可以选择不同的关于支付款项相关条件及要求的条款。 《范本》分中、英文版本。根据要求,世行项目国内竞争性招标一律使用中文版本;亚行项目国内竞争性招标可根据亚行对采购的审核要求与具体情况,选择使用中文版本或英文版本。其他国际金融组织在华项目,可根据相关贷(赠)款机构的具体采购要求自主选择使用版本。 据悉,此次全面修订充分考虑了国内现有采购法律法规以及世行、亚行采购指南和采购政策的要求,反映了采购工作应遵循的经济性、效率性和透明性原则,进一步强调了在招标工作中反欺诈、反腐败的要求,如在招标文件中单独列有关于腐败与欺诈行为条款,并且在投标资料表中规定了欺诈和腐败的定义以及相应的制裁措施。

广播电影电视总局局长: 二〇〇七年十一月一日 《标准施工招标资格预审文件》 和《标准施工招标文件》试行规定 第一条为了规范施工招标资格预审文件、招标文件编制活动,提高资格预审文件、招标文件编制质量,促进招标投标活动的公开、公平和公正,国家发展和改革委员会、财政部、建设部、铁道部、交通部、信息产业部、水利部、民用航空总局、广播电影电视总局联合编制了《标准施工招标资格预审文件》和《标准施工招标文件》(以下如无特别说明,统一简称为《标准文件》)。 第二条本《标准文件》在政府投资项目中试行。国务院有关部门和地方人民政府有关部门可选择若干政府投资项目作为试点,由试点项目招标人按本规定使用《标准文件》。 第三条国务院有关行业主管部门可根据《标准施工招标文件》并结合本行业施工招标特点和管理需要,编制行业标准施工招标文件。行业标准施工招标文件重点对“专用合同条款”、“工程量清单”、“图纸”、“技术标准和要求”作出具体规定。

第四条试点项目招标人应根据《标准文件》和行业标准施工招标文件(如有),结合招标项目具体特点和实际需要,按照公开、公平、公正和诚实信用原则编写施工招标资格预审文件或施工招标文件。 第五条行业标准施工招标文件和试点项目招标人编制的施工招标资格预审文件、施工招标文件,应不加修改地引用《标准施工招标资格预审文件》中的“申请人须知”(申请人须知前附表除外)、“资格审查办法”(资格审查办法前附表除外),以及《标准施工招标文件》中的“投标人须知”(投标人须知前附表和其他附表除外)、“评标办法”(评标办法前附表除外)、“通用合同条款”。 《标准文件》中的其他内容,供招标人参考。 第六条行业标准施工招标文件中的“专用合同条款”可对《标准施工招标文件》中的“通用合同条款”进行补充、细化,除“通用合同条款”明确“专用合同条款”可作出不同约定外,补充和细化的内容不得与“通用合同条款”强制性规定相抵触,否则抵触内容无效。 第七条“申请人须知前附表”和“投标人须知前附表”用于进一步明确“申请人须知”和“投标人须知”正文中的未尽事宜,试点项目招标人应结合招标项目具体特点和实际需要编制和填写,但不得与“申请人须知”和“投标人须知”正文内容相抵触,否则抵触内容无效。 第八条“资格审查办法前附表”和“评标办法前附表”用于明确资格审查和评标的方法、因素、标准和程序。试点项目招标人应根据招标项目具体特点和实际需要,详细列明全部审查或评审因素、标准,没有列明的因素和标准不得作为资格审查或评标的依据。 第九条试点项目招标人编制招标文件中的“专用合同条款”可根据招标项目的具体特点和实际需要,对《标准施工招标文件》中的“通用合同条款”进行补充、细化和修改,但不得违反法律、行政法规的强制性规定和平等、自愿、公平和诚实信用原则。 第十条试点项目招标人编制的资格预审文件和招标文件不得违反公开、公平、公正、平等、自愿和诚实信用原则。 第十一条国务院有关部门和地方人民政府有关部门应加强对试点项目招标人使用《标准文件》的指导
