On 22 February 2005 the Bahamas flag bulk carrier Clipper Kawa was lying at the outer anchorage off the port of Albany, Western Australia. At about 0815, the Bosun,

with the two deck cadets and two seamen set to work transferring used dunnage lying on the hatch cover of No.3 hold, to the space between the break of the forecastle and No.1 hatch.

The Bosun and the two cadets went to unlash the forward gantry crane of the ship. This done, the senior cadet remained in the starboard driving cab while the Bosun, the junior cadet and the two seamen slung the dunnage. On completion, the Bosun and the two seamen alighted from the port side of the hatch cover, while the junior cadet alighted on the starboard side. The two seamen then went forward, and the Bosun, having received an 'all clear' signal from the cadet on the starboard side, signaled the driver to move the gantry forward to No.1 hatch.

After the gantry crane arrived at No.1 hatch and lowered the dunnage, the Bosun noticed that the junior cadet had not arrived up forward. He walked aft on the starboard side and found the cadet, apparently unconscious, lying against the hatch coamming of No.2 hold. The crew carried him into the crew's recreation room in the accommodation and the Chief Officer started to apply CPR(Cardiopulmonary resuscitation,心肺复苏).

Shortly afterwards, on unzipping the overalls of the cadet, it was found that his abdomen had burst open and it was concluded that he was. The post mortem revealed that he had died from shock and haemorrhage(大出血) following multiple crush injuries.

When a clean bill of lading has been issued(当一份清洁提单已经发出), estoppel arises or, in other words, the carrier is prevented from proving, as against a third party relying on the clean bill of lading, that there was any thing wrong. In the case of inherent vice, however, which is a natural defect in the thing shipped, the carrier is not estopped by his clean bill of lading, because a clean bill of lading, in stating that a certain cargo is on board, gives sufficient notice that this cargo, in the natural course of events, may have certain qualities or defects which all similar cargo normally has. For example, a cargo of flour will shrink slightly, and this fact does not have to be noted on the face of the bill of lading.

Similarly, where cargo is unfit to withstand the ordinary incidents of the contractual voyage contemplated by the parties, owing to some inherent vice or hidden defect presented within it, the carrier is not estopped by the clean bill of lading from asserting the inherent defect exception, provided that the damage has not been aggravated by any conduct of the carrier or those for whom he is responsible.

The carrier issuing a clean bill of lading is only bound by his statements as to the outward condition of the cargo and is therefore not estopped from proving inherent vice or hidden defect when that vice or defect was not apparent at the time of shipment. In other words, a clean bill of lading does not necessarily fulfill the shipper's burden of proof in respect to inherent vice or hidden defect.

(1)It is concluded that on issuing a clean bill of lading, the carrier ______.

A.will not be estopped from proving inherent vice or hidden defect when that vice or defect was not apparent at the time of shipment(缺陷或瑕疵在装运时不明显)

B.will be prevented from proving there is any natural defect in the thing shipped

C.indicates that the cargo is unfit to withstand the ordinary incidents of the contractual voyage contemplated by the parties

D.gives sufficient notice that this cargo has no defects which all similar cargo normally has

(2)The carrier issuing a clean bill of lading will only be bound by ______.

A.inherent vice or hidden defect presented within the cargo

B.the conduct of the carrier or those for whom he is responsible

C.the apparent order and condition of the cargo

承运人签发清洁提单只能由货物的表面状况束缚

D.any thing wrong in the natural course of events

(3)The slight shrinkage of flour面粉的细小的缩水is ______.

A.a damage which is always aggravated by the conduct of carrier

B.a vice or defect which should be noted on face of B/L due to the fact that it is not apparent at the time of shipment

C.an inherent defect of the cargo 货物的内在固有缺陷

D.an outward condition of the cargo

(4)Of the following, ______ in the cargo shipped on board his vessel should be considered as a thing that will give rise to estoppel on the part of the carrier.

A.inherent vice

B.hidden defect

C.inherent defect

D.ordinary incident 普通的事件

A shipowner will normally require an underwriter to provide insurance for the value of the hull and machinery,(船东通常要给船壳和设备买保险)and, in unstable times, war risk insurance. Separate insurance will be negotiated for the cargo. For all the other risks the owner might face during a voyage, pollution, damage to docks and other fixed objects, collision liability, crew liability, strikes and their consequences and even the cost of wreck removal if his ship is lost, the owner will arrange this with a Protection and Indemnity Association. This is often termed the 'club' and it is an apt description as it is normally organised with a group of owners agreeing to share their losses on a mutual basis. Once again this has the effect of spreading the losses over a number of owners, and minimising its effect upon the individual owner.

Until recently, marine insurance was an option that an owner could opt (选择) out of, and there were indeed some very high quality owners who calculated that they could cover their own losses, as these happened but rarely. Other owners may agree that they themselves will pay a proportion of any losses, minimising the cost of insurance with this 'deductible'. Insurance for today's enormously valuable ships and their cargo is very necessary, and in some areas 'third party' insurance is becoming mandatory. There is also some concerns that with risks multiplying, even a modest ship can become involved in a casualty that could multiply into a 'catastrophe', with gigantic and unsustainable costs.

(1)The author implies the following EXCEPT ______.

A.Although some owners tend to cover their own losses, Insurance for shipping today particularly the enormously valuable ships and their cargo is still very necessary

B.The risks of shipping in suffering from gigantic and unsustainable costs are increasing

C.The risks of shipping in suffering from gigantic and unsustainable costs are decreasing

D.Although some owners tend to cover their own losses, third party insurance is still very necessary and is becoming mandatory in some respects

(2)Which of the following statement is correct according to the passage?

A.Hull insurance and the P&I insurance are both for the interest of the insurers

B.Hull insurance is much more important than the P&I insurance

C.P&I insurance is much more important than the Hull insurance

D.Hull insurance and the P&I insurance are both for the interest of the shipowners

(3)Shipowners would not select maritime insurance to protect themselves or would increase the proportion of the losses which they are to be responsible because ______.

A.They can bear the cost of or a portion thereof the losses of their own

B.They are not satisfied with the services provided by the insurers

C.They have very good safety records in maintaining their ships

D.They are cleverer than the insurers

(4)The principle and mechanism on how the P&I insurance works is ______.

A.Owners in the club share the losses involuntarily

B.Owners in the club share the losses reasonably

C.Owners in the club share the losses jointly and severally

D.Owners in the club share the losses equally
