找工作的人常为面试烦扰。过于紧张会让您忽略到一些细节问题,而这些细节问题有可能非常重要。Looking for jobs is a painful thing, but nearly every one must do it at least once a lifetime. Anyway, there are some points a person must remember to succeed in having an interview.

To begin with, it is not a good idea to be late. People don’t think very highly of the one who arrives twenty minutes late, or explaining that he couldn’t find the street and that his watch was slow. The wise one studies the place the day before, or make sure that he can find the street, the building, the right floor, and the office; at the same time, he looks around to examine what the employees are wearing and how they work. Next day he arrives early. It does not matter if someone recognizes him and mentions his first visit to her boss. On the contrary, the eager fellow can only be regarded as smart, thoughtful, and well organized - three points in his favor before he has said a word.

Then, appearance. It is most important for one to be dressed properly and to look alive- pleasant, interested. It is also very important to look at people in the eyes because this "eye contact’ can strongly suggest that one is honest and open-minded. A few other points are regularly mentioned by the gum or smoke during an interview; they should not sit down before being invited to do so. It is even worse to examine the objects on the desk while the manager is answering the telephone, to listen to the conversation - and perhaps offer a comment afterwards. This is definitely not the time to joke, or to interrupt the interviewer in mid-sentence.

No one wants to look silly or do the wrong thing at a new job. It is important to make the right impression- not the wrong one - from the very first day. You will face new people. You will be in a new place. It may be difficult to know what to do. Here are seven tips to help you make it through the first days at a new job:

1. First impressions can last forever. Make sure you make a good one. Before your first day, find out if your new job has a dress code (rules about what you can wear to work). 抱怨信函写作:发货延迟

Complaints & Claims(抱怨和索赔信函)的目的是为了获取更好的服务,对已出现的问题求得尽快的、妥善的解决。它通常是买方由于对收到的货物不满而书写,如:货物未按时到达;货物虽抵达,但与订单所载不同;货物有损毁现象;货物数量短缺或多余;货物质量与样品不符;服务不合理以及收费过高等,这些均是抱怨、索赔的正当理由。

书写抱怨、索赔信函时,不妨开门见山提出原先双方同意的条件,然后列举事实以表示有何不满,以及为什么不满,最后提出解决的方法。内容应明确、清楚、有理,语气要简洁、坚决。避免使用愤怒和使对方过于难堪的措辞(除非你所抱怨的问题反复发生,且多次投诉而毫无结果)。

For Delay in Shipment (由于发货延迟而抱怨)

Dear Sirs,

The furniture we ordered from you should have reached us a week ago. The delay in delivery has put us to great inconvenience. It is therefore imperative that you dispatch them immediately. Otherwise we shall be obliged to cancel the order and obtain the goods elsewhere.

NO TRICKS:商务谈判中的八字箴言

商业经营中诚信非常重要。中国自古就有“货真价实,童叟无欺”的八字箴言,英文中也有一个八字经典:NO TRICKS。从字面看来,它与中文的意义非常相近。不过“NO TRICKS”并不仅仅代表字面的意思,每一个字母还有更深一层的含义--谈判中的八种能力。

谈判能力在每种谈判中都起到重要作用,无论是商务谈判、外交谈判,还是劳务谈判。在买卖谈判中,双方谈判能力的强弱差异决定了谈判结果的差别。对于谈判中的每一方来说,谈判能力都来源于八个方面,就是NO TRICKS 每个字母所代表的八个单词--need,options,time,relationships,investment,credibility,knowledge,skills。

1. “N”代表需求(need)

对于买卖双方来说,谁的需求更强烈一些?如果买方的需要较多,卖方就拥有相对较强的谈判力。卖方越希望卖出产品,买方就拥有较强的谈判力。

2. “O”代表选择(options)

如果谈判不能最后达成协议,那么双方会有什么选择?如果你可选择的机会越多,对方认为你的产品或服务是唯一的或者没有太多选择余地,你就拥有较强的谈判资本。

3. “T”代表时间(time)

主要是指谈判中可能出现的有时间限制的紧急事件,如果买方受时间的压力,自然会增强卖方的的谈判力。

4. “R”代表关系(relationships)

如果与顾客之间建立强有力的关系,在同潜在顾客谈判时就会拥有关系力。但是,也许有的顾客觉得卖方只是为了推销,因而不愿建立深入的关系。这样。在谈判过程中将会比较吃力。

5. “I”代表投资(investment)

在谈判过程中投入了多少时间和精力?为此投入越多、对达成协议承诺越多的一方往往拥有较少的谈判力。

6. “C”代表可信性(credibility)

如果潜在顾客对产品的可信性也是谈判力的一种,如果推销人员知道你曾经使用过某种产品,而他的产品具有价格和质量等方面的优势时,无疑会增强卖方的可信性,但这一点并不能决定最后是否能成交。

7. “K”代表知识(knowledge)

知识就是力量。如果你充分了解顾客的问题和需求,并预测到你的产品能如何满足顾客的需求,你的知识无疑增强了对顾客的谈判力。反之,如果顾客对产品拥有更多的知识和经验,顾客就有较强的谈判力。

8. “S”代表的是技能(skills)

这可能是增强谈判力最重要的内容了,不过,谈判技巧是综合的学问,需要广博的知识、雄辩的口才、灵敏的思维……

总之,在商业谈判中,应该善于利用“NO TRICKS”中的每种力,当然还要做到NO TRICKS。

合约中“人”的含义

将合约中所牵涉到的特定用语加以定义,是很重要的工作,目的在将语言有限的精确性提升到最高,尽量限制对同一词语作出不同解释的可能性,以避免法律关系的模糊不清引发争议。例如专利权授权契约的当事人对于营业秘密的保护,可能有以下的约定:

The Licensee shall not divulge to any third person any trade secret having to do with the business of the Licensor that shall come to the knowledge of the Licensee by reason of this Agreement, during the term of this Agreement and for three years after the termination of this Agreement.

被授权人于本合约期间及本合约终止后三年内期间,不得将因本合约而得知授权人之营业秘密,泄露给任何其它第三人。

这样的约定看起来已经很完整了,除了Licensee、Licensor 及Agreement这几个大写词通常会在这个条款出现于合约之前,就给予适当的定义以外,还有什么概念需要定义呢?问题就出在于any third person 里面的person 这个概念,究竟范围如何?"自然人"包括在内或许没有问题,但是"法人"属于这里所说的person 吗?或许依照合约上下文可以推知,当事人的意思里person 包括"公司",那么"合伙组织"算不算是这个条款里要规范的person 呢?为避免这种解释上的困扰,同时也为避免意图违约的当事人玩文字游戏,当事人就会考虑在合约第一条加入以下的定义条款:"Person" means-

(i) a natural person & and any corporation or other entity which is given, or is recognized as having, legal personality by the law of any country or territory; or

(ii) any unincorporated association or unincorporated body of persons, whether formed in the United Kingdom or elsewhere, including a partnership, joint venture or consortium.

本合约所称“人”包括:

(i) 自然人、法人、或依照任何国家或领域之法律,享有法人格之主体。

(ii) 在英国或其它地域所组成之非法人组织,例如合伙组织、合资组织、财团组织等等。

individual

如果要特别表示“自然人”(natural person),而排除“法人”的概念,通常会使用individual来代替person 这个字,可以减少疑义。

依照同样的道理,英文合约中常常出现的,还有以下对于“单、复数”及“阴、阳性”名词的范围定义:

"Stock Certificate" includes "stock certificate" and "stock certificates".

"He" includes "he" and "she".

"His" includes "his" and "her".

"Him" includes "him" and "her".

本合约所称“股票”,包括单数与复数。

本合约所称“他”,包括“他”与“她”。

本合约所称“他的”,包括“他的”与“她的”。

本合约所称“他(宾格)”,包括“他(宾格)”与“她(宾格)”。

商务信函中的7个"C"原则

写信的原则(Writing Principles)已从原来的3个"C"(Conciseness, Clearness, Courtesy)发展到目前的7个"C":Completeness, Clearness, Concreteness, Conciseness, Correctness, Courtesy, Consideration.

对商业信函的"完整"要求

要求书信的"完整",理由有三:

1.一封完整的书信比一封不完整的书信,有更大的可能性带来预期的效果;

2.一封完整的书信,有助于建立和表达友善关系;

3.一封完整的书信,可以避免由于遗漏重要情况(情报)所导致的诉讼(Lawsuit);

4.有时,某些不显眼的书信或文件,由于所提供的情况完整而又生动有力(Complete and Effective)而成为极为重要的文件。

一封信写得是否完整,建议用五个"W"来检验,即:

"Who, What, Where, When 及Why (包括How)"

例如在定货的信中,必须明确说明

"需要什么商品"(What you want)

"何时需要" (When you need the goods)

"货物发到何地何人收"(to Whom and Where the goods to be sent)

"如何付款"(How payment will be made)

如对对方的要求做出否定的答复时(如不能报盘,不能理赔等)应说明理由"为什么"(Why)
